Codification And Right Answers, Andrew P. Morriss Jan 1999

Codification And Right Answers, Andrew P. Morriss

Faculty Scholarship

Attempting to survey the entire sweep of the nineteenth-century American codification debate is well beyond the scope of this article. Here, I will concentrate on what I view to be the most interesting portion—the debate provoked by draft codes prepared by David Dudley Field for New York during the 1860s. Field's drafts formed the basis for the codes ultimately adopted in Dakota Territory, California, and Montana as well as sparking years of often heated debate in New York.

I concentrate on the debate over the Field Codes, to the exclusion of the successful codifications in Georgia and Louisiana and unsuccessful …

Ecophysiological Characteristics Of Four Maize Hybrids And Abutilon Theophrasti, John L. Lindquist, David A. Mortensen

Department of Agronomy and Horticulture: Faculty Publications

Combining empirical research with simulation modeling may improve our understanding of the dynamics of crop:weed competition and for testing hypotheses on the importance of specific traits for enhancing crop performance in mixtures. Two field experiments were conducted to quantify and compare estimates of traits important for radiation interception and utilization in four maize hybrids and Abutilon theophrasti grown in monoculture. Early leaf area growth rate did not vary among maize hybrids within a year, but varied among years. The response of CO2 assimilation rate to absorbed radiation and leaf nitrogen content did not differ among hybrids. Abutilon theophrasti and …

Mechanism Of Interaction Of Asphalt Cement With Crumb Rubber Modifier, Magdy Abdelrahman, Samuel Carpenter Jan 1999

Mechanism Of Interaction Of Asphalt Cement With Crumb Rubber Modifier, Magdy Abdelrahman, Samuel Carpenter

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

The nature of the interaction process between asphalt cement and crumb rubber modifier (CRM) has not been fully understood. Two main types of mechanisms that affect the produced binder properties are reported: particle swelling and degradation (devulcanization and depolymerization). These mechanisms occur as the binder is subjected to different combinations of interaction time and temperature. Insight into the mechanisms by which the interaction between the two materials takes place through monitoring the changes in the rheological parameters of the binder is provided. The effects of the interaction process variables, time and temperature, are explained. The effect of CRM properties, including …

In-Clip Search Algorithm For Content-Based Audio Retrieval, Punpiti Piamsa-Nga, Nikitas A. Alexandridis, Sanan Srakaew, George C. Blankenship, S. R. Subramanya

Electrical and Computer Engineering Faculty Research & Creative Works

Researchers are currently more interested in searching for fragments that are similar to a query, than a total data item that is similar to a query; the search interest is for "contains", not "is". The paper presents an O(logn) algorithm, called the "generalized virtual node (GVN)" algorithm; the GVN algorithm is a search algorithm for data fragments that have similar contents to that of a query. An example of the use of the GVN algorithm is in the search of a database of audio recordings for a few measures of a melody. Each audio clip is transformed into characteristic features …

Sport Medicine And The Ethics Of Boxing, Suzanne Leclerc, Chris Herrera Jan 1999

Sport Medicine And The Ethics Of Boxing, Suzanne Leclerc, Chris Herrera

Department of Philosophy Faculty Scholarship and Creative Works

In the light of medical evidence of the health risks associated with boxing, a watchful agnostic position among sport physicians is no longer justifiable. The normal activity in a boxing match places the athletes at risk of head injury, some of which may be difficult to detect and impossible to repair. This suggests that sport physicians and others expert in the prevention and diagnosis of such injuries should take a public stand against boxing, as other medical associations have. Although there is a need for continuing research into the health risks, doctors can in the interim take steps to increase …

A Coupled Bio-Optical And Mixed Layer Model For The Equatorial Pacific, James Vincent Koziana Jan 1999

A Coupled Bio-Optical And Mixed Layer Model For The Equatorial Pacific, James Vincent Koziana

OES Theses and Dissertations

A one dimensional coupled bio-optical and mixed layer model is developed and applied to problems involving the role of phytoplankton-induced turbidity (PIT) on the vertical structure and heating of the upper ocean in the Equatorial Pacific Ocean. The bio-optical and mixed layer model for optically pure sea water was forced with climatological environmental conditions to provide a reference simulation for 140°W in the eastern Equatorial Pacific Ocean. This reference simulation was used for comparison to other simulations which considered the effects of variations in wind stress and solar input for a homogeneous chlorophyll a profile and variations in the magnitude …

Physical Control Of Biological Processes In The Central Equatorial Pacific: A Data Assimilative Modeling Study, Marjorie Anne Macwhorter Friedrichs Jan 1999

Physical Control Of Biological Processes In The Central Equatorial Pacific: A Data Assimilative Modeling Study, Marjorie Anne Macwhorter Friedrichs

