Commercial Arbitration In The U.S.: The Arbitrability Of Disputes Arising From Statute-Based Claims, Sylvie Frankignoul Jan 1999

Commercial Arbitration In The U.S.: The Arbitrability Of Disputes Arising From Statute-Based Claims, Sylvie Frankignoul

LLM Theses and Essays

A leading contemporary expert in arbitration has explained: "The concept of arbitrability determines the point at which the experience of contractual freedom ends and the public mission of adjudication begins. In effect, it establishes a dividing line between the transactional pursuit of private rights and courts' role as custodians and interpreters of the public interest." 1 A major part of the arbitrability doctrine deals with the kind of claims that can fall within the scope of agreements for private dispute resolution. Arbitration clauses are an integral part of the parties' transactions. Nevertheless, the American judiciary historically has refused to enforce …

Notions Of Equity In (International) Environmental Law: Inter-Generational Equity, Youk-Hyun Sung Jan 1999

Notions Of Equity In (International) Environmental Law: Inter-Generational Equity, Youk-Hyun Sung

LLM Theses and Essays

Equity has a long history. In the first chapter of this thesis, notions of equity in conventional international law will be discussed. It must be more helpful to understand equity based upon the history of the term since the issues relating to equity were raised in quite a few cases in the past. In the second chapter, by discussing environmental equity in the United States, the only remaining superpower and the largest economy in the world, the thesis tries to see the future of equity in international environmental law. Environmental equity issues in the United States are good sources for …

State Immunity Waivers For Suits By The United States, Evan H. Caminker Jan 1999

State Immunity Waivers For Suits By The United States, Evan H. Caminker

Articles

The Supreme Court closed this millennium with a virtual celebration of state sovereignty, protecting state authority from the reach of congressional power in several significant ways. In a pair of cases, Seminole Tribe v. Florida1 and Alden v. Maine,2 the Court held that states enjoy a constitutional immunity from being sued without their consent. In Seminole Tribe, the Court opined that "the background principle of state sovereign immunity embodied in the Eleventh Amendment"3 protects states from unconsented suits in federal court. In Alden, the Court held that this principle is not merely embodied in the Eleventh Amendment but rather is …

The Boundaries Of Private Property, Michael A. Heller Jan 1999

The Boundaries Of Private Property, Michael A. Heller

Articles

If your house and fields are worth more separately, divide them; if you want to leave a ring to your child now and grandchild later, split the ownership in a trust. The American law of property encourages owners to subdivide resources freely. Hidden within the law, however, is a boundary principle that limits the right to subdivide private property into wasteful fragments. While people often create wealth when they break up and recombine property in novel ways, owners may make mistakes, or their self-interest may clash with social welfare. Property law responds with diverse doctrines that prevent and abolish excessive …

The Cutting Edge Of Poster Law, Michael A. Heller Jan 1999

The Cutting Edge Of Poster Law, Michael A. Heller

Articles

Students place tens of thousands of posters around law schools each year in staircases, on walls, and on bulletin boards. Rarely, however, do formal disputes about postering arise. Students know how far to go-and go no farther despite numerous avenues for postering deviance: blizzarding, megasigns, commercial or scurrilous signs. What is the history of poster law? What are its norms and rules, privileges and procedures? Is poster law effident? Is it just?

Two Movements Of A Constitutional Symphony: Akhil Amar’S The Bill Of Rights, Kurt T. Lash Jan 1999

Two Movements Of A Constitutional Symphony: Akhil Amar’S The Bill Of Rights, Kurt T. Lash

Law Faculty Publications

A remarkable effort is afoot to justify American constitutional law at the end of the twentieth century. Ground zero in this effort is Yale Law School, and the principle architects are professors Akhil Reed Amar and Bruce Ackerman. Together, these scholars are calling for a reevaluation of commonly accepted doctrines with the goal of grounding judicial review and constitutional interpretation on the principles of popular sovereignty. What makes the effort remarkable is its emphasis on political morality, as opposed to the attainment of a particular doctrinal end. Take, for example, Amar's explanation of his purpose in writing The Bill of …

The Tentative Case Against Flexibility In Commercial Law, Omri Ben-Shahar Jan 1999

The Tentative Case Against Flexibility In Commercial Law, Omri Ben-Shahar

Articles

Well-rooted in modern commercial law is the idea that the law and the obligations that it enforces should reflect the empirical reality of the relationship between the contracting parties. The Uniform Commercial Code ("Code") champions this tradition by viewing the performance practices formed among the parties throughout their interaction as a primary source for interpreting and supplementing their explicit contracts. The generous recognition of waiver and modifications, as well as the binding force the Code accords to course of performance, course of dealings, and customary trade usages, effectively permits unwritten commercial practices to vary and to erode explicit contractual provisions.

The unique cultural ways of Cambodian refugee families, combined with the physical and psychological health problems inherent in their refugee experience, present challenging and rewarding opportunities for school nurses to engage in the process of transcultural nursing. The authors discuss the profound and devastating impact of the refugee experience upon the mind, body, and spirit of Cambodian children. The purpose of this exploratory and descriptive study was to understand the nature and meaning of a school district's cross-cultural team's experiences of providing health care for Cambodian refugee children. The Sincere Body: The Performance Of Weeping And Emotion In Late Medieval Italian Sermons, Lyn Blanchfield Jan 1999

The Sincere Body: The Performance Of Weeping And Emotion In Late Medieval Italian Sermons, Lyn Blanchfield

Quidditas

In 1493 the well-known and controversial Franciscan preacher Bernardino of Feltre gave a series of Lenten sermons to the people of Pavia. On March 11 he dedicated an entire sermon to the necessity of contrition—or perfect sorrow over sin—in the rite of confession. Speaking to a large audience of both men and women, rich and poor, and the local ecclesiastical and civic authorities, Bernardino discussed how one should behave when contrite: “If you cannot feel sorrow of the body, then at least [feel it] in [your] heart, and if you cannot weep with [your] bodily eyes, then at least [weep] …

Effects Of Different Irrigation Programs On Fruit, Trunk Growth Rates, Quality And Yield Of Grapefruit Trees, Riza Kanber, Harun Köksal, Ati̇lla Yazar, Bülent Özeki̇ci̇, Sermet Önder

Turkish Journal of Agriculture and Forestry

Long-term field experiments were carried out between 1985 and 1988 to determine the effect of different irrigation intervals and pan coefficients on the fruit and trunk growth rates and yield of mature grapefruit trees grown in the Eastern Mediterranean Region of Turkey in a medium-light textured soil. Two different irrigation intervals (I 1 =15 and I 2 =25 days), and pan coefficients (k 1 =0.60 and k 2 =1.00) were used. Higher evapotranspiration values were obtained from the treatments with k 2 coefficient in the two irrigation regimes. The average irrigation water (IR) and evapotranspiration (Et) values were 796 mm …

The Problem Of Children Riding In The Back Of Pickup Trucks In Florida, Xuehao Chu Jan 1999

The Problem Of Children Riding In The Back Of Pickup Trucks In Florida, Xuehao Chu

CUTR Research Reports

This paper provides a preliminary investigation into the problem of children riding in the back of pickup trucks in Florida from four perspectives. First, using the Fatal Analysis Reporting System (F ARS), it presents a descriptive analysis of fatal accidents involving children under 15 years of age riding in the back of pickup trucks in Florida from 1994 to 1997. Second, it compares the consequences of fatal accidents involving children riding in the back of pickup trucks with those involving school buses and those involving children in airbag crashes in Florida during the same period. Third, using the 1995 Nationwide …
