This manual focuses on controlling nuisance aquatic plants, occurring in Oregon lakes. To use this manual, it is necessary to distinguish between an aquatic plant problem, and a water quality enrichment problem that typically results in excessive algae production (See Box this page). The most serious type of aquatic plant problem is caused by invasion of a waterbody by a non-native species. Non-native weed invaders may flourish in suitable conditions and degrade habitat and other beneficial uses. The biology and ecology of weeds allows them to fluorish under a wide range of conditions. Taking Fiction Seriously: The Strange Results Of Public Officials' Individual Liability Under Bivens, Cornelia T. Pillard

Georgetown Law Faculty Publications and Other Works

This article argues that the Supreme Court's decision to place liability on federal officials in their personal capacity--what Professors Fallon and Meltzer call Bivens's "genius"--is in fact its Achilles' heel. Individual liability under Bivens has become fictional because it is the government, and not the individual personally, that is in fact liable in Bivens cases. The individual liability fiction has ended up helping the federal government more than the Bivens plaintiff in various ways, and has contributed to the low rate of recovery under Bivens.

It may seem odd to attribute the low rate of Bivens recoveries to the individual …

In this Article, Jennifer Fan argues that existing laws in Japan do not adequately protect working women from sex discrimination. Specifically, Fan examines the Equal Employment Opportunity Law (EEOL), a law designed to prevent discrimination against women in the workplace, and concludes that the EEOL is little more than a paper tiger that preserves the status quo. After briefly discussing the legal sources of protection for working women in Japan before the passage of the EEOL, Fan examines the creation of the EEOL, its substantive provisions, and its legal impact. In his essay The Hedgehog and the Fox, Isaiah Berlin used an ancient Greek proverb comparing these animals as a metaphor to express a deep division among thinkers and writers in their understanding of the human condition. In this essay, I extend the metaphor to contrast the differing approaches to risk management taken by the public sector in the exercise of its sovereign functions and that taken by members of the private sector in the conduct of commercial transactions. My definition of creativity in environmental law is any legal initiative that advances the subject with new levels of analysis, structure, or institutional bridges. There are two requirements: improvement on function and novelty. Law is better if it increases the prospect of protecting the natural world or its inhabitants. Law is novel if it combines mandate, process, or structure in unusual ways.

There are reasons to suspect that environmental law as a field may be more creative than other legal subjects such as trust and estates, contracts, property, or tax law. One reason, as Oliver Houck has said, is that …

Preparation of this guidance manual for integrated aquatic vegetation management in irrigation canals was stimulated, in large part, by the accidental release of acrolein-treated irrigation water into Bear Creek in southern Oregon. The resulting fish kill brought into focus the need to examine the methods available for managing aquatic vegetation in flowing water. Furthermore, it demonstrated the need for technical assistance on aquatic vegetation management in Oregon. Vegetation management in flowing water is a difficult undertaking. Several studies have shown that Rhipicephalus appendiculatus from geographically isolated areas differ in their susceptibilities to Theileria paIva, the haemoprotozoan causative agent of East Coast Fever. In Kenya, R. appendiculatus from Muguga have been reported to be less susceptible to T parva infection than those from Rusinga Islands. As the same tick species from different areas shows variation in vector competence, it was considered to be of epidemiological interest to determine whether these tick populations are genetically different. Evaluation Of The Impact Of Cotesia Flavipes Cameron (Hymenoptera :Braconidae) And Indeginous Parasitoids On Stemborer Populations In Southwestern Kenya., Kennedy Okoth Ogedah

Data obtained from regular field samples throughout the life cycle of Chilo partellus in three experimental sites; Ungoye, Mbita point and Kuja river, were used to construct life tables. Key factor analysis was conducted to determine the key mortality factors. Results showed little variation in the total inter-generation mortality expressed as 100rx at all the three developmental stages of C.partellus. The mean values obtained ranged from 89.35%-98.1 %,86.1 %-99.8% and 91.7%-96.03% for Kuja river, Mbita point and Ungoye respectively. The most common cause of mortality was classified as disappearance whereas parasitism contributed minimally to the C.partellus mortality at all the …

