We will then review the application of the act, discuss its implications on the future of trademark ownership in business, and suggest improvements to the legal application of the act.

Can A Religious Person Be A Big Firm Litigator? , Amelia J. Uelmen Jan 1999

Can A Religious Person Be A Big Firm Litigator? , Amelia J. Uelmen

Fordham Urban Law Journal

This Essay takes on the challenge of describing some of the ways in which values often defined as "personal" or "religious" can be integrated into the practice of law at a large firm. Part I describes some of the aspects of big firm practice that make it particularly difficult to integrate religious and personal values which may give meaning to one's work. Part II suggests that such meaning can be found through a religious vision of what it means to be a person, which includes a sense of obligation to serve the common good. Part III explores how this concept …

Shedding Some Light On Lending: The Effect Of Expanded Disclosure Laws On Home Mortgage Marketing, Lending And Discrimination In The New York Metropolitan Area, Richard D. Marsico Jan 1999

Shedding Some Light On Lending: The Effect Of Expanded Disclosure Laws On Home Mortgage Marketing, Lending And Discrimination In The New York Metropolitan Area, Richard D. Marsico

Fordham Urban Law Journal

The amended Home Mortgage Disclosure Act (HMDA), updated in 1991, required lenders to disclose information regarding the number of applications received, the race and income of applicants, the location of the property for which the loan was sought, and the disposition of each application. This article studies the expanded HMDA's impact on conventional home mortgage lending in the New York City metropolitan area from 1991 until 1998. The author first examines ways to determine whether the disclosure of expanded HDMA data in 1991 influenced private lenders allocation of credit in the New York City metropolitan area. The release of data …

Who's Not Working And Why: Employment, Cognitive Skills, Wages, And The Changing U.S. Labor Market, Frederic L. Pryor, D. L. Schaffer Jan 1999

Who's Not Working And Why: Employment, Cognitive Skills, Wages, And The Changing U.S. Labor Market, Frederic L. Pryor, D. L. Schaffer

Economics Faculty Works

Over the Last Quarter-Century, the U.S. labor market has experienced some disturbing trends. Despite apparent economic prosperity, joblessness among less-educated prime-age males is rising and, in addition, an increasing number of university graduates are taking "high-school jobs." Moreover, except for a thin layer of university-educated workers, most in the labor force are experiencing stagnating or falling real wages. Simultaneously, the inequality of wages is increasing within most groups. Using an entirely new approach that takes account of the cognitive skills of U.S. workers and the detailed occupational structure of the labor force, Frederic L. Pryor and David L. Schaffer explore …

Collaboration Between Lawyers And Social Workers: Re-Examining The Nature And Potential Of The Relationship, Paula Galowitz Jan 1999

Collaboration Between Lawyers And Social Workers: Re-Examining The Nature And Potential Of The Relationship, Paula Galowitz

Faculty Articles

The impetus for this Article was a case handled this past year by the Civil Legal Services Clinic which I teach at New York University Law School. In the clinic, third-year students represent clients in a variety of cases, including housing, government benefits, immigration, guardianship planning for clients who are HIV positive, and education. The students, who work in pairs, select from the clinic's docket the kinds of cases on which they want to work. The two students in this particular case chose to work on a case for a client who was HIV positive. The clinic's experience in that …

"Practice Of Law" In The New Millennium: New Roles, New Rules, But No Definitions, Linda Galler Jan 1999

"Practice Of Law" In The New Millennium: New Roles, New Rules, But No Definitions, Linda Galler

Hofstra Law Faculty Scholarship

This Article proposes that the MDP Commission consider separately and independently its interests in regulating lawyers and excluding non-lawyers. A definition of the "practice of law" could be drafted now, solely for the purpose of regulating lawyers in multidisciplinary firms, while the professional activities of non-lawyers could be addressed separately, at this time or later, for example, by intensifying efforts to enforce unauthorized practice of law ("UPL") statutes. By concentrating initially only on lawyers, the MDP Commission could readily attain its goal of regulating every lawyer who provides legal services-a goal that is both fundamental and immediate. Although a model …

Deterrence And Distribution In The Law Of Takings, Michael A. Heller, James E. Krier Jan 1999

Deterrence And Distribution In The Law Of Takings, Michael A. Heller, James E. Krier

Articles

Supreme Court decisions over the last three-quarters of a century have turned the words of the Takings Clause into a secret code that only a momentary majority of the Court is able to understand. The Justices faithfully moor their opinions to the particular terms of the Fifth Amendment, but only by stretching the text beyond recognition. A better approach is to consider the purposes of the Takings Clause, efficiency and justice, and go anew from there. Such a method reveals that in some cases there are good reasons to require payment by the government when it regulates property, but not …
