Erisa Preemption Of Medical Malpractice Claims: Can Managed Care Organizations Avoid Vicarious Liability?, J. Bradley Buckhalter
Seattle University Law Review
This Comment begins by briefly discussing the theory of respondeat superior and the vicarious liability of MCOs for the negligence of affiliated physicians.' Next, the section presents an overview of ERISA, focusing on ERISA's preemption of laws that impact employee benefit plans, particularly medical malpractice claims brought against MCOs seeking to hold them vicariously liable for an affiliated physician's negligence. Section III applies current ERISA preemption doctrine to a situation such as Peterson's, in which a plaintiff attempts to hold an MCO vicariously liable for an affiliated physician's negligence. Legal Mechanisms Of Public-Private Partnerships: Promoting Economic Development Or Benefiting Corporate Welfare?, Nick Beermann
Seattle University Law Review
This Comment argues that while the public may ultimately benefit economically from public-private partnership development, the legal mechanisms used in public-private partnerships to skirt the constitution violate the public trust by (1) precluding the public from obtaining information regarding these projects; (2) denying the taxpaying public their right to participate in public choices and spending decisions that affect them; and (3) severely impinging on the public's state constitutional right to the referendum process. Furthermore, by allowing these mechanisms to exist, the Washington Supreme Court only furthers the violation of the public's trust, while simultaneously weakening the role of the judiciary …

Literature Review: Challenging Hiv-Related Stigma And Discrimination In Southeast Asia: Past Successes And Future Priorities, Joanna Busza
HIV and AIDS
Pervasive stigma has surrounded HIV/AIDS since the beginning of the pandemic. In Southeast Asia, as elsewhere, it has been accompanied by discrimination, affecting transmission patterns and access to care and support. This paper describes the regional experience of stigma and discrimination and offers a review of community-based interventions that have attempted to reduce them. The evidence presented comes primarily from unpublished literature and anecdotal evidence gained through interviews with project staff throughout the region.

Informing Research On Hiv Prevention: A Consultation, Sharon Fonn, C. Elizabeth Mcgrory
HIV and AIDS
According to a 1998 UNAIDS/WHO report, HIV infection among women is the fastest-growing segment of the AIDS pandemic, especially in developing countries. Unfortunately, the HIV-prevention strategies put forward by the public health community—monogamy, condom use, and treatment of sexually transmitted infections—are not feasible for many women. Women urgently need a means within their personal control to protect themselves against HIV. Recognizing this need, a number of international and nongovernmental organizations and government agencies have called for the development of microbicides, products that women could use vaginally to prevent infection with sexually transmitted infections, particularly HIV. For the last decade feminist literary critics have convincingly argued that bestselling novels from Gone with the Wind (1936) and Forever Amber (1944) to The Valley of the Dolls (1966) and The Flame and the Flower (1972) reveal the psychic needs of twentieth-century middle-class American women, and that these needs have as much to do with desire for the emotional sustenance they once received from their mothers as with desire for heterosexual romance. This article will follow a deductive approach in order to comprehend the intricacies involved in the NAFTA and NAAEC's environmental provisions. It will also contextualize the inseparable relationship between environmental protection and trade which is depicted in these agreements. Part I will review and analyze the NAFTA's environmental provisions, focusing on their relevant mechanisms, nexus to trade, and shortcomings. In Part II, the uniqueness and effectiveness of the formula developed to reconcile trade and the environment in the form of the NAAEC will be introduced.