OES Theses and Dissertations

A five-component data assimilative ecosystem model is developed in order to investigate the effects of physical processes encompassing a wide range of space and time scales, on the lower trophic levels of the highly dynamic central equatorial Pacific (140°W). Many of the biological processes included in the ecosystem model respond to environmental fluctuations with time scales between one and ten days, which are not typically resolved by basin to global scale circulation models. Therefore, the ecosystem model is forced using daily observations from the TAO mooring array. Model simulations successfully reproduce data collected both during and after the 1991–92 El …

Growth And Yield-Per-Recruit Modeling Of Spot (Leiostomus Xanthurus) In The Chesapeake Bay, And A Comparison Of Biological Reference Points, Kevin Ray Piner Jan 1999

Growth And Yield-Per-Recruit Modeling Of Spot (Leiostomus Xanthurus) In The Chesapeake Bay, And A Comparison Of Biological Reference Points, Kevin Ray Piner

Biological Sciences Theses & Dissertations

Spot were sampled from the Chesapeake Bay commercial fishery from 1993–1995 to determine if spot are overfished. Transversely sectioned otoliths were determined to be the most appropriate structure for ageing spot. It was determined that spot have a high natural mortality rate (M = 0.9) and fast growth (K = 0.6). This combination of M and K makes spot relatively impervious to growth overfishing as determined by yield-per-recruit modeling. Because spot are nearly impervious to growth overfishing, management thresholds based on yield-per-recruit modeling may be inappropriate. In addition, the combination of high M and fast K makes it possible to …

Water Quality Relationships To Concentrations Of Pfiesteria-Like Organisms In Virginia Estuaries For 1998., Everett P. Weber, Harold G. Marshall Jan 1999

Water Quality Relationships To Concentrations Of Pfiesteria-Like Organisms In Virginia Estuaries For 1998., Everett P. Weber, Harold G. Marshall

Biological Sciences Faculty Publications

A series of statistical analyses were performed to identify the relationship between abundance of dinoflagellates grouped as Pfiesteria-like organisms and a set of 25 water quality variables from May through October of 1998 at 41 estuarine locations. Although regions were identified in relation to seasonal density of cells present, there were no strong relationships to specific water quality variables. Factors that may have influenced these results included: a) several species were included in the group analyzed and this composite did not respond as a unit to changing environmental conditions; b) cell concentrations were low and there were a large …

Monitoring Results For Pfiesteria Piscidida And Pfiesteria-Like Organisms From Virginia Waters In 1998, Harold G. Marshall, David W. Seaborn, Jennifer Wolny Jan 1999

Monitoring Results For Pfiesteria Piscidida And Pfiesteria-Like Organisms From Virginia Waters In 1998, Harold G. Marshall, David W. Seaborn, Jennifer Wolny

Biological Sciences Faculty Publications

Results of an extensive 1998 monitoring program for the presence of Pfiesteria-like organisms (PLO) in Virginia estuaries indicate these dinoflagellates are widely distributed in both the water column, and as cysts in the sediment, however Pfiesteria piscicida was not detected at this time. The highest concentrations of PLO were in estuaries along the Virginia shore line of the Potomac River, and in western Chesapeake Bay estuaries from the Little Wicomico River to the Rappahannock River. The most common PLO included Cryptoperidiniopsis sp. and Gymnodinium galatheanum. The lowest PLO concentrations were at ocean side locations. PLO were also …

Pfiesteria Piscicida And Dinoflagellates Similar To Pfiesteria, Harold G. Marshall Jan 1999

Pfiesteria Piscicida And Dinoflagellates Similar To Pfiesteria, Harold G. Marshall

Biological Sciences Faculty Publications

Pfiesteria pisiccida is a microscopic, unicellular organism that is classified as both a mixotrophic and heterotrophic dinoflagellate, which has been associated with both fish deaths and a cause of human illness (Burkholder et al., 1992; Glasglow et al., 1995; Burkholder and Glasgow, 1997). This species possesses a complex life cycle that includes motile forms (e.g. zoospores, gametes, amoebae) and a cyst stage that may remain dormant in the sediment (Burkholder et al, 1995b). Pfiesteria piscicida is known to have toxin and non-toxin producing populations, where cyst transformation into the toxic motile zoospores may be initiated by the presence of certain …

A Data Dictionary Approach To Meeting User Requests For Accounting Information, Kristi Jane Yuthas, Dennis F. Togo

Business Faculty Publications and Presentations

In this era of massive data accumulation, dynamic development of large-scale databases and inteifaces intended to be user-friendly, there is still an increasing demand on analysts as actual user access to databases is still not a common practice. A data dictionary approach, that includes providing users with a list of relevant data items within the database, can expedite the analysis of information requirements and the development of user-requested information systems. Furthermore, this approach enhances user involvement and reduces the demands on the analysts for systems development projects.

