Chasing The Future: Has The Digital Performance In Sound Recordings Act Of 1995 Kept Pace With Technological Advances In Musical Performance, Or Is Copyright Law Lagging Behind, Steven V. Podolsky Jan 1999

Chasing The Future: Has The Digital Performance In Sound Recordings Act Of 1995 Kept Pace With Technological Advances In Musical Performance, Or Is Copyright Law Lagging Behind, Steven V. Podolsky

UC Law SF Communications and Entertainment Journal

Ever since jukeboxes and taped music began replacing bands in many restaurants and bars, performing musicians have been deprived of earnings and protection from unauthorized performance of their work. Digital technology exacerbated the problem by creating super quality sound that can be duplicated without a loss of quality. The Internet, which has become a medium for distributing prerecorded music, has the potential for doing damage to ownership interests throughout the entire recorded music industry. In just a few seconds, anyone with Internet access can retrieve, store, and listen to the performance without paying royalties to the performers. This article discusses …

Gamut Mapping For Pictorial Images, Gustav Braun, Mark Fairchild Jan 1999

Gamut Mapping For Pictorial Images, Gustav Braun, Mark Fairchild

Presentations and other scholarship

A psychophysical evaluation was performed to test the quality of several color gamut mapping algorithms. The task was to determine which mapping strategy produced the best matches to the original image. Observer preference was not considered. The algorithms consisted of both device dependent and image-dependent mappings. Three types of lightness scaling functions (linear compression, chroma weighted linear compression, and image dependent sigmoidal compression) and four types of chromatic mapping functions were tested (linear compression, knee-point compression, "sigmoidlike " compression, and clipping). The source and destination devices considered were a monitor and a plain-paper inkjet printer respectively. The results showed that, …

A Victory For Equivalent Background — On Average, Mark Fairchild Jan 1999

A Victory For Equivalent Background — On Average, Mark Fairchild

Presentations and other scholarship

A psychophysical experiment was carried out to examine the relationship between image contrast and overall perceived brightness. A second phase of the experiment looked at the relationship between the perceived brightness of variegated backgrounds and the simultaneous contrast effect produced by such backgrounds. These results have important ramifications for procedures used to calculate adapting chromaticities and luminances for image displays. The results suggest that the traditional concepts of linear luminance integration and equivalent background are satisfactory on average. However, results for individual observers show very striking, consistent, and significant trends with substantial inter-observer variability. These results help to reconcile differences …

When Repression Is Democratic And Constitutional: The Federalist Theory Of Representation And The Sedition Act Of 1798, James P. Martin Jan 1999

When Repression Is Democratic And Constitutional: The Federalist Theory Of Representation And The Sedition Act Of 1798, James P. Martin

University of Chicago Law Review

This Article examines the Federalist rhetoric surrounding the brief appearance of Democratic-Republican Clubs (1794-95) and the Sedition Act of 1798. Though now universally believed anti-democratic, Federalist positions are actually a reflection of the now forgotten but in important ways superior democratic theory they held. Representation by definition requires repression since elected officials perform a political process for the people that the people are no longer permitted to perform themselves. Repression, therefore, may serve democratic ends. This simple insight permits a fresh look at Federalist rhetoric of the 1790s and the democratic processes / institutions they championed. Federalists claimed the people …

Ultrathin Iron Oxide Films On Cu(100)., Jeevananda Karunamuni Jan 1999

Ultrathin Iron Oxide Films On Cu(100)., Jeevananda Karunamuni

LSU Historical Dissertations and Theses

In this investigation, I have focused on understanding the structure and morphology of ultrathin iron oxide films and characterizing them by STM and LEED. The room temperature Fe deposition results in a layer by layer growth. The oxidation was accomplished by annealing the sample to 810K in ambient oxygen. Two distinct oxide surface structures were observed depending on initial Fe coverage. For deposited Fe films of less than 2 ML, an oxide layer was formed with preferential growth along two perpendicular directions with a banded coarse and a hexagonal fine superstructure. As the initial Fe coverage above 2 ML, a …

Unbound Pavement Base Courses: Parallel Study Of Stiffness And Drainage Characteristics, Moussa Issa Jan 1999

Unbound Pavement Base Courses: Parallel Study Of Stiffness And Drainage Characteristics, Moussa Issa

Doctoral Dissertations

The purpose of this project was to study the effects of fines (minus #4 sieve) on permeability and stiffness characteristics of unbound base materials and to propose an optimumgradation that will satisfy these two parameters. One type of highway base material--crushed limestone--was used in the study. A total of 75 laboratory tests were conducted and distributed--25 respectively on permeability, resilient modulus and unconfined compression. The permeability test data were collected using a low-head permeameter. The resilient modulus and unconfined compression test data were collected by the mean of the MTS (Machine Testing System) with a load cell capacity of 22-kips. …

