Is There A Private Cause Of Action Under Epa's Title Vi Regulations?: The Need To Empower Environmental Justice Plaintiffs, Bradford Mank Jan 1999

Is There A Private Cause Of Action Under Epa's Title Vi Regulations?: The Need To Empower Environmental Justice Plaintiffs, Bradford Mank

Faculty Articles and Other Publications

This article will apply the Chester three-factor test to find a private right of action implied in the administrative regulations promulgated by various agencies to implement Section 602 of Title VI. This article also proposes that it would be inconsistent to apply today's more stringent standard for inferring congressional intent in deciding whether a private right exists under Section 602. Such inconsistency arises as a result of the Supreme Court's application of a more lenient standard in recognizing a private right of action under Section 601.

The Potential And The Pitfalls Of Habitat Conservation Planning Under The Endangered Species Act, Shi-Ling Hsu Jan 1999

The Potential And The Pitfalls Of Habitat Conservation Planning Under The Endangered Species Act, Shi-Ling Hsu

Scholarly Publications

Editors' Summary: The ESA is simultaneously the most popular and most hated of environmental statutes. Conservationists fervently support the ESA's mission of preventing the extinction of our country's fish, wildlife, and plants, but private landowners subject to ESA restrictions claim that the Act unfairly and illogically restricts the use of their valuable property. As the agency with primary responsibility for the ESA's administration, the U.S. Fish and Wildlife Service (FWS) is caught between both sides. This Article examines how the FWS uses habitat conservation plans (HCPs) to balance the demands of conservationists and property owners. The Article begins by discussing …

Discovering Indigenous Peoples: Accounting And The Machinery Of Empire, Dean E. Neu Jan 1999

Discovering Indigenous Peoples: Accounting And The Machinery Of Empire, Dean E. Neu

Accounting Historians Journal

This study examines the historical usage of accounting as a technology of government within the domain of government-indigenous peoples relations in Canada. Our thesis is that accounting was salient within the chain of circumstances that influenced the discovery/identification of indigenous peoples as a governable population. By the 1830s, accounting techniques had come to occupy a central place in the military machinery of empire. When the cost-cutting and reformist sentiments prevalent in Britain during the early 1800s encouraged the reconsideration of the military costs of empire, accounting techniques were one of the methods used in the attempt to interrogate military expenditures. …

Labor's Changing Responses To Management Rhetorics: A Study Of Accounting-Based Incentive Plans During The First Half Of The 20th Century, Leslie S. Oakes, Mark A. Covaleski, Mark William Dirsmith Jan 1999

Labor's Changing Responses To Management Rhetorics: A Study Of Accounting-Based Incentive Plans During The First Half Of The 20th Century, Leslie S. Oakes, Mark A. Covaleski, Mark William Dirsmith

Accounting Historians Journal

This study compares organized labor's reactions to changing management rhetorics as these rhetorics surrounded accounting-based incentive plans, including profit sharing. Results suggest that labor's perceptions of profit sharing changed dramatically from the 1900-1930 period to post-World War II. The shift, in turn, prompts an exploration of two research questions: (1) how and why did the national labor discourse around the management rhetoric and its emphasis on accounting information change, and (2) how did this change render unions more governable in their support for accounting-based incentive plans?

Mission Boys, Civilized Men, And Marriage: Educated African Men In The Missions Of Southern Rhodesia, 1920–1945, Carol Summers

History Faculty Publications

This paper examines what marriage may have meant to African men within the Christian elite of Southern Rhodesia. Using mission and government sources, it argues that domestic, Christian marriage was important to elite African men as a way of allowing them to achieve adulthood while remaining in good standing with mission sponsors who generally objected to or feared indigenous ideas of patriarchal male adulthood. Tracing life histories of two American Board of Commissioners of Foreign Missions ministers, one who succeeded in remaining within the mission system and one who left, blacklisted, it explores how domestic, Christian marriage defused many of …

Facility Layout Of Irregular-Shaped Departments Using A Nested Approach, Alan Mckendall, James Noble, Cerry Klein Jan 1999

Facility Layout Of Irregular-Shaped Departments Using A Nested Approach, Alan Mckendall, James Noble, Cerry Klein

Faculty & Staff Scholarship

The facility layout problem is a very difficult and widely studied optimization problem. As a result, many facility layout models and techniques have been developed. However, the literature does not fully consider or control irregular-shaped departments. In this paper, the nested facility layout problem is defined whereby irregular-shaped departments(i.e. L-shaped, O-shaped or U-shaped) can be generated and controlled. This is a unique problem that can be used to efficiently layout workstations, storage areas and other departments within departments, while arranging the departments with respect to an objective. The objective considered here is to minimize material handling cost. We present a …
