Analysis Of Technology Plans Of Selected Suburban Elementary Schools Within Regional Office Of Education/North Cook Intermediate Service Center #1, Diane V. Ettelbrick

Masters Theses

Technology continues to be a topic of great interest and concern in the educational community. The educational system is responsible for preparing students so that they can function successfully in life and work in the world of today and tomorrow. The interest and concern regarding technology in the educational setting has spread in recent years to include the sectors of business and politics. East Maine School District No. 63, where the author of this study is employed as a Library/Media Specialist, has not developed a formal technology plan as recognized by the Illinois State Board of Education. The purpose of …

Millennial Rhetoric At The Turn Of The Millennium, John Robert Stanley Jan 1999

Millennial Rhetoric At The Turn Of The Millennium, John Robert Stanley

Masters Theses

Millennial rhetoric has predominately had an apocalyptic theme in the past; however, the current rhetoric about the millennium can be seen as more positive, optimistic, and enthusiastic. By treating the texts Deep Impact and Armageddon, various news sources, and five web sites as part of what Becker (1971) defines as a "mosaic," it was found that the current view of the millennium presents various tensions present in our current society. These tensions include unity versus individualism, technological advancement versus technological limitations, and optimism versus angst. The analysis suggests that unity is preferred over individualism to overcome current obstacles at …

Opinion: The Public Intellectual, Service Learning, And Activist Research, Ellen Cushman Jan 1999

Opinion: The Public Intellectual, Service Learning, And Activist Research, Ellen Cushman

Service Learning, General

While I support the good intentions of those who have recently proposed definitions of the public intellectual, I find these definitions problematic in their narrow delineation of the word "public"- they focus on a "public" consisting of middle and upper class policy makers, administrators, and professionals, and, in doing so, omit an important site for uniting knowledge-making and political action: the local community.

What Hath Ovitz Wrouqht: Agents V. Managers Revisited, Donald E. Biederman Jan 1999

What Hath Ovitz Wrouqht: Agents V. Managers Revisited, Donald E. Biederman

Vanderbilt Journal of Entertainment & Technology Law

For more than 60 years, a feud has raged between artists' managers and talent agents. In part, this has to do with philosophical differences concerning the role which each plays in the development and furtherance of their clients' careers, and in part it concerns the levels of compensation each can receive. As a general rule of thumb, the job of an agent is to find work for his/her clients, whereas the job of a manager is to guide and develop the client's career. Of equal importance is the manner in which they are regarded by prevailing law. Agents have been …

The Times They Are A Changin': How Technology Has Forced The Law To Deal With A New Era In Music Distribution, Mark Plotkin Jan 1999

The Times They Are A Changin': How Technology Has Forced The Law To Deal With A New Era In Music Distribution, Mark Plotkin

Vanderbilt Journal of Entertainment & Technology Law

The United States has attempted to keep pace with emerging digital music distribution technology through its copyright law. However, the perfect quality, limitless geographical scope, and exponential growth of digital music delivery implicate the varied and conflicting interests of songwriters, performers, record companies, broadcasters, and the public. Reconciling the interests of these groups in digital music delivery has not been, and will not be, easy...

To understand how the 1995 Act and the DMCA change music licensing, one should be aware that, in general, two distinct copyrights exist for each song that is recorded: the song copyright and the sound …

Phoenix Rising: Inside The Owner's Box With Counsel To Jerry Colangelo, J. S. Ruffner Jan 1999

Phoenix Rising: Inside The Owner's Box With Counsel To Jerry Colangelo, J. S. Ruffner

Vanderbilt Journal of Entertainment & Technology Law

In late spring of 1987, I received a telephone call that changed my law practice. Jerry Colangelo, General Manager of the Suns since its arrival in Phoenix as an expansion NBA franchise in 1969, called me to discuss representing a group of investors he was putting together for the purchase of the franchise. At the time, the Suns franchise was the only major professional sports team in Arizona and had been very successful. Unfortunately, the reputation of the team, carefully nurtured from its arrival, recently had been tarnished by allegations and investigations concerning drugs. Jerry explained that the Tucson and …

Revisiting Victim's Rights, Lynne Henderson Jan 1999

Revisiting Victim's Rights, Lynne Henderson

Utah Law Review

In a 1982 referendum, the voters of California approved Proposition 8-the first state "victim's rights" amendment-revising a number, of provisions of the California Constitution. I wrote The Wrongs of Victim's Rights in response to that referendum and the Reagan Administration's Task Force on Victims of Crime Final Report. At the time I wrote the article, I had recently been a victim of a violent rape committed by a burglar; I had had two friends murdered in separate killings; and I knew others who had had family members killed, as well as many friends who were victims of other crimes. I …

Sailing Through Designing Memo Assignments, Lorraine K. Bannai, Anne Enquist, Judith Maier, Susan Mcclellan Jan 1999

