Constitutional Constraints On Redistribution Through Class Power, Mark Barenberg Jan 1999

Constitutional Constraints On Redistribution Through Class Power, Mark Barenberg

Faculty Scholarship

My comments will not be so much a critique as an elaboration of the two papers, especially Professor Neuman's paper on United States (U.S.) law, since I am not an expert on German constitutional law. For those less familiar with U.S. law, my goal is to bring to light some additional elements of the U.S. constitutional tradition that impede the use of law to achieve economic equality-elements of U.S. constitutional law that reinforce the weak "general equality" principle of the Equal Protection Clause.2 I will use U.S. labor law as my vehicle for showing the variety of constitutional principles that …

Scholarly Works

On January 14, 1998 the Food and Drug Administration (FDA) approved the use of a product previously marketed as Excedrin Extra Strength® for use in treating migraine headaches. As part of the approval for the new use of the product, FDA required the pharmaceutical manufacturer of Excedrin®, Bristol-Myers Squibb, to relabel and repackage the product. The new product is called “Excedrin Migraine®” and is sold side-by-side with Excedrin Extra Strength®. Both over-the-counter (OTC) products contain the same active ingredients: 250 milligrams of acetaminophen, 250 milligrams of aspirin, and sixty-five milligrams of caffeine. Many …

Determining Local Labor Market Outcomes Through Federal Minimum Wage Legislation And Immigration Policy: The Role Of State-Specific Variation., Marvin Edward Dodson Jan 1999

Determining Local Labor Market Outcomes Through Federal Minimum Wage Legislation And Immigration Policy: The Role Of State-Specific Variation., Marvin Edward Dodson

Graduate Theses, Dissertations, and Problem Reports (ETD)

Individual states within the United States have vast and specific structural differences in their economies in general and their labor markets specifically. These structural differences may combine with federal regulation to produce results at odds with the intention of any particular federally legislated regulation. Federal minimum wage legislation and immigration policy are two examples of economic regulation that impose uniformity across the states without regard for state specific structural differences. This dissertation demonstrates that differences do exist between state economies and thus these federal regulatory activities will induce a varied set of responses. There is some theoretical basis to believe …

The Meaning Of Religious Belief, Practice, And Community For Latter-Day Saint Fathers Of Children With Special Needs, Loren Dean Marks Jan 1999

The Meaning Of Religious Belief, Practice, And Community For Latter-Day Saint Fathers Of Children With Special Needs, Loren Dean Marks

Theses and Dissertations

While the tragedy of American fatherlessness has evoked a growing body of research, religious beliefs, practices, and communities have not been a significant part of the scholarly discussion. This article discusses possible reasons for this and reviews the religion and family literature with a focus on fathers. Qualitative interviews were conducted with 19 Latter-day Saint (LDS) fathers of children with special needs and analyzed to examine the meaning of religious experience for these fathers and their families. Analysis indicated three dimensions of religious experience: spiritual belief, religious practice, and faith community. The spiritual belief in an eternal perspective, including the …

Religiosity And Physical Fitness: A Study Of Middle-Aged Mormon Men, Janette Olsen Jan 1999

Religiosity And Physical Fitness: A Study Of Middle-Aged Mormon Men, Janette Olsen

Theses and Dissertations

Research has related both physical fitness and religiosity to health. This study combined these ideas and examined the relationship between religiosity and physical fitness among middle aged Mormon men (n=110). Mormons are an ideal population for study because of their strict health code. Fitness variables were grip strength, waist/hip ratio, body mass index (BMI) and estimated maximal oxygen uptake (VO2max). A questionnaire assessed level of religiosity and separated subjects into two groups: highly religious (n=35) and less religious (n=14). Moderately religious subjects (n=61) were omitted. A one way ANOVA (between-groups design) found no significant differences in fitness variables between groups. …

Latter-Day Saint Fathers Of Children With Special Needs: A Phenomenological Study, Michael M. Olson Jan 1999

Latter-Day Saint Fathers Of Children With Special Needs: A Phenomenological Study, Michael M. Olson

Theses and Dissertations

This research, presents a qualitative study of six Latter-day Saint fathers of children with special needs. In-depth interviews were used to examine the demands and resources fathers draw upon in meeting the needs of their child(ren), the application of the conceptual ethic of fathering as generative work and crisis/stress theory, as well as an analysis of how fathers incorporated their religious beliefs, faith, and practices into fathering their special needs children. Narrative accounts are used to illustrate the results. These results are then applied to an integrated conceptual framework and clinical applications are made.