Drafting A Patent Noninfringement Opinion Letter In Light Of Markman And Warner-Jenkinson, Barry Dove

Computer Law Review and Technology Journal

This article provides a practical guide to drafting a patent noninfringement opinion letter in light of two recent U.S. Supreme Court decisions: Markman v. Westview Instruments, Inc. and Warner-Jenkinson Co. v. Hilton Davis Chemical Co. The guidelines offered here do not represent the only way to write a noninfringement opinion letter. But if they are followed, the opinion letter should protect the interests of both the client and the patent attorney.

Cd-Rom Filings At Trial And Beyond, Clint F. Sare Jan 1999

Cd-Rom Filings At Trial And Beyond, Clint F. Sare

Computer Law Review and Technology Journal

For motions and briefs, using digital formats - such as a CD-ROM format - may provide significant benefits. Very few courts, however, accept electronic documents for filing in place of paper documents. Thus, for now, computer media may be used only to supplement those traditional filings. This paper discusses the following issues related to CD-ROM filings: (1) when CDROM filings may be allowed in trial and appellate courts; (2) what the disk may and should contain; and (3)whattechnical requirements may apply to such CDROM filings.

Because CD-ROM filings are far from standard, and are sometimes unacceptable, this article is necessarily …

The Ghost In The Computer: Radio Frequency Interference And The Doctrine Of Federal Preemption, Ralph H. Brock Jan 1999

The Ghost In The Computer: Radio Frequency Interference And The Doctrine Of Federal Preemption, Ralph H. Brock

Computer Law Review and Technology Journal

The "Police Blotter" feature in a local Texas newspaper sets the scene. A man had reportedly complained to the police that a neighbor's use of a citizens' band (CB) radio was interfering with his business. He could hear the neighbor's CB radio transmissions on his telephone and through his computer speakers. After installing filters on his telephone and complaining to the FCC, the man had filed a criminal mischief complaint with the local police. Unfortunately for him, though, the local police have no jurisdiction.

Capital Formation And The Internet: An Alternative Source Of Equity Financing For Small Businesses, Brandon W. Freeman Jan 1999

Capital Formation And The Internet: An Alternative Source Of Equity Financing For Small Businesses, Brandon W. Freeman

Computer Law Review and Technology Journal

Traditional methods of equity financing are unrealistically expensive for most small companies with capital needs. Under federal and state disclosure laws, start-up ventures must pay for printing a prospectus, advertising, and mailing, along with legal fees and other expenses, which are often beyond their means. But the Internet is expanding to enable small companies in their early growth stages to raise money from outside equity investors. By accommodating new technologies, the Securities and Exchange Commission (SEC) and state regulators have aided the Internet's expansion into equity financing.

In October 1995, through a Securities Act Release, the SEC endorsed and encouraged …

A Proposed Defense To Patent Infringement, Alfonso Garcia Chan Jan 1999

A Proposed Defense To Patent Infringement, Alfonso Garcia Chan

Computer Law Review and Technology Journal

The American patent system is a major catalyst for technological progress and economic growth. In most cases, the system works well to achieve those ends. In rare but significant circumstances, however, the patent system can be manipulated to suppress technological progress. Unlike patent rights in other nations, the American patent grant is a negative right to exclude others. Thus, the patent owner need not practice or license others to practice the invention. Indeed, a patent owner has the right to do nothing for the lifetime of the patent. A patent owner's lack of action, however, could prevent progress in a …

Finally, it analyzes the current caselaw in the area of domain name disputes and predicts what courts will do when faced with these novel and complex issues.

Saving Trees And Saving Time: Researching Environmental Law On The Internet, Jennifer Hodgkins Jan 1999

Saving Trees And Saving Time: Researching Environmental Law On The Internet, Jennifer Hodgkins

Computer Law Review and Technology Journal

Conducting research on environmental law typically involves using federal and state statutes, administrative regulations, caselaw, law reviews, journals, and other resources in highly technical and scientific areas. Many of these resources are now available on the Internet, enabling lawyers to take advantage of free and convenient access to information. This paper focuses on sites specifically pertaining to environmental law; it will not address more general sites that provide statutes, administrative regulations, and caselaw. Internet sites that may be useful to environmental lawyers are grouped into the following twelve categories:

(1) Federal Government Agencies (page 38)

(2) Texas Government Agencies (page …

Dickinson V. Zurko: Limits On The Federal Circuit's Standard Of Review, Sue Ann Mota Jan 1999

Dickinson V. Zurko: Limits On The Federal Circuit's Standard Of Review, Sue Ann Mota

Computer Law Review and Technology Journal

Standards ofreview matter -or at least we think they do. After receiving an unfavorable decision from an administrative agency, a party faces a high hurdle on appeal if the standard of review is quite deferential. In Dickinson v. Zurko, the Supreme Court recently held that decisions of the Patent and Trademark Office (PTO) must be reviewed under the relatively lax scrutiny required by the Administrative Procedure Act (APA). In contrast, the Federal Circuit had claimed the right to use the tougher "clearly erroneous" standard in Federal Rule of Civil Procedure 52(a).

Rejecting the historical, statutory, and policy reasons of …
