Creating A Seamless Transition From Jury Box To Jury Room For More Effective Decision Making, Annie King Phillips Dec 1999

Creating A Seamless Transition From Jury Box To Jury Room For More Effective Decision Making, Annie King Phillips

University of Michigan Journal of Law Reform

Why am I writing here? I am not a judge or lawyer, and I may never be. I don't even play one on TV. In searching for an answer to this question, it came to mind that at sometime in everyone's life, there is a need to enter the court system-as a victim, offender, witness, court staff or juror. The interactions among these persons impact the effective administration of justice in our court system. Every two years for the past eighteen years (like the tick of a clock), I am summoned to jury duty at either the District of Columbia …

The Interplay Of Race And False Claims Of Jury Nullification, Nancy S. Marder Dec 1999

The Interplay Of Race And False Claims Of Jury Nullification, Nancy S. Marder

University of Michigan Journal of Law Reform

After the verdicts in the OJ Simpson and Stacey Koon/Laurence Powell cases, many in the press explained the juries' acquittals as instances of jury nullification. However these were unlikely to have been instances of nullification, particularly because the jurors explained that their verdicts were based on reasonable doubt. One motivation for these false claims of jury nullification was the homogeneity of the juries-a largely African-American jury in the case of Simpson and a largely white jury in the case of Koon/Powell. Nullification became the term by which press and public attempted to discredit verdicts rendered by juries they distrusted. A …

Fundamental Study Of The Coating And Basesheet Influences On Gloss In Relationship To Coated Inkjet Papers, Raja Ramakrishnan Dec 1999

Fundamental Study Of The Coating And Basesheet Influences On Gloss In Relationship To Coated Inkjet Papers, Raja Ramakrishnan

Masters Theses

The use of fumed metallic oxides for glossy ink jet media offers alternatives to expensive cast coated and extruded film methods. Fumed metallic oxide pigments provide a high internal porosity and packing porosity that enable the rapid diffusion of liquid inks into the coating layer. Their small particle size (0.1-0.3μm), enable the development of gloss. However, calendering is needed to develop gloss values in the range of cast coated and extruded film grades.

Calendering of coated sheet reduces production speed, adds additional handling and rewinding cost (if performed off-line) and reduces the bulk and porosity of the coating layer, consequently …

Comparison Of State Appropriations By Function And By Program To Actual Expenditures For The Two-Year Institutions In The Tennessee Board Of Regents System, Rosemary Y. Jackson

Electronic Theses and Dissertations

The purpose of this study was twofold. The first purpose was to determine the extent to which the 14 two-year institutions of the Tennessee Board of Regents system expended funds in functional categories equal to the amount of funds provided by the appropriations funding formula for the same functional categories. The second purpose was to determine the extent to which the 14 two-year institutions expended funds for direct instructional purposes for each academic program equal to the amount of funds provided by the appropriations funding formula for direct teaching purposes for each academic program. Using an archival research design, appropriations …

Jenifer Troxel v. Tommie Granville

On Writ Of Certiorari To The Supreme Court Of Washington

From the Summary of the Argument

The fundamental rights of parents to direct and control the upbringing of their children and the autonomy of the family have been recognized time and again by this Court. These rights and this autonomy are not creatures of positive law, but are grounded in the natural moral order. The family is the "building block" of civil society and has as its natural end, or telos, the nurturing and development of flourishing human persons and good citizens. …

A Comparative Analysis Of Text And Music And Gender And Audience In Duke Bluebeard's Castle, Andrea Fábry Dec 1999

A Comparative Analysis Of Text And Music And Gender And Audience In Duke Bluebeard's Castle, Andrea Fábry

CLCWeb: Comparative Literature and Culture

Andrea Fábry discusses in her article, "A Comparative Analysis of Text and Music and Gender and Audience in Duke Bluebeard's Castle," the image of Bluebeard as a metaphor for gender relations. Béla Bartók's opera and its libretto represent a prime example of the metaphor that in turn can be found in a range of text types, from fairy tales through novels to films. In the article, Fábry analyzes Bartók's contribution to the metaphor, namely with his opera, Duke Bluebeard's Castle. She relates the opera to the text of the opera's libretto, written by film theoretician Béla Balázs, and places her …

Literature, "In-House" Writers, And Processes Of Success In Publishing, Frank De Glas Dec 1999

Literature, "In-House" Writers, And Processes Of Success In Publishing, Frank De Glas

CLCWeb: Comparative Literature and Culture

Frank de Glas discusses in his article, "Literature, 'In-House' Writers, and Processes of Success in Publishing," the fact that too many studies of twentieth-century publishing practices concentrate on individual case studies while neglecting more general patterns and that too little use is made of theoretical concepts developed in the sociology of cultural production. He argues that one of the contributing elements in the economic and artistic success of a publishing house is the bringing together of a productive group of "in-house authors." To build up and to maintain such a group, publishers steadily launch new authors who they hope will …

Western Mediations In Reevaluating The Communist Past: A Comparative Analysis Of Gothár's Time Stands Still And Andonov's Yesterday, Roumiana Deltcheva Dec 1999

Western Mediations In Reevaluating The Communist Past: A Comparative Analysis Of Gothár's Time Stands Still And Andonov's Yesterday, Roumiana Deltcheva

CLCWeb: Comparative Literature and Culture

Roumiana Deltcheva's article, "Western Mediations in Reevaluating the Communist Past: A Comparative Analysis of Gothár's Time Stands Still and Andonov's Yesterday," offers a comparative analysis of two films, Peter Gothár's Time Stands Still and Ivan Andonov's Yesterday. Both films appeared in the 1980s, in Hungary and Bulgaria, respectively, and were highly acclaimed by the critics and the audience. Both films deal with the Communist past of these two countries. In her analysis, Deltcheva's adopts the perspective of "in-between peripherality," a particular manifestation of the post-colonial paradigm in its application to East Central and Central Europe. The two films use similar …

Michael Ondaatje's The English Patient, 'History,' And The Other, Steven Tötösy De Zepetnek Dec 1999

Michael Ondaatje's The English Patient, 'History,' And The Other, Steven Tötösy De Zepetnek

CLCWeb: Comparative Literature and Culture

In his article, "Michael Ondaatje's The English Patient, 'History,' and the Other," Steven Tötösy discusses the historical background of Michael Ondaatje's novel, The English Patient (1992). The historical background and its analysis extend to selected aspects of Anthony Minghella's and Michael Ondaatje's adaptation of the novel to film (1996) and the ensuing controversy after the release of the film. From the historical background Tötösy designates as the "Almásy theme" of the novel and the film, he relates Ondaatje's engagement of the protagonist -- Central European Hungarian László Almásy -- to the notion of the Other as a historical and fictional …

Performance Evaluation Of Exhaust Aftertreatment Devices Used For Emissions Control On Diesel Engines Employed In Underground Coal Mines, Daniel K. Carder Dec 1999

Performance Evaluation Of Exhaust Aftertreatment Devices Used For Emissions Control On Diesel Engines Employed In Underground Coal Mines, Daniel K. Carder

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study was initiated to assist the WV Diesel Equipment Commission in its promulgation of initial rules, requirements, and standards governing the operation of diesel-powered equipment in underground coal mines. Four different engines and various exhaust after treatment devices that represent current levels of in-use technology were selected for performance evaluation. Both eddy-current and water-brake dynamometers were used to load the engines according to an ISO 8-Mode test cycle. Experimental emissions data, sampled from a full-flow dilution tunnel, suggests that particulate traps can reduce the mass emission rates of particulate matter (DPM) by nearly 90%, while reductions in fuel sulfur …
