Bilingual Creativity, Multidimensional Analysis, And World Englishes, Wendy Baker, William G. Eggington Jan 1999

Bilingual Creativity, Multidimensional Analysis, And World Englishes, Wendy Baker, William G. Eggington

Faculty Publications

Research in world English literatures has concentrated on qualitative measures of analysis in order to understand what is meant by `bilingual creativity.' These measures demonstrate that there are differences in rhetorical and literary style within world English literatures both in the inner and outer circle. Using Biber's multidimensional analysis (1988) to examine a large corpus of world English literatures written in Indian, West African, Britain, Anglo-American and Mexican American varieties of English, this paper examines whether quantitative analyses can also be insightful and useful in the examination of world English literatures in expanding our understanding of what `bilingual creativity' entails. …

Taking Fiction Seriously: The Strange Results Of Public Officials' Individual Liability Under Bivens, Cornelia T. Pillard Jan 1999

Taking Fiction Seriously: The Strange Results Of Public Officials' Individual Liability Under Bivens, Cornelia T. Pillard

Georgetown Law Faculty Publications and Other Works

This article argues that the Supreme Court's decision to place liability on federal officials in their personal capacity--what Professors Fallon and Meltzer call Bivens's "genius"--is in fact its Achilles' heel. Individual liability under Bivens has become fictional because it is the government, and not the individual personally, that is in fact liable in Bivens cases. The individual liability fiction has ended up helping the federal government more than the Bivens plaintiff in various ways, and has contributed to the low rate of recovery under Bivens.

It may seem odd to attribute the low rate of Bivens recoveries to the individual …

Breaking Out Of "Custody": A Feminist Voice In Constitutional Criminal Procedure, Dana Raigrodski Jan 1999

Breaking Out Of "Custody": A Feminist Voice In Constitutional Criminal Procedure, Dana Raigrodski

Articles

In this Essay, I suggest that reexamination of this field of law through a feminist lens can shed new light and add to the understanding of constitutional criminal procedure. These insights, in turn, can and should generate a positive feminist jurisprudence of criminal procedure—a distinctive feminist voice to be integrated systematically into our constitutional criminal procedure and our criminal justice system. Applying feminist legal theories to particular areas of constitutional criminal procedure may help guide us through the more difficult task of constructing a positive feminist jurisprudence of constitutional criminal procedure. Many areas of constitutional criminal procedure lend themselves as …

A Comparison Of Performance Of Students Referred For Gifted Evaluation On The Wisc-Iii And Binet Iv., James Edward Mullins Jan 1999

A Comparison Of Performance Of Students Referred For Gifted Evaluation On The Wisc-Iii And Binet Iv., James Edward Mullins

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present study examined the performances of students referred for placement in gifted programs on the WISC-III and Binet IV. The first research question asked which subtests and index scores of the WISC-III relate most strongly to placement. All subtests except Arithmetic and Coding were significantly correlated with placement. Both the Verbal Conceptualization Index (WVCI) and the Perceptual Organization Index (WPOI) Scores were found to be significantly correlated with placement. In addition, discriminant function analyses were computed. Both WVCI and WPOI were found to be significant predictors of placement. Of the WISC-III subtests, all were significant predictors except Information (WINFO) …

Farewell To An Idea? Ideology In Legal Theory, David Charny Jan 1999

Farewell To An Idea? Ideology In Legal Theory, David Charny

Michigan Law Review

In 1956, Morocco inaugurated a constitutional democratic polity on the Western model. Elections were to be held, and political parties formed, with voters to be registered by party. The Berbers, however, did not join the parties as individual voters. Each Berber clan joined their chosen party as a unit. To consecrate (or, perhaps, to accomplish) the clan's choice, a bullock was sacrificed. These sacrificial rites offer a useful parable about the relationship between law and culture. The social order imposed by law depends crucially on the "culture" of the participants in the system - their habits, dispositions, views of the …

The Private Law Of Race And Sex: An Antebellum Perspective, Adrienne D. Davis Jan 1999

The Private Law Of Race And Sex: An Antebellum Perspective, Adrienne D. Davis

Scholarship@WashULaw

In this article, Professor Adrienne D. Davis traces the interaction of race, sex, and estate law in the antebellum and postbellum South. Through a close analysis of intestate succession and testamentary transfers involving the formerly enslaved, she unearths the role of private law in reconciling and preserving both property rights and racial hierarchy. The article centers on a series of historical case studies involving the rights of formerly enslaved women and their children to postmortem transfers of wealth. While the law of private property generally served to reinforce racial hierarchy, these cases involved the use of property rights -- specifically, …

Creating High-Quality Marriages: A Qualitative Study Of Religious Couples, Jerry Lyman Redd Jan 1999

Creating High-Quality Marriages: A Qualitative Study Of Religious Couples, Jerry Lyman Redd

