A Proposal To Require Lawyers To Disclose Information About Procedural Matters, William H. Fortune

In the absence of a rule clearly requiring disclosure, a lawyer is obligated not to disclose information which is adverse to the interests of a client. However, judges should be able to expect lawyers to disclose information about procedural matters. This Article argues that Model Rule of Professional Conduct 3.3 should be amended to require disclosure of information about procedural matters. Part I describes the events in Potter v. Eli Lilly & Co., a case involving a secret settlement related to Prozac. Part II makes the argument for a rule requiring disclosure of procedural information. Part III describes how …

Farm Tractor Safety In Kentucky, 1995, Steven R. Browning, Susan C. Westneat, Helena Truszczynska, Deborah Reed, Robert Mcknight

Preventive Medicine and Environmental Health Faculty Publications

Objective: Tractor rollovers are a major cause of farm injuries and fatalities. The authors used data from a statewide surveillance study to estimate the prevalence of safety features such as rollover protective structures, seat belts, and power take-off shields on farm tractors in Kentucky.

Methods: Using data from the Farm Family Health and Hazard Surveillance Project, the authors report on the prevalence of farm tractor safety features by size of farm, by region of the state, by number of tractors per farm, and by tractor age and estimate the prevalence of tractors equipped with rollover protection by region and for …

The Problem Of Children Riding In The Back Of Pickup Trucks In Florida, Xuehao Chu

This paper provides a preliminary investigation into the problem of children riding in the back of pickup trucks in Florida from four perspectives. First, using the Fatal Analysis Reporting System (F ARS), it presents a descriptive analysis of fatal accidents involving children under 15 years of age riding in the back of pickup trucks in Florida from 1994 to 1997. Second, it compares the consequences of fatal accidents involving children riding in the back of pickup trucks with those involving school buses and those involving children in airbag crashes in Florida during the same period. In a recent study of tuberculosis cases in Texas it was found that while the incidence of tuberculosis is fairly low (compared to developing countries), of the cases reported, almost 10% were resistant to at least one of the four first line drugs (Taylor, 1999). When tuberculosis is diagnosed in a patient, especially one who may have contracted an antibiotic resistant strain, discovery of the type and extent of the resistance is imperative to a successful treatment regimen. This address dichotomized academic research and policymaking as two separate, distinct, and often conflicting worlds or cultures. Higher education as a field of study was used as a case example illustrating academic research, and state legislative politics illustrated the world of policymaking. Suggestions were made for finding ways of communicating between the two cultures, and specific recommendations were included.

Academic Careers In The Twenty First Century: New Options For Faculty, Judith M. Gappa

Mid-Western Educational Researcher

The faculty career is changing in response to external and internal pressures. Public calls for productivity and accountability, student demands for access and high quality education, faculty workloads, tenure criteria and processes, and the desire for balance in personal and professional lives are all contributing to change. Today less than 50% of all faculty members occupy tenure-track positions; 26% of full-time faculty occupy nontenurable positions. This paper examines these and other pressures for institutional change, describes current faculty demographics, and explores possible institutional responses including modifications to traditional tenure systems and faculty career alternatives outside tenure.

The educational needs of future K-8 teachers in the areas of mathematics and science are greater as a result of the increased (and, I would add, appropriate) student expectations in the area of mathematics and science as enunciated in the SOL and the specific content areas as described in the new licensure requirements. The sophistication and understanding of science and mathematics that is needed at both the elementary school and middle school levels is indeed substantial.
