Towering Figures, Enigmas, And Responsive Communities In American Legal Ethics, Thomas L. Shaffer Jan 1999

Towering Figures, Enigmas, And Responsive Communities In American Legal Ethics, Thomas L. Shaffer

Journal Articles

The first thing Niebuhr and Guttman are telling us to do is to look around and figure out what is going on around us. With that in mind, it has seemed to me that, at the simplest, a lawyer (or a journalist) functions in at least four communities, any one of which might be a community to talk about lawyers' moral questions in.

My inquiry, then, is an inquiry in communitarian legal ethics, using a Guttman-Niebuhr focus on responsibility. I infer a further question about communities of moral discernment—that is, not only where a modern lawyer is responsible but also …

Reconciling Loss Aversion And Guilty Pleas, Richard Birke Jan 1999

Reconciling Loss Aversion And Guilty Pleas, Richard Birke

Utah Law Review

In the context of criminal law, a criminal defendant may choose to waive the right to trial because the defendant does not value objectively and appropriately the worth of a trial relative to the worth of a plea, or because the defendant lacks information to make an informed valuation. Until and unless a researcher's privilege comes to exist, one will have to speculate about why defendants are making bad choices, and accordingly, about the right way to fix the problem.

Using The Same Actor "Inference" In Employment Discrimination Cases, Anna Laurie Bryant, Richard A. Bales Jan 1999

Using The Same Actor "Inference" In Employment Discrimination Cases, Anna Laurie Bryant, Richard A. Bales

Utah Law Review

The same actor inference provides a simple rationale for disposing of easy cases, and reduces in some small degree the legal burden that Title VII places on employers who hire minority employees. It does not, however, provide absolute proof that discrimination has not occurred. For this reason, in Burdine-type cases where the plaintiff's circumstantial evidence of discrimination is weak, courts should be free to apply the inference in summary judgment or directed verdict proceedings as part of the third step in the Burdine framework. The effect of the inference should be to hold the plaintiff to a slightly higher standard …

The Third Model Of Criminal Process: The Victim Participation Model, Douglas Evan Beloof Jan 1999

The Third Model Of Criminal Process: The Victim Participation Model, Douglas Evan Beloof

Utah Law Review

It is time to face the fact that the law now acknowledges the importance of victim participation in the criminal process. Thirty-one states have chiseled victims' rights into their respective constitutions. The federal government and the rest of the states have enacted numerous statutory rights for victims? An amendment to the United States Constitution providing civil rights for crime victims has been proposed& and is the topic of authors in this symposium. There are those who resist acknowledging the existence, genuine nature, and significance of victim participation laws. The state of denial that accompanies such resistance has stood in the …

Victim Standing, Susan Bandes Jan 1999

Victim Standing, Susan Bandes

Utah Law Review

The most cynical conclusion regarding the judicial role in protecting victims' interests is that, for standing purposes, the only collective interest cognizable is the government's own definition of its own interests, which it buttresses when necessary by claiming to represent victims or society as a whole. There are less cynical conclusions as well. Federalism, separation of powers, and prosecutorial discretion all play important and legitimate roles, when properly defined and limited. We can debate what those limits ought to be. For the purposes of this conference, however, the question is not so much the judicial role, or even the prosecutorial …

The Crime Victims' Rights Amendment And Two Good And Perfect Things, Steven J. Twist Jan 1999

The Crime Victims' Rights Amendment And Two Good And Perfect Things, Steven J. Twist

Utah Law Review

After years of struggle, we now know that the only way to make respect for the rights of crime victims "incorporated with the national sentiment" is to make these rights a part of the sovereign instrument of the whole people, the Constitution. The movement for constitutional rights for crime victims, properly understood, constitutes neither an attack on the rights of defendants, nor on the power of public prosecutors, but rather is a movement to save these two good and perfect things in the American justice system by tempering their excessive virtue with true balance. Indeed, this Amendment just might save …

Reply To Paul Cassell: What We Know About Victim Impact Statements, Susan Bandes Jan 1999

Reply To Paul Cassell: What We Know About Victim Impact Statements, Susan Bandes

Utah Law Review

Cassell fails to offer empirical evidence that victim impact statements increase victim satisfaction with the criminal process. More important, he fails to address (and indeed conflates) the difficult issues raised by the separate question of whether the criminal sentencing hearing can or should be a forum for the healing of the friends and relatives of homicide victims.

Barbarians At The Gates? A Reply To The Critics Of The Victims' Rights Amendment, Paul G. Cassell Jan 1999

Barbarians At The Gates? A Reply To The Critics Of The Victims' Rights Amendment, Paul G. Cassell

Utah Law Review

Until we have further analysis of the data, lack of firm proof that Payne increased the number of death penalty convictions should count heavily against Professor Bandes and others who argue against admitting victim impact statements because of their effects on juries.31 9 Allowing surviving family members to make impact statements clearly improves the perceived fairness of the process32° and we have no proof that juries have been influenced, let alone unfairly influenced.

The Violence Against Women Act And Contemporary Commerce Power: Principled Regulation And The Concerns Of Federalism, Parker Douglas Jan 1999

The Violence Against Women Act And Contemporary Commerce Power: Principled Regulation And The Concerns Of Federalism, Parker Douglas

Utah Law Review

In confronting the issues raised by the current judicial assessments of VAWA, this Note has attempted to synthesize a workable Commerce Clause test from previous Commerce Clause jurisprudence, a test faithful to principles of federalism and one that courts may use to assess the constitutionality of statutes that regulate non-economic, intrastate activities. Ultimately, commerce power questions are largely political in nature and any attempt to fashion justiciably manageable standards of review of Commerce Clause questions must recognize and respond to this fact. With this in mind, this Note has argued that Commerce Clause jurisprudence should focus on the regulated activity's …

Dietary Interactions Influencing Feed Intake, Nutrient Utilisation And Appetite Regulation In The Rainbow Trout, Oncorhynchus Mykiss, Ahmet Adem Tekinay Jan 1999

Dietary Interactions Influencing Feed Intake, Nutrient Utilisation And Appetite Regulation In The Rainbow Trout, Oncorhynchus Mykiss, Ahmet Adem Tekinay

School of Biological and Marine Sciences Theses

Dietary factors are one of the most significant considerations in the regulation of appetite in fish since dietary nutrient and energy concentration modulate feed intake in the short and longer term. These interactions may also be important from a commercial aspect, since the objective of aquaculture is to obtain maximum growth, feed efficiency and consumer acceptance of the product. This thesis addresses the major dietary components which are likely to influence appetite in rainbow trout. These include dietary lipid level, carbohydrate content and degree of complexity as well as energy density and protein/energy ratio. Experimental data is presented which examines …

The Ethics Of Intimate Student-Faculty Relationships, Brian Craig Steinberg Jan 1999

The Ethics Of Intimate Student-Faculty Relationships, Brian Craig Steinberg

Graduate Research Papers

What are the ethics behind intimate student-faculty relationships in higher education? Should such relationships be allowed? Can they be legally controlled? Should there be a penalty for faculty and students who engage in these relationships? Consenting romantic and/or sexual relationships between faculty and student, or between student services professional and student, although usually not expressly forbidden, are generally deemed unwise (Cahn, 1986). According to Svinicki (1994), codes of ethics for most professional associations forbid "professional-client" sexual relationships. In an educational institution, the professor-student and student affairs professional-student relationships are thus such "professional-client" relationships. The respect and trust accorded a professor …