Creating High-Quality Marriages: A Qualitative Study Of Religious Couples, Jerry Lyman Redd Jan 1999

Creating High-Quality Marriages: A Qualitative Study Of Religious Couples, Jerry Lyman Redd

Theses and Dissertations

This study is a qualitative analysis of in-depth interviews with thirty-two couples who have been married for eight years. Although the couples in this sample have similar religious, economic, and cultural backgrounds, the quality of each marriage is quite different. Ten couples have exceptionally high-quality marriages, eighteen have average-quality marriages, three are struggling, and one couple has been divorced. The purpose of this study was to better understand what the ten couples with high-quality marriages are doing to create successful relationships. I conclude that high-quality marriages are created by a couple's participation in a particular process with a specific paradigm …

The Impact Of Religiosity On Coping Among Lds Adolescents, Matthew P. Roper Jan 1999

The Impact Of Religiosity On Coping Among Lds Adolescents, Matthew P. Roper

Theses and Dissertations

This study examines the impact of religiosity on coping in a group of Mormon (Church of Jesus Christ of Latter-day Saints) youth. Longitudinal data were gathered from detailed questionnaires administered to 2852 male and female adolescents in 1990 and 1993. Coping was conceptualized as four general dimensions (self-concept, public activities and service, deviance and future plans). Religiosity was also conceptualized multi-dimensionally (religious belief, public religiosity, private religious behavior, and religious experiences). Multiple regression analysis was used to investigate the unique effects of each of the dimensions of religiosity on each dimension of coping. It was hypothesized that religiosity was positively …

Religious Couples' Reported Effects Of Prayer In Conflict Situations, Julie Ann Stout Jan 1999

Religious Couples' Reported Effects Of Prayer In Conflict Situations, Julie Ann Stout

Theses and Dissertations

For religious couples, the spiritual domain stands alongside the biological, psychological, and systemic domains as an influence upon interaction and mechanism for change. This study is a quantitative expansion of Butler, Gardner, and Bird's (1998) qualitative study, of the change dynamics of prayer. This study attempted to improve the generalizability of the Butler et al. (1998) study through its use of a larger, and religiously and geographically more diverse sample. This study investigated the effects of prayer during times of marital conflict through a quantitative methodology with a survey design. The researchers developed a survey based on the findings of …

Voiding Dysfunction And Detrusor Instability After The Colposuspension Operation For Genuine Stress Incontinence, Luigi Bombieri Jan 1999

Voiding Dysfunction And Detrusor Instability After The Colposuspension Operation For Genuine Stress Incontinence, Luigi Bombieri

Peninsula Medical School Theses

Colposuspension is an effective treatment for genuine stress incontinence. Continence is restored by positioning the bladder neck in a fixed and elevated retro-pubic position. Despite a high success rate of up to 90%, post-operative complications occur which may have an adverse effect on quality of life. Voiding difficulties develop in 0-43% of patients and detrusor instability in 2- 25%. This considerable variability is due to differences in definition, the timing of assessment, patient selection, and probably also in surgical technique. The natural history of these complications is not clearly known due to the lack of prospective follow-up studies. There is …

What Is The Common Good, And Why Does It Concern The Client's Lawyer?, John M. Finnis Jan 1999

What Is The Common Good, And Why Does It Concern The Client's Lawyer?, John M. Finnis

Journal Articles

Why is anything of real concern to any of us? Because, besides our simply emotional motives, we have reasons for action (which may be supported or opposed by our emotions). What are reasons for action? Some are instrumental, means to further ends: I have reason to start reading this paper to you, and you had reason to come back into the room to hear it. What reasons? Well, doing so is my contribution to this symposium's reflection on its subject-matter. That reflection, in turn, is intended to be instrumental in promoting a wider and deeper understanding of an important set …
