Litigation
Case summary: The Supreme Court of California issued a peremptory writ of mandate prohibiting the Governor and the Secretary of the State of California from implementing Proposition 5, an initiative that would add a section to the government code detailing tribal-state compacts for gaming and gambling in the state. The Court held all but the last sentence of Proposition 5 was invalid because it was inconsistent with the anti-casino provision of California's Constitution.

Preserving The History Of Boston's Diversity, Nancy Richard, Joan D. Krizack
Provenance, Journal of the Society of Georgia Archivists
These headlines appeared in Boston newspapers. The articles they introduce tell each story from the journalist's point of view. Mainstream institutions involved in the events-the courts, law enforcement, schools, and businesses--created records that provide additional information from a mainstream point of view. Often these sources are the only documentation preserved in archives and libraries that are available to researchers. Individuals from the communities involved generally pass on their perspectives on the events by word of mouth. Occasionally, members of the community or the individuals who were present create oral or written sources in which to preserve their story. Unless mainstream …

The Privatization And Project Finance Adventure: Acquiring A Colombian Public Utility Company, Mario Andrade, Mario A. De Castro
Northwestern Journal of International Law & Business
Colombia is an exciting new arena for the international practitioner structuring project finance and privatization transactions. The sectors of the economy that are attractive targets for most multinationals (MNCs) entering Colombia are the energy, oil and gas, mining, water, and telecommunications sectors. In most cases, MNCs in these sectors consider investments in Colombia when the Colombian authorities announce a plan for the privatization or capitalization of state-run companies that have a monopoly on business. Often the MNC becomes aware of the privatization, concession, or capitalization project via an official announcement by the Colombian government calling for bids or an invitation …

Law Day 2050: Post-Professionalism, Moral Leadership, And The Law-As-Business Paradigm, Russell G. Pearce
Florida State University Law Review
Inspired by Ted Schneyer’s future history of professional discipline and Bob Gordon’s description of “the hazy aspirational world” of the “Law Day Sermon,” I offer a vision of the legal profession’s next fifty years in the form of a Law Day speech from the year 2050. Looking back on developments in the first half of the twenty-first century, this piece explores the implications of the analysis proposed in my earlier article, The Professionalism Paradigm Shift: Why Discarding Professional Ideology Will Improve the Conduct and Reputation of the Bar. The speech presents a projection of the moral leadership the bar could …
