This is an essay about privacy. My aim is to understand privacy through these two very different ideas. Privacy, in the sense that I mean here, can be described by these two different ideas. It stands in competition with these ideas. It is that part of life that is left after one subtracts, as it were, the monitored and the searchable. Restorative justice has become a fashionable term both in Canadian and foreign legal and social policy discourse. Restorative justice is certainly not a new idea. In fact, it is foundational to our very ideas about law and conflict resolution. There is, nevertheless, a lack of clarity about the meaning of this term. Often it is used as a catchall phrase to refer to any practice which does not look like the mainstream practice of the administration of justice, particularly in the area of criminal justice. Alternative families - those that do not fit the classic nuclear family model - have been the focus of legal reform over the last twenty years. The American Law Institute has produced model legislation recognizing de facto parents as holders of some limited rights. To some this is a more flexible regime that would benefit non-nuclear families, in particular lesbian families. This article critiques the ALI draft, demonstrating that its promise is largely illusory.

Capital Investment Decisions Of Large Industrial Firms In Major European Countries, Faith Yilmaz

Using large-company panel data, this thesis empirically analyses investment decisions in major European countries. We particularly concentrate on three issues: the taxation of capital in the EU, the role of agency costs of debt on investment decisions, and the empirical analyses of the investment-uncertainty relationship. First, based on a dynamic system in capital and Tobin's q ratio, some simplified analytical results are derived to simulate various tax policy effects on investment. Also, for a single investment project, a model is developed to consider jointly the role of uncertainty and irreversibility in the taxation of capital. The simulation results cast doubt …

Caste, Class, And Equal Citizenship, William E. Forbath

There is a familiar egalitarian constitutional tradition and another we have largely forgotten. The familiar one springs from Brown v. Board of Education; its roots lie in the Reconstruction era. Court-centered and countermajoritarian, it takes aim at caste and racial subordination. The forgotten one also originated with Reconstruction, but it was a majoritarian tradition, addressing its arguments to lawmakers and citizens, not to courts. Aimed against harsh class inequalities, it centered on decent work and livelihoods, social provision, and a measure of economic independence and democracy. This article argues that parental objections should not be allowed to block minors from accessing information from government agencies, including schools and libraries. This is particularly important when a mature minor seeks information that is essential to meaningful decisions about the exercise of autonomy rights that are constitutionally protected for teenagers, such as reproductive rights including the right to contraception and abortion. The right to receive information is also implicated where minors seek information to facilitate emerging identity choices that may conflict with those of their parents, such as religion and reliance on medical care. The Darkest Domain: Deference, Judicial Review, And The Bill Of Rights, Daniel J. Solove

Deference presents one of the greatest threats to liberalism in the modern age, undermining judicial review for fundamental constitutional rights such as freedom of speech, freedom of religion, and due process. In contrast to existing critiques which dismiss deference as an ideological tool wielded by conservative judges, this article explores deference more systematically and rigorously, addressing it at its conceptual underpinnings. Deference has a strong conceptual backbone rooted in the long-accepted principle that the judiciary must avoid doing what was done in Lochner - the substitution of judicial judgment for that of the policymaker or legislature. Implemented in Montgomery County, Texas, STAR deviates from traditional boot camps in a variety of ways. The program is closely coupled with school jurisdictions, the juvenile court, and correctional authorities. In addition, the program is non-residential and serves status, misdemeanor, and felony juvenile offenders and mandates parental participation. Passage of the Sherman Act in the United States in 1890 set the stage for a century of jurisprudence regarding monopoly, cartels, and oligopoly. Among American statutes that regulate commerce, the Sherman Act is unequaled in its generality. The Act outlawed every contract, combination or conspiracy in restraint of trade and monopolization and treated violations as crimes. By these open-ended commands, Congress gave federal judges extraordinary power to draw lines between acceptable cooperation and illegal collusion, between vigorous competition and unlawful monopolization.

Behaviour disorders are common among nursing home residents and the management of these problems is difficult and emotionally taxing for caregivers. Although widespread acknowledgment of the problem exists amongst those caring for the elderly, there has, until recently, been little formal investigation of these disorders in any systematic degree. This study investigated 63 nursing home residents (22 males and 41 females) in two primary diagnostic categories; those with vascular dementia and those with dementia due to other causes, primarily Alzheimer's disease. The western rock lobster, Panulirus cygnus, fishery represents a significant commercial asset to Western Australia, and it is therefore important that appropriate strategies are developed to effectively manage it. Because the fishery has a very high level of exploitation, researchers and managers rely significantly on annual stock assessments which are based on catch and effort data. This study will identify and assess the effects that changes in fishing power factors (e.g. advances in fish-finding technology) have had on estimates of catch and effort. In this thesis, an intelligent fuzzy logic system using genetic algorithms for the prediction and modelling of interest rates is developed. The proposed system uses a Hierarchical Fuzzy Logic system in which a genetic algorithm is used as a training method for learning the fuzzy rules knowledge bases. A fuzzy logic system is developed to model and predict three month quarterly interest rate fluctuations. The system is further trained to model and predict interest rates for six month and one year periods. Discrimination, persecution, violence and harassment of certain groups are not a new phenomenon. Legend has described the formation of groups who have been known to persecute others, such as Jews, blacks, religious orders, as a means of protecting the dominant views of society.
