Applying The Ada To Mitigating Measures Cases: A Choice Of Statutory Evils, Lisa A. Eichhorn

This Article critiques the idea that the ADA should exclude from its coverage people who use mitigating measures, such as medications and medical devices, to alleviate the effects of their mental and physical impairments. After describing the statute as an expansive but flawed tool for combating disability-based discrimination, the Article analyzes a 1999 trilogy of Supreme Court cases holding that in determining whether a person has a disability for purposes of ADA coverage, courts should take account of the ameliorative effects of so-called mitigating measures on the person’s impairments. Major Litigation Activities Regarding Major Life Activities: The Failure Of The Disability Definition In The Americans With Disabilities Act Of 1990, Lisa A. Eichhorn

The passage of the Americans with Disabilities Act ("ADA") in 1990 has been praised as the major accomplishment of the disability rights movement. This statute, however, is not without its flaws. Perhaps the most problematic one is the way in which “disability” is defined. Lisa Eichhorn argues that the definition undercuts the effectiveness of the ADA. She begins with a historical look at society’s concepts of disability and discusses how these concepts were incorporated into the Rehabilitation Act of 1973 and the ADA. She then examines cases that have been dismissed because plaintiffs cannot prove disabled status, which illustrate the …

The first suggestion that controls on eutrophication and dredging impacts were needed came in 1969. The federal Water Pollution Control Administration recommended a water quality management plan and waste abatement program to control odour and other pollution symptoms in Hillsborough Bay, and a master plan for dredging and filling the bay.

Evaluation Of Soilless Media Used In Tobacco Float Systems, Robert C. Pearce, Jack M. Zeleznik

Agronomy Notes

A wide range of soilless media is currently available to tobacco growers utilizing the float system for transplant production. Most of the media are predominantly made up of peat moss with varying amounts of perlite, vermiculite,and coconut fibers (coir). One of the most difficult problems for growers has been inconsistency in the media from year to year. Because peat is a natural product, some year to year variability is unavoidable. However, many manufacturers of soilless media have procedures in place to ensure that the final product is as consistent as possible.

Mental health parity legislation could substantially reduce the degree to which financial responsibility for the treatment of mental illness is shifted to government, especially state and local government. There is substantial evidence that both mental health and addictions treatment is effective in reducing the utilization and costs of medical services. There appears to be a lack of substantial evidence to discourage Florida from pursuing mental health and substance abuse parity legislation.

This research demonstrates how the use of geographic information systems and other study methods can assist in identifying potential adverse impacts of transit programs and activities on minority and low-income populations. A process or examining the relationship between transit facilities and mobile pollutant sources. demographic characteristics, and land use patterns is provided to assist transportation professionals in identifying the location of minority and low-income populations and the potential for adverse impacts on their health and quality of life. Remediation alternatives are also presented.

Nebraska Beef Cattle Reports

Eight ruminally fistulated, yearling steers (two concurrent 4x4 Latin squares) were used to evaluate dietary Rumensin level (0, 30, 30/40 or 40 g/t), and bunk management strategy (ad libitum or clean bunk: 24- or 14-hour feed access). Rumensin decreased meal size and increased meal frequency without compromising intake. Clean bunk management increased consumption rate, meal size and ruminal pH change and pH variance. Steers with limited feed exposure are at greater risk for subacute acidosis; Rumensin effects consumption favorably for controlling acidosis, especially for cattle with limited feed exposure.

Two-hundred ten head of predominantly British and/or British x Continental cross heifers were assigned to six implant/reimplant treatment groups (five pens/treatment). In addition, melengestrol acetate (MGA) was provided to four treatment groups from day 28 until 48 hours prior to slaughter. Heifers not fed MGA had the greatest number of immature ovaries, although they were also the most efficient in feed conversion (lower feed to gain ratio). Heifers fed MGA and implanted with Finaplix were the least efficient in feed conversion

Objective: Little research evidence is available on the prevalence of problem drinking and other health related behaviours in Hong Kong. The purpose of this study was to test the utility, the validity and reliability of the AUDIT, a well-tested and validated screening instrument for alcohol consumption, in the Chinese language and with a sample of Hong Kong hospital patients. The study examined the prevalence of problem-drinkers amongst a sample of general hospital patients and compared this to the prevalence of other health-related behaviours.
