A Case-By-Case Approach To Pleading Scienter Under The Private Securities Litigation Reform Act Of 1995, Matthew Roskoski Jun 1999

A Case-By-Case Approach To Pleading Scienter Under The Private Securities Litigation Reform Act Of 1995, Matthew Roskoski

Michigan Law Review

Securities fraud litigation under Rule lOb-5 threatens all publicly traded companies: according to the Stanford Securities Class Action Clearinghouse, in 1998 a securities fraud lawsuit was filed for nearly every day that the stock markets were open. Some of these lawsuits appear to be frivolous, triggered by inevitable fluctuations in stock prices (so-called "fraud by hindsight" complaints), while others represent legitimate efforts at private enforcement of the securities laws. Disposition on the pleadings is a critical defense strategy for all securities lawsuits. Securities fraud lawsuits that withstand a 12(b)(6) motion almost always settle, regardless of the actual merits of the …

Falcandus And Fulcaudus Epistola Ad Petrum Liber De Regno Sicilie Literary Form And Author's Identity, Gwenyth Hood Jun 1999

Falcandus And Fulcaudus Epistola Ad Petrum Liber De Regno Sicilie Literary Form And Author's Identity, Gwenyth Hood

English Faculty Research

In Paris, in 1550, when the printing press was still relatively new, Gervais de Tournay published a medieval chronicle under the title, Historia Hugonis Falcandi Siculi De rebus gestis in Siciliae regno iam primum typis excusa [« The History of Hugo Falcandus the Sicilian, concerning things done in the Kingdom of Sicily, now printed for the first time »]. He had discovered this history, as he explains in his preface, in a codex placed at his disposal by Matthew Longuejoue, bishop of Soissons, a codex so ravaged by time that it looked repulsive enough to poison the hand that dared …

Collaborative Synergy Between Business And Academia: In Conversation With A Borges, S Watson And M R Rao, N Balasubramanian Jun 1999

Collaborative Synergy Between Business And Academia: In Conversation With A Borges, S Watson And M R Rao, N Balasubramanian

IIMB Management Review

While the need for greater collaboration between industry and academia is agreed upon by both sides, the engineering of such collaboration is often problematic. Generous funding from industry may come with strings attached which may not be acceptable to management institutes and yet it is a fact that with shrinking government funding, research is increasingly market driven. A mutual interchange is essential to the health of both theory and practice but the best people to teach business are not necessarily businessmen, or academics ensconced in their ivory towers. Business schools still have to overcome the competitive mindset and switch to …

Removal Of Trace Contaminants From Wastewater Effluents Using Local Adsorbents, Kasim Ghulam Haider Ghulam Jun 1999

Removal Of Trace Contaminants From Wastewater Effluents Using Local Adsorbents, Kasim Ghulam Haider Ghulam

Theses

Wastewater reclamation must ensure removal of residual pollutants to a high degree so as to make the water acceptable for the designated reuse. There has been a growing interest worldwide to employ cost-effective treatment methods for polishing secondary treatment wastewater effluents. Carbon adsorption has proved to be an effective method for effluent polishing but treatment costs are relatively high.

AI-Ain wastewater treatment plant at Zakher has a design capacity of 54,000 m3/day and incorporates preliminary treatment, followed by extended aeration and dual-media filtration for effluent polishing before water reuse in irrigation. The chemical quality of the treated effluent …

Reinterpreting Modern Culture: An Introduction To Friedrich Nietzsche’S Philosophy, Paul V. Tongeren Jun 1999

Reinterpreting Modern Culture: An Introduction To Friedrich Nietzsche’S Philosophy, Paul V. Tongeren

Purdue University Press Books

Friedrich Nietzsche (1844-1900) presents himself several times as a physician of culture. He considers it his task to make a diagnosis of the culture of his age, to point to the latent or patent diseases, but also to the possibilities to overcome them. His diagnosis, prognosis, and prescriptions implied an overcoming of traditional interpretation of what is going on in the main domains of culture: knowledge, morality, religion, and art. This book presents Nietzsche's thoughts on knowledge and reality, on morality and politics, and on religion. Preceding these main dialogues is an introduction on the art of reading Nietzsche's texts …

Recommendations For Maximizing Battery Life In Photovoltaic Systems: A Review Of The Lessons Learned, Florida Solar Energy Center, James Dunlop

FSEC Energy Research Center®

This report contains notes, observations and recommendations about the use of batteries in small stand-alone photovoltaic (PV) systems. The conclusions of this work are based on the results of more than a decade's worth of battery testing at the Florida Solar Energy Center and related work with Sandia National Laboratories, the PV industry and user groups. The most critical findings were the relationship between battery state-of-charge and battery life and the importance of an adequate PV array-to-load ratio.

Area Of Expertise Teams: The Michigan Approach To Applied Research And Extension, Arlen Leholm, Larry Hamm, Murari Suvedi, Ian Gray

Journal of Extension

Michigan State University's Extension and the Agricultural Experiment Station have restructured their educational delivery system through implementation of area of expertise (AOE) teams. The AOE teams are different from most Extension teams in that they are more permanent in their life span; more self-directed in their operation; more tightly linked with public leaders and groups; more integrative of research demonstration, education design, delivery and evaluation; more dedicated to enhancing their knowledge skills and capacity; and more empowered with resources. This article describes how the adoption of AOE team approach and related system changes have created the seamless interface between Extension …

Food Safety Instructor Training Using Distance Education

Journal of Extension

An instructor training program was designed to provide state mandated food safety updates for certified Food Protection Management (FPM) instructors using the Trans-Texas Videoconferencing Network (TTVN). The distance education train-the-trainer program featured innovative, interactive, computer-based instructional components including multimedia class materials and activities. A telephone survey of 89 participants indicated that videoconferencing was just as effective as face-to-face instruction and that there was a substantial increase in self-reported knowledge of food safety content after the training program.