Graduate Record 1999: Priceless, Southwestern Oklahoma State University

SWOSU Yearbooks

The Mastercard "priceless" advertising campaign hits on a specific point — there are some items you can put a price on, and there are some you cannot. The point rings true at Southwestern Oklahoma State University. You can put a price on books, room and board, dinner, clothes. You can count the number of hours you spent studying, talking, partying, or sleeping. But if you combined all your time and money spent in Weatherford, Oklahoma, you could never put a price on it. Your four years in Southwestern are wrapped up in a combination of experiences, fun, sorrow, stress, happiness …

Ebonics: The Debate Which Never Happened, Barbara Birch Jan 1999

Ebonics: The Debate Which Never Happened, Barbara Birch

Ethnic Studies Review

The thesis of this paper is that no substantive and impartial debate about the pedagogical value of using Ebonics in the classroom could be held in the United States media because America's prescriptive attitude towards Ebonics does not allow fair and objective consideration of the issue. In presenting this theme I will discuss language ideologies in general and prescription in particular as a common attitude towards language. Prescription with respect to Ebonics usually takes the form of language prejudice. I will conclude with an introduction to one area of language planning, status planning, in which language planners try to improve …

When Cyberspace Meets Main Street: A Primer For Internet Business Modeling In An Evolving Legal Environment, Christopher Paul Boam Jan 1999

When Cyberspace Meets Main Street: A Primer For Internet Business Modeling In An Evolving Legal Environment, Christopher Paul Boam

UC Law SF Communications and Entertainment Journal

With the increasing use of the World Wide Web, the Internet consumer will, for better or worse, change the "shop around the comer." However, the advent of electronic commerce can have the capacity to be the great equalizer. This technology, which allows the smallest of entrepreneurs to enter millions of households throughout the world also subjects them to innumerable conflicting foreign laws and jurisdictions and magnifies the legal impact of any content errors. The ability to enter the households of millions of unknown persons also poses difficult challenges of identification, privacy, and security. The collective impact of these peculiar characteristics …

He also discusses the implications of these almost instantaneous business decisions in the context of copyrights, patents, comparison sites, gaming and spamming.

Taxation Of International Computer Software Transactions Under Regulation 1.861-18, Jonathan Purcell Jan 1999

Taxation Of International Computer Software Transactions Under Regulation 1.861-18, Jonathan Purcell

UC Law SF Communications and Entertainment Journal

Transfer of computer software in the international context presents many complexities. Tension has developed between countries of manufacture and the countries of sale. Specifically, how should the income arising from such transactions and the resulting tax base be allocated between the nations where the purchaser and seller are located? Treasury Regulation 1.861-18 attempts to bring some clarity to the characterization of income from the international transfer of computer software. This note explains this regulation as it concerns the disposition of copyright ownership rights and copyrighted subject matter, as well as explores various tax planning opportunities.

Improving The Management Of Stis Among Mch/Fp Clients At The Nakuru Municipal Council Health Clinics, Julie Solo, Baker Ndugga Maggwa, James Kariba Wabaru, Bedan Kiare Kariuki, Gregory Maitha

Reproductive Health

In an effort to address the global crisis of HIV/AIDS and to reduce the spread of other sexually transmitted infections (STIs), maternal and child health/family planning (MCH/FP) programs have attempted to integrate the management of STIs into their services. This integration was endorsed at the 1994 International Conference on Population and Development in Cairo. However, as noted in this report, programs have encountered a number of difficulties as they try to effectively manage STIs in an MCH/FP setting. In particular, the effective detection and treatment of STIs has proven difficult among MCH/FP populations. This current study was developed to help …

A Proposal For Federal Legislation To Address Health Insurance Coverage For Experimental And Investigational Treatments, Sharona Hoffman Jan 1999

A Proposal For Federal Legislation To Address Health Insurance Coverage For Experimental And Investigational Treatments, Sharona Hoffman

Faculty Publications

Health insurance coverage for experimental treatments has generated significant debate and frequent litigation in recent years. In many cases, denials of coverage for investigational therapies constitute economically and ethically sound policy. This article argues, however, that health insurance providers should be required to cover experimental treatments in limited circumstances, namely, when they are administered in phase III clinical trials to patients with terminal illnesses who are likely to die within two years. This coverage mandate would help the sickest patients, who have no other treatment options, and would benefit medical researchers, who often face a dearth of patients willing to …
