Race, Space, And Place: The Geography Of Economic Development, Audrey G. Mcfarlane Jan 1999

Race, Space, And Place: The Geography Of Economic Development, Audrey G. Mcfarlane

San Diego Law Review

In 1993, Congress authorized a community and economic development program called The Empowerment Zone and Enterprise Cities Demonstration Program ("Empowerment Zones Program") to create geographic zones within certain selected cities that would be eligible for special federal attention to alleviate pervasive conditions of

poverty and economic distress within the cities. The program is self- described as a strategy "to create jobs and business opportunities in [the]

most economically-distressed areas of inner cities' by providing tax incentives and social service funds within the zone to stimulate business creation and expansion and attain, over the long-term, revitalization of

the distressed community. The …

Slaves To Fashion: A Thirteenth Amendment Litigation Strategy To Abolish Sweatshops In The Garment Industry, Samantha C. Halem Jan 1999

Slaves To Fashion: A Thirteenth Amendment Litigation Strategy To Abolish Sweatshops In The Garment Industry, Samantha C. Halem

San Diego Law Review

Viewed as a relic of a bygone era, modem legal teaching largely ignores the Thirteenth Amendment. Few constitutional law textbooks give it any more than a passing glance.' After all, slavery was abolished in the United States in 1863. While it is true that some scholars have suggested new applications for the Civil War Amendment legal practitioners have found few practical applications. This Article proposes a real world application of the Thirteenth Amendment to a current real world problem. Legal practitioners have under-utilized the Thirteenth Amendment. They should employ the Thirteenth Amendment as a valuable tool for fighting slavery and …

The Tort That Refuses To Go Away: The Subtle Reemergence Of Public Disclosure Of Private Facts Jan 1999

The Tort That Refuses To Go Away: The Subtle Reemergence Of Public Disclosure Of Private Facts

San Diego Law Review

This Comment focuses instead on the subtle reemergence of the private facts tort in factual scenarios Warren and Brandeis most likely could not foresee one hundred years ago. Part II of the Comment briefly describes the development of the private facts tort. Part III examines the inevitable conflict between the private facts tort and the First Amendment, and common law attempts to reconcile that conflict through variations of the "newsworthiness" defense. Part IV focuses on the resurrection of the private facts tort in recent case law, due to judicial limitation of the newsworthiness defense. Finally, after examining the problems associated …

Modelling Of Swash Zone Sediment Transport On Coarse Grained Beaches, Eur Ing Erik Van Wellen Jan 1999

Modelling Of Swash Zone Sediment Transport On Coarse Grained Beaches, Eur Ing Erik Van Wellen

School of Engineering, Computing and Mathematics Theses

A review is presented which assesses the importance of the swash zone as a potential contributor to the longshore and cross-shore transport on steep coarse-grained beaches. Based on this review it is apparent that the swash zone on such beaches forms an important contributor to both the longshore and the cross-shore transport. The review also identifies that the swash zone is neglected in all but a few sediment transport models. In addition, a lack of available shingle beach field data against which to validate existing and new transport models is also reported. Two surf zone integrated equations are presented with …

Advanced Magnetic Thin-Film Heads Under Read-While-Write Operation, Frank Zhigang Wang Jan 1999

Advanced Magnetic Thin-Film Heads Under Read-While-Write Operation, Frank Zhigang Wang

School of Engineering, Computing and Mathematics Theses

A Read-While-Write (RWW) operation for tape and/or potentially disk applications is needed in the following three cases: 1. High reliability; 2. Data servo systems; 3. Buried servo systems. All these applications mean that the read (servo) head and write head are operative simultaneously. Consequently, RWW operation will require work to suppress the so-called crossfeed field radiation from the write head. Traditionally, write-read crossfeed has been reduced in conventional magnetic recording heads by a variety of screening methods, but the effectness of these methods is very limited. On the other hand, the early theoretical investigations of the crossfeed problem concentrating on …