Turning Points In The Development Of Blended Families, Leslie A. Baxter, Dawn O. Braithwaite, John H. Nicholson Jun 1999

Turning Points In The Development Of Blended Families, Leslie A. Baxter, Dawn O. Braithwaite, John H. Nicholson

Department of Communication Studies: Faculty Publications

A modified retrospective interview technique (RIT) was employed with members of 53 blended families to determine the types of turning points they reported experiencing and the developmental trajectories of their respective blended family’s first 4 years. Findings revealed 15 primary types of turning points, of which “Changes in Household Configuration,” “Conflict,” “Holidays/Special Events,” “Quality Time,” and “Family Crisis” were the most frequent. A cluster analysis revealed five basic trajectories of development for the first 48 months of family development: Accelerated, Prolonged, Stagnating, Declining, and High-Amplitude Turbulent. The trajectories differed in the overall positive-to-negative valence ratio, the frequency of conflict related …

Histogenesis In The Metacestode Of Echinococcus Vogeli And Mechanism Of Pathogenesis In Polycystic Hydatid Disease, Robert L. Rausch, Antonio D'Alessandro Jun 1999

Histogenesis In The Metacestode Of Echinococcus Vogeli And Mechanism Of Pathogenesis In Polycystic Hydatid Disease, Robert L. Rausch, Antonio D'Alessandro

Harold W. Manter Laboratory of Parasitology: Faculty Publications

Histogenesis of the metacestode of Echinococcus vogeli was traced mainly in rodents inoculated intraperitoneally with finely minced infective vesicles. The fragments aggregated in the peritoneal cavity and coalesced, forming structures (plaques) from which primary vesicles arose. From primordia in their germinal tissue, exogenous vesicles developed, enlarged, and migrated outward to the surface of the laminated membrane, where they remained attached and proliferated. Each unit of vesicles so formed retained discrete identity and, within 6-8 months, acquired an adventitia; thereafter, exogenous multiplication ceased and endogenous proliferation supervened. Large numbers of daughter cysts arose in the germinal tissue lining chambers within the …

Spectroscopic And Kinetic Investigation Of Carbocation Reactivity In Supercritical Carbon Dioxide, Hongshu Jin Jun 1999

Spectroscopic And Kinetic Investigation Of Carbocation Reactivity In Supercritical Carbon Dioxide, Hongshu Jin

Masters Theses

Recent interest in the use of supercritical CO2 as an environmentally benign reaction medium has included the development of solvent systems that may support polar and ionic chemistry. Carbocations are key intermediate in a variety of synthetically important reactions and characterization of their reactivity is the focus of this work. UV-visible absorption, and steady-state and time-resolved fluorescence spectroscopy has been used to identify and monitor the reaction kinetics of 9- phenylxanthenium carbocation. The arylcarbocation is conveniently generated from 9- phenylxanthen-9-ol in supercritical CO2 under mildly acidic conditions. Under these conditions 9-phenylxanthenium ion is extremely stable and persists for …

A Three-Choice Drug Discrimination Procedure Differentiates The Stimulus Effects Of D-Amphetamine And Mdma, Amy K. Goodwin Jun 1999

A Three-Choice Drug Discrimination Procedure Differentiates The Stimulus Effects Of D-Amphetamine And Mdma, Amy K. Goodwin

Masters Theses

(±)-3,4-Methylenedioxymethamphetamine (MDMA) produces effects in humans that are reportedly similar to those of CNS stimulants. However, drug discrimination studies in nonhumans have yielded inconsistent results regarding the similarities between MDMA and d-amphetamine. Sixteen male Sprague-Dawley rats were trained to discriminate d-amphetamine, MDMA, and saline in a three-lever drug discrimination procedure. In addition, differential outcomes were employed during drug discrimination training with eight of the rats but this did not appear to facilitate the acquisition of the discrimination. Cocaine (0.25-10.0 mg/kg) produced dose dependent increases in d-amphetamine-appropriate responding with complete substitution at the highest dose administered. LSD (0.02-0.16 mg/kg), produced dose …

School-Based Functional Assessment For Adolescents With Adhd: Procedural Issues In General Education Settings, Pamela M. Radford Jun 1999

School-Based Functional Assessment For Adolescents With Adhd: Procedural Issues In General Education Settings, Pamela M. Radford

Masters Theses

Functional assessment is a structured problem-solving process that has been found to be an effective method for guiding the selection of classroom intervention for students who present a variety of problem behaviors (O'Neill, et al., 1997), including Attention Deficit/Hyperactivity Disorder (ADHD; American Psychiatric Association, 1994). This study evaluated the utility of school-based functional assessments with 2 adolescent boys diagnosed with ADHD in general education settings utilizing resources typically available to school personnel to document information relevant to behavior function. Descriptive information (i.e., interviews, observations, record reviews) led to the development of potential intervention strategies that were implemented and evaluated by …

The Study Of Political And Economic Reforms In Ghana, John L. Adedeji Jun 1999

The Study Of Political And Economic Reforms In Ghana, John L. Adedeji

Masters Theses

The dual transition program of Ghanaian political economy was put in place as a result of Ghana's huge external debts, its balance of payments problems, and the critical shortage of foreign exchange resulting from years of financial management by seven regimes (civilian and military) that ruled the West African nation since its independence in 1957. Taken together, these problems tilted the balance of power in favor of external actors, including the International Monetary Fund and World Bank.

The study focuses on the dual strategy of macroeconomic measures and structural adjustments. The study then evaluates: (a) the policy components of the …