The purpose of the present study was to explore the relationship between parental verbal abuse and children's emotional development (depression, anxiety, stress, self esteem, and anger). The participants were 29 male and 89 female college students whose average age was 19. Five instruments were used to collect data: Depression, Anxiety, and Stress Scales (DASS-21), Coopersmith Self-Esteem Inventory, Verbal Abuse Measure, Child Attitude Toward Parents Measure, and State-Trait Anger Expression Inventory. For data analyses, several tests were used. The Pearson correlation was calculated to see the inter-correlations of each emotional variable. This research study investigated the efficiency and effectiveness of self-monitoring as an individual intervention technique. Data were collected for 10 weeks in a public elementary school in a small city in central Iowa. The subjects were 1 fourth-grade regular classroom teacher and 1 of her students and 1 special education teacher and 1 student from a fourth-grade regular classroom in which the special education teacher team-taught. Both teachers had willingly volunteered to participate in the research study and later identified a student in their class who had low rates of work completion. As a result of munitions manufacturing and decommissioning, explosive compounds have contaminated groundwater and soils at many sites throughout the U.S. and worldwide. Three of the most commonly occurring explosive contaminants are TNT, ROX, and HMX. Many processes, biological as well as physical, have been developed to remediate the contaminated material. But feasibility studies rarely take into account the three contaminants at once. We chose four of the technologies used to remediate explosives-contaminated water and studied comparatively their effectiveness and efficiency in degrading TNT, ROX, and HMX in solution at their maximal solubilities. This article contends that Defendants clearly had a duty to the people who travel on public highways not to serve alcohol to an underage individual. Therefore, N.C. GEN. STAT. section 18B-302, which prohibits the sale of alcohol to underage persons, should be regarded as a public safety statue, violation of which constitutes negligence per se. It further argues that Defendants should have recognized that Mullis and others might be injured by their conduct. This Article supports the court's position that there is no state constitutional right to state funding of abortion. It focuses on three areas often neglected by appellate courts. First, this article will look at the legal environment in which the Constitution of 1868 was adopted. As of 1868, the law of North Carolina would have been hostile to a claim of a right to abortion or a right to state funding of abortion. Rehabilitation For Deafened Adults: A Puzzle With Missing Pieces, Miguel Oswald Aguayo

This study explored the psychological and social impact of adventitious deafness, and the rehabilitation services that were offered to individuals who acquired this condition in adulthood. Qualitative interviews were conducted with a sample of eight deafened adults, who were recruited from across Ontario. The results show that medical interventions (e. g., audiometric testing, hearing aid provision, and cochlear implantation) were relied on exclusively as a rehabilitation approach in providing care to deafened people. None of the study participants were offered individual, family, or group counselling by their hearing health service providers. This lack of attention to the socio-emotional needs of …

This study is aimed at monitoring the impact of the 1996 federal welfare legislation on American Indian families with children on reservations within the state of Arizona over five years (1997-2002). Our goal is to inform the public policy debate on how to improve the social and economic opportunities for low-income families with children on reservations. This report is based on our first year (October 1, 1997-September 30,1998) of work, which focused on aspects of reform implementation and short-term and potential long-term outcomes. Securitization: The Conflict Between Personal And Market Law (Contract And Property), Tamar Frankel

The road to securitization - transforming debt and loans into securities - is littered with obstacles. These obstacles seem unrelated. Yet, upon reflection, many legal and business problems arising in the securitization process can be traced to one source: the inherent conflict between contract law governing personal relations among creditors and debtors, and property law governing the same relations converted into "commodities" issued or traded in the market among investors. Identical terms can be characterized as contract loans in personal context, and as personal property (securities or bonds) in market context.
