Applying The Ada To Mitigating Measures Cases: A Choice Of Statutory Evils, Lisa A. Eichhorn Jan 1999

Applying The Ada To Mitigating Measures Cases: A Choice Of Statutory Evils, Lisa A. Eichhorn

Faculty Publications

This Article critiques the idea that the ADA should exclude from its coverage people who use mitigating measures, such as medications and medical devices, to alleviate the effects of their mental and physical impairments. After describing the statute as an expansive but flawed tool for combating disability-based discrimination, the Article analyzes a 1999 trilogy of Supreme Court cases holding that in determining whether a person has a disability for purposes of ADA coverage, courts should take account of the ameliorative effects of so-called mitigating measures on the person’s impairments. Through this holding, the Court inappropriately constricted the scope of the …

Major Litigation Activities Regarding Major Life Activities: The Failure Of The Disability Definition In The Americans With Disabilities Act Of 1990, Lisa A. Eichhorn Jan 1999

Major Litigation Activities Regarding Major Life Activities: The Failure Of The Disability Definition In The Americans With Disabilities Act Of 1990, Lisa A. Eichhorn

Faculty Publications

The passage of the Americans with Disabilities Act ("ADA") in 1990 has been praised as the major accomplishment of the disability rights movement. This statute, however, is not without its flaws. Perhaps the most problematic one is the way in which “disability” is defined. Lisa Eichhorn argues that the definition undercuts the effectiveness of the ADA. She begins with a historical look at society’s concepts of disability and discusses how these concepts were incorporated into the Rehabilitation Act of 1973 and the ADA. She then examines cases that have been dismissed because plaintiffs cannot prove disabled status, which illustrate the …

Pm 704 Marriage And Family Counseling, Virginia Todd Holeman

Syllabi

Friedman, E. H. (1985). Generation to Generation: Family Process in Church and Synagogue. New York: Guilford Press. This is the foundation text for this course. You may find this challenging reading if family systems terms are new to you. Friedman's insights into the processes of family and church are worth the price of the book - especially chapters 8 & 9. Guerin, P.J., Jr., Forgarty, T. F., Fay, L.F., Kautto, J. G. (1996). Working with Relationship Triangles. New York: Guilford Press. Guerin, et al. adds some meat and bones to many of Friedman's principles. I found this book very engaging, …

All-Inclusive List of Electronic Theses and Dissertations

American schools are rapidly introducing new technological tools to their staff members and students. Using both quantitative tools and qualitative strategies, the researcher undertook a case study at a small Midwestern school to determine whether teachers have concerns about technological innovations and if so, to specifically identify and measure teachers' levels of concerns about the introduction of computers to their classrooms. The quantitative data, collected from instruments developed by Concerns-Based Adoption Model theorists, revealed that teachers do have concerns about technology, and their concerns are most often centered in the self” domain. Disabled Meanings: A Comparison Of The Definitions Of Disability In The British Disability Discrimination Act Of 1995 And The Americans With Disabilities Act Of 1990, Nick Wenbourne Jan 1999

Disabled Meanings: A Comparison Of The Definitions Of Disability In The British Disability Discrimination Act Of 1995 And The Americans With Disabilities Act Of 1990, Nick Wenbourne

UC Law SF International Law Review

The British Disability Discrimination Act (DDA) marks an important turning point in the history of disability civil rights in Great Britain. The DDA was the first legislation in Europe to specifically acknowledge that disabled people suffer from discrimination in a number of fields and public services including employment, education and transportation. However, people across the political spectrum have criticized the DDA.

This note compares the DDA with its United States counterpart, the Americans with Disabilities Act (ADA), which is widely regarded as the most comprehensive and radical legislation of its kind in the world. This note pays particular attention to …