Sailing Through Designing Memo Assignments, Lorraine K. Bannai, Anne Enquist, Judith Maier, Susan Mcclellan

Faculty Articles

Sailing and designing memo assignments have a lot in common. At first, both can seem overwhelming - so much to learn, so much to organize sequentially, and so much to get right in a short period of time. Mistakes mean instability, lost time, and possibly capsizing. Avoiding the mistakes, a good skipper can break through to clean water and good air, and teaching writing can be exhilarating. The students and teacher both benefit from and enjoy working with an ideal memo assignment. The process is critical, but the destination is key. No memo assignment is effective if it results in …

Welfare reform's changes in immigration laws-aimed at working-age adults-may have a lasting effect on immigrant children in the United States. By familiarizing themselves with the most common barriers to assistance and ways to overcome them, advocates can help immigrant children access the benefits they need to lead better lives.

Narrative And Client-Centered Representation: What Is A True Believer To Do When His Two Favorite Theories Collide?, John B. Mitchell Jan 1999

Narrative And Client-Centered Representation: What Is A True Believer To Do When His Two Favorite Theories Collide?, John B. Mitchell

Faculty Articles

Professor Mitchell illustrates that Client-centered Representation does not simplistically reduce to a single admonition: Tell the client's story. The concept is far more nuanced than that. It incorporates a constellation of ideas. Listen to the client's story. Hear what they want. Try to be creative about ways to tell the story. Look for opportunities to bring their story into the legal process. At the same time, the attorney must join together to discuss any risks and problems which may result from various strategic choices, including the risks in even telling the story and whether those risks are worth it to …

Introduction: Critical Race Praxis And Legal Scholarship, Margaret Chon Jan 1999

Introduction: Critical Race Praxis And Legal Scholarship, Margaret Chon

Faculty Articles

In this introduction, Professors Margaret Chon and Keith Aoki situate both Professor Yamamoto's work and the articles that respond to it. They also follow Yamamoto's advice and "perform" critical race praxis as it might relate to legal education and legal scholarship. Thus, the latter part of this introduction takes the form of an epistolary exchange, culled loosely from various e-mail messages between Professors Aoki and Chon. It is intended (in both form and content) to illustrate how conceptual tools that Yamamoto provides can be used to address the intergroup racial justice issues that permeate law schools.

De Facto Parents And The Unfulfilled Promise Of The New Ali Principles, Julie Shapiro Jan 1999

De Facto Parents And The Unfulfilled Promise Of The New Ali Principles, Julie Shapiro

Faculty Articles

Alternative families - those that do not fit the classic nuclear family model - have been the focus of legal reform over the last twenty years. The American Law Institute has produced model legislation recognizing de facto parents as holders of some limited rights. To some this is a more flexible regime that would benefit non-nuclear families, in particular lesbian families. This article critiques the ALI draft, demonstrating that its promise is largely illusory.

Direct Democracy In America, Sherman J. Clark Jan 1999

Direct Democracy In America, Sherman J. Clark

Michigan Law Review

The phrase "laboratories of democracy," as applied to the states, seems most often to mean something more like "democratic laboratories" - democratic testing grounds for various approaches to social problems. What sort of welfare reform will be most effective? Let Wisconsin try out Plan A, while Michigan experiments with Plan B. What combination of tort liability rules will achieve desired levels of compensation and deterrence? Let the states experiment with strict liability, comparative negligence, or various nofault schemes. It is also true, however, that the states are literally laboratories of democracy - arenas in which democratic institutions are themselves experimented …

Counseling Counsel For Children, Martin Guggenheim Jan 1999

Counseling Counsel For Children, Martin Guggenheim

Michigan Law Review

You are a lawyer working in juvenile court, representing children in proceedings in which their parents are accused of being unfit. Your clients range in age from newborns to seventeen-yearolds. At any one time you have 125 active cases on your docket. You work hard at your job, and you believe deeply in the rights of the children you represent. Occasionally, it occurs to you that you don't really have as good a sense as perhaps you should of your precise role and how you ought to discharge your responsibilities to your clients. But you don't ever seem to have …

China's Bid To The Wto— Hidtory Task Needs Joint Efforts, Lei Du Jan 1999

China's Bid To The Wto— Hidtory Task Needs Joint Efforts, Lei Du

LLM Theses and Essays

As one of the three international institutions formed in the aftermath of the Second World War constituted the postwar world economic order, the GATT was an international treaty with its central mission promoting free trade among the contracting parties. During the forty-seven years of its existence (1947-1994), the GATT provided a legal framework within which most international trades were conducted. On January 1, 1995, the WTO was established in accordance with the results of the Uruguay Round of Multilateral Negotiations under the auspices of the GATT. The replacement of the GATT by an institutional body, the WTO, ushered in a …