Theses and Dissertations

This study is a qualitative analysis of in-depth interviews with thirty-two couples who have been married for eight years. Although the couples in this sample have similar religious, economic, and cultural backgrounds, the quality of each marriage is quite different. Ten couples have exceptionally high-quality marriages, eighteen have average-quality marriages, three are struggling, and one couple has been divorced. The purpose of this study was to better understand what the ten couples with high-quality marriages are doing to create successful relationships. I conclude that high-quality marriages are created by a couple's participation in a particular process with a specific paradigm …

Local Coherence And Its Limits: A Second Look At Second Sentences, Desmond Allison, Susheela Varghese, Siew Mei Wu Jan 1999

Local Coherence And Its Limits: A Second Look At Second Sentences, Desmond Allison, Susheela Varghese, Siew Mei Wu

Research Collection Lee Kong Chian School Of Business

Our article takes up Joy Reid's (1996) proposal that second sentences deserve a second look in academic writing research and pedagogy. Reid's data and commentaries indicate that second sentences, the sentences following topic sentences, make important but generally underrated contributions to the (in)coherence of students' written paragraphs. Her study, in a U.S. university, found that English as a second language (ESL) student writers often developed paragraphs that did not meet the expectations of experienced native English speaker (NES) readers. We offer a contextualized critique and partial replication of Reid's exploratory study. Our research, in Singapore, investigates second sentence writing by …

The Reflective Journal: The Emotions And Consciousness States Of Poets Within A Transpersonal Writing Design., Mary Catherine Wuenstel Jan 1999

The Reflective Journal: The Emotions And Consciousness States Of Poets Within A Transpersonal Writing Design., Mary Catherine Wuenstel

Graduate Theses, Dissertations, and Problem Reports (ETD)

The Reflective Journal methodology is an educational tool that was created to examine poets as they wrote poetry within a transpersonal writing design. Although language arts theory approaches have dealt primarily with the interactive and subjective nature of language through reading and writing activities, few have addressed the potential of the use of language as a vehicle for personal change through self-expression. This study attempted to investigate the psychological experiences, which may occur when poets are engaged in writing poetry and their opinions on personal change after the experience of writing. While writing, the poets in the study displayed that …

La Influencia De La Arquitectura En Tres Novelas De La Posguerra., Maria De Las Mercedes Rodriguez Fuentes Jan 1999

La Influencia De La Arquitectura En Tres Novelas De La Posguerra., Maria De Las Mercedes Rodriguez Fuentes

Graduate Theses, Dissertations, and Problem Reports (ETD)

Developing Critical Consciousness: Representations Of Race And Gender In Two Afro-German Works., Maren Knebel Jan 1999

Developing Critical Consciousness: Representations Of Race And Gender In Two Afro-German Works., Maren Knebel

Graduate Theses, Dissertations, and Problem Reports (ETD)

Eva Demski and Ika Hügel-Marshall are two contemporary women writers whose works contribute significantly to the Afro-German culture. Demski is a “white” German author who depicts in her novel the life of an Afro-German woman, Afra, as well as the life of her “white” daughter, Nivea. Hügel-Marshall, who was born in 1947 as the daughter of a German mother and an African-American father, depicts in her autobiography her own development from object to subject. This thesis demonstrates that both authors encourage a development of critical consciousness by creating written evidence of a shared Afro-German identity and by expressing the problems …

Comparing Moral Values In Gotthold Ephraim Lessing's "Miss Sara Sampson" And Nathaniel Hawthorne's "The Scarlet Letter"., Karsten Dieter Kleine Jan 1999

Comparing Moral Values In Gotthold Ephraim Lessing's "Miss Sara Sampson" And Nathaniel Hawthorne's "The Scarlet Letter"., Karsten Dieter Kleine

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis examines the impact of rigid moral codes on women by comparing two works, Lessing’s Miss Sara Sampson, (1775), and Hawthorne’s The Scarlet Letter, (1850). Although the works were written in different centuries and continents, they share a common theme: the clash between patriarchal control and women’s quest for self-determination. In each work, a beautiful young woman violates the social code by becoming involved in an illicit love affair, and because of this transgression and her refusal to renounce her love, is severely punished. Also in each work, the father-daughter relationship is highlighted and can be seen to symbolize …

The Effects Of Learning Geometry Using A Computer-Generated Automatic Draw Tool On The Levels Of Reasoning Of College Developmental Students., Lalah W. Larew

Graduate Theses, Dissertations, and Problem Reports (ETD)

The following study investigated the cognitive growth of college developmental geometry students enrolled in a one-semester course in introductory Euclidean Geometry. A quasi-experimental research design was used to determine if changes in cognitive growth occurred when students used a computer-generated automatic draw tool as an instructional aid. The subjects were a control group of 36 community-college students who learned geometry in a lecture-based formal and 27 students from the same college who learned geometry by using the automatic draw tool, GeoExplorer , for one-third of their instructional time. The van Hiele Theory of levels of thought in geometry was used …