The group comprised two distinct major subsidiaries, Waterford Crystal which produced crystal glass and Josiah Wedgwood whose main business was ceramic tableware. Redmond was Chief Operating officer of Waterford Crystal. With the impending retirement of the current Chief Executive, Paddy Galvin, Redmond …

Developing Ireland As A Successful Garden Tourism Destination, Catherine Elizabeth Gorman Jan 1999

Developing Ireland As A Successful Garden Tourism Destination, Catherine Elizabeth Gorman

Conference papers

The marketing of Ireland as a garden destination has been evolving over the past six years. The complexity of Ireland’s history and modern circumstances have led to the demise of Irish gardens over the past three centuries. An initiative entitled The Great Gardens of Ireland Restoration Programme has been operated under the Operational Programme for Tourism 1994-99 which has been funded by the European Union. The outcome of the scheme has been twofold; the funding has rescued a significant part of Irish heritage and history; it has provided many new comprehensive tourist attractions to both the domestic and overseas market. …

Las Mujeres De Oro, Benjamin J. Nelson '99

Honors Projects

The Case Of Pearl S. Buck: Neglect And Abandonment Vs. Recognition And Recovery, Linda K. Adkins Jan 1999

The Case Of Pearl S. Buck: Neglect And Abandonment Vs. Recognition And Recovery, Linda K. Adkins

Dissertations and Theses @ UNI

Pearls. Buck was the third American to win the Nobel Prize for Literature, the first American woman to win this Prize, and only the fourth woman in the world to do so. Taking into consideration the Nobel Prize and all the additional honors and awards Buck and her writing received, it is odd that she has been abandoned by American literary critics. Therefore, it is the goal of this thesis to identify reasons why Pearl Buck and her works have been neglected, and to provide significant reasons why she and her work should be recognized and studied. The first part …

Juvenile Justice Professionals And The Goal Of Rehabilitation, Heather Bruch Jan 1999

Juvenile Justice Professionals And The Goal Of Rehabilitation, Heather Bruch

Dissertations and Theses @ UNI

Numerous studies conducted over the past 20 years have suggested that support for rehabilitation in the criminal justice system has decreased. As a result of these findings, an increase in the examination of support for rehabilitation has occurred. According to much of the research on this issue, an important factor in the support of rehabilitation is the attitudes of criminal justice workers. The increasing prison populations are partially responsible for the heightened interest in this issue. It is believed by many that the attitudes of the workers in the criminal justice system have an effect on the success of the …

The Ob-Literation Of Art, Walter Sun Chien Jan 1999

The Ob-Literation Of Art, Walter Sun Chien

Dissertations and Theses @ UNI

I read a story, a true story in fact, with real people and real events, an account really, about a piece of cloth. This piece of fabric, brocade actually, had been cut from an old sofa, a couch; stained "shit-brown" from dried blood so went the account. In truth, it was Adolph Hitler's blood on that piece of cloth cut from the couch which he sat on in his bunker beneath burning Berlin before and after he blew his brains out and bled on the brocade.

Degradation Of Explosives In Solution Using Bacteria, A Fungus (Phanerochaete Chrysosporium), Titanium Dioxide, Ozone, And Electrochemical Peroxidation, Stéphane Debost Jan 1999

Degradation Of Explosives In Solution Using Bacteria, A Fungus (Phanerochaete Chrysosporium), Titanium Dioxide, Ozone, And Electrochemical Peroxidation, Stéphane Debost

Dissertations and Theses @ UNI

As a result of munitions manufacturing and decommissioning, explosive compounds have contaminated groundwater and soils at many sites throughout the U.S. and worldwide. Three of the most commonly occurring explosive contaminants are TNT, ROX, and HMX. Many processes, biological as well as physical, have been developed to remediate the contaminated material. But feasibility studies rarely take into account the three contaminants at once. We chose four of the technologies used to remediate explosives-contaminated water and studied comparatively their effectiveness and efficiency in degrading TNT, ROX, and HMX in solution at their maximal solubilities. The chosen technologies were bacterial and fungal …

Meiosis: The Analysis Of Using A Modified Teaching Approach, Christine Marie Graf Jan 1999

