The Judicial Politics Of White Collar Crime, J. Kelly Strader

White collar crime cases produce a curious paradox in Supreme Court jurisprudence: in a substantial number of the Court's leading white collar criminal cases, ranging from insider trading to political corruption cases, the "liberal" justices have voted to affirm convictions, and the "conservative" justices to reverse them. Even more frequently, these cases have produced strange alliances among the liberals and conservatives, who rarely split into such groupings in non-white collar criminal cases. And it is not merely votes and alliances that change in white collar cases; judicial philosophies, attitudes, and rhetoric transmogrify into a veritable twilight zone of Supreme Court …

America's Uneasy Relationship With The Working Poor, A. Mechele Dickerson

While Americans historically have supported efforts to provide financial assistance to the truly needy members of our society, we have a fear that giving cash or other forms of economic assistance to the unemployed but able-bodied is morally corrupting and fosters economic dependency. Recent efforts to overhaul welfare and bankruptcy laws resulted from the public's perception that too many people failed to become economically self-sufficient despite an extended peacetime period of economic prosperity.

Institutional Signals And Implicit Bargains In The Ulp Strike Doctrine: Empirical Evidence Of Law As Equilibrium, Michael H. Leroy

Law as Equilibrium hypothesizes that the Supreme Court acts strategically, through signals and implicit bargains with the coordinate branches, to import its substantive values to public policies. In this Article, Professor LeRoy provides strong empirical support for this theory.

Examining 467 National Labor Relations Board decisions over a 60- year period that categorized permanent replacement strikes as "economic" or "unfair labor practice" (ULP) strikes, I find remarkable evidence of decisional constancy. For the 1940s, the Board ruled that a replacement strike was also a ULP strike in 39% of its cases. These rulings essentially negated an employer's right to hire …

A Comparison Of Two Approaches Of Symbolic Modeling And Self -Efficacy, Roy James Hamilton

The effect of video and written modeling on self-efficacy of 70 master's degree students enrolled in their first techniques course was investigated. The ability to understand and use reflection of content, feeling, and meaning was presented to the experimental group through videotaped instruction and examples and the control group through written instruction and examples. Facts about reflecting skills, which included information and three vignettes, demonstrated the use of the skills. Through two pilot studies, the Reflecting Skills Questionnaire (RSQ) developed for this study showed convergent validity with the Counseling Self-Estimate Inventory (COSE). The 1990 national census report revealed that Indiana ranked 47 th in the nation in regard to individuals over the age of 25 with bachelor degrees. Forty-nine percent of the 1995–96 Indiana high school graduates matriculated into Indiana higherEducation institutions—56 percent in-state and out-of-state (Indiana Commission for HigherEducation Report, 1998). However, the African-American student persistence rate is 24 percent, regarding those who attain a bachelor degree within four years compared to 51 percent for all students. However, if extended to six years, the percentage increases to 42.2 percent compared to 57.5 percent for all students. This study determined certain retention …

The project we describe in this article emerged from thinking about Fridays. While the Monday through Thursday schedule at Renaissance Middle School in Montclair, New Jersey covers the traditional distribution of curriculum, Fridays are dedicated to nine-week cycles of two hour sessions. Each session involves in-depth work focusing on five themes: Aviation, Genetics, Building Bridges, Community Service and this, the Oral History Project. Because the school is thematically organized around core notions of justice, history, social movements and "renaissances" (that is, Italian, Harlem and Montclair), we structured this project around the deeply contested history of desegregation of the Montclair public …

It is widely accepted in the literature that internalised childhood psychopathology including anx1cty is best identified by child self-report, followed by observations by parents and then to a lesser extent, by teachers. Although anxiety scales are a useful way to quantify anxiety symptomatology and progress through treatment, changes to classification systems (e.g., DSM-111-R to DSM-IV) make their ability to screen for the presence of psychiatric problems difficult. This research looked at whether the Anxiety Cluster (AC) scale of the Piers-Harris Children's Self-Concept Scale (PHCSCS) can be used to identify anxiety disorders in children. Cervical cancer remains a significant cause of death in women. There is a notable age related decrease in levels of screening and women aged over 50 years with later, more invasive disease. One hundred and forty women aged between 50 and 69 years (M "'58.21 years) and 23 Pap smear providers completed a Cervical Cancer Screening Questionnaire designed to identify the relative importance of barriers to attendance for cervical screening, as well as providers own barriers and issues. Previous research exploring the relationship between litigation status and the symptoms of the plaintiff has been inconsistent and limited by methodological dlfficulties. While Mendelson (1984, 1986, 1988) argued there was no difference In symptoms and rates of work return between litigating chronic pain patients and those not involved in the compensation system, others argued that work related injuries were maintained either by the plaintiffs' wish for monetary compensation (compensation neurosis), or by their involvement in the medico-legal process with the stress of the litigation slowing down the recuperative process (nomogenic influences). This thesis examines Aboriginal mothers as one of the major variables to their daughters' participation and achievement in tertiary education. It presents the findings of research that Investigated specific nurturing behaviours of four Aboriginal mothers who assisted their adult daughters to participate and achieve in tertiary education. The research is qualitative in nature and research data was collected using interviews and ethnographic observations of the eight participants over a two and a half-year period. The observations and interviews were made of Aboriginal mothers whose daughters had achieved a degree or diploma through a university or further education institution. The findings …

Depression in older adults can have fatal consequences if undetected and not treated. Comparisons of studies are difficult because of the lack of methodical consistency. The literature is reviewed with regard to the definition, prevalence, consequences, recognition, treatment and prognosis of depression in relation to general practitioners (GPs) and with particularly regard to elderly males. The research indicates poor recognition and treatment of depression in older adults, despite the research indicating that older adults have a similar prognosis as younger adults, when the depression is treated. Factors influencing the detection of depression are included.

The present study investigated the existence of repetition priming for melody and the extent to which that priming would be affected by the manipulation of frequency. A group of 62 university students and 2 members of the public listened to 20 high frequency and 20 low frequency melodies in the first phase of a repetition priming experiment. Participants were required to name as many melodies as they could as quickly as possible. The same melodies were then re-presented immediately in the second phase of the experiment along with another group of 40 melodies matched in frequency to those in the …

This is a symbolic interactionist study into behaviours surrounding social interaction. The study has two components, asking how people with able-bodies interact with a young person with a disability, and how does the young person, who is non-verbal, respond to and interpret such interactions? Participants were observed and recorded using a digital camera whilst interacting at a social venue. The able-bodied participants were not aware of the camera at the time of filming, and were approached after the filming to participate in the study.