Meiosis: The Analysis Of Using A Modified Teaching Approach, Christine Marie Graf

Dissertations and Theses @ UNI

It is well documented that to successfully learn genetics an understanding of meiosis is often thought necessary, and to effectively learn meiosis, knowledge ofDNA structure is also thought to be necessary. Based on student misconception research, recommendations for teaching meiosis suggests several modifications of the teaching approach. This study investigated whether the concept of meiosis could be learned successfully by the use of a modified teaching approach based specifically on research recommendations. Modifications included (a) using student generated diagrams, (b) reducing the amount of vocabulary, ( c) clarifying and differentiating the terms used, ( d) using the cell cycle to …

The Impact Of The Internet On Democratic Discourse, Dalia K. Hamed Jan 1999

The Impact Of The Internet On Democratic Discourse, Dalia K. Hamed

Dissertations and Theses @ UNI

The Internet has demonstrated the ability to empower its users by giving them more accurate information about matters of political, professional, and organizational concerns. While many believe that the Internet will fundamentally change political discourse, others argue that it is just another communications tool among many that may affect how governments function, but it will not affect democratic discourse. The thesis argues that unless some requirements are met, the Internet potential as a new democratic forum will not be fulfilled. Concepts such as freedom of speech, democracy, and democratic communication are essential to analyzing the potential use of the Internet …

Dramaturgical Perspective In Modern Police Work : An Analysis Of Interviews And Observations, Michael P. Wagner Jan 1999

Dramaturgical Perspective In Modern Police Work : An Analysis Of Interviews And Observations, Michael P. Wagner

Dissertations and Theses @ UNI

Using a qualitative approach, I analyze data collected from two small Midwestern police departments. I gathered this data through a combination of methods: ethnographic interviewing, participant observation, and content analysis of police artifacts and documents. Most of the data derive from (1) my ethnographic interviews of 17 police officers and (2) my observations of officers during 16 "ride-along."

My analyses are guided by Goffman's (1959) dramaturgical analysis of face-to-face interaction, Manning's (1971; 1977) dramaturgical approach to policing, and Hunt and Manning's (1991) dramaturgical studies of police lying and the use of normal force (see also Hunt 1985). I rely most …

Idols Are For Suckers: An Exhibition Of Prints, Brett Anthony Fisher

Dissertations and Theses @ UNI

In this show I have included some of the prints that I have made during my time as a graduate student at the University of Northern Iowa. I believe that these prints show development and transition in style and sensibility. As I have worked, I have tried to continually develop my art. With every print there is an attempt to go beyond the barriers of the previous one. Working intuitively, I try not to have any preconceived notions of what the final piece is going to look like. Every step in the process is valuable; I don't always necessarily know …

Unwanted sexual experiences whilst under the age of sixteen were surveyed. Response rates were high and indicate that unwanted sexual experiences prior to age sixteen are experienced by some 30% of female respondents. Indecent exposure was the most frequently reported experience. This figure falls considerably for contact and penetrative forms of abuse. Long term effects of non-contact forms of abuse were most frequently reported as embarrassment. More acute effects, such as suicidal tendencies, …

Congressional Accountability And Denial: Speech Or Debate Clause And Conflict Of Interest Challenges To Unionization Of Congressional Employees , James J. Brudney Jan 1999

Congressional Accountability And Denial: Speech Or Debate Clause And Conflict Of Interest Challenges To Unionization Of Congressional Employees , James J. Brudney

Faculty Scholarship

In 1995, Congress passed the Congressional Accountability Act, which applied federal workplace and anti-discrimination laws to Congress. Under the terms of the Act, Congress can prevent legislative staff from unionizing if the presence of organized employees would raise constitutional problems or present a conflict of interest. In this Article, Professor Brudney argues that these constitutional conflicts and issues do not pose sufficient concern to outweigh the workplace rights of congressional staff. Rather, he maintains that Congress, should either fulfill its obligations under the Act and allow legislative staff to unionize, or else enact a statute and explain the need for …
