The Sky Is Falling (Or Is It?): International Contracts And The Y2k Problem, Mark B. Baker Jan 1999

The Sky Is Falling (Or Is It?): International Contracts And The Y2k Problem, Mark B. Baker

Vanderbilt Journal of Transnational Law

Y2K problems at this point in time are reasonably foreseeable due to the amount of attention given the subject. Contracting parties should examine potential Y2K problems arising internally and address them before January 1, 2000. Yet the extent of Y2K problems, be they widespread or solitary occurrences, remains unforeseeable and unpredictable. Even those parties having adequately addressed internal Y2K problems can experience difficulties due to external parties having failed to become Y2K-compliant. This "second tier" of unforeseeability supports the use of excused performance, but the "first tier" foreseeability that Y2K problems potentially exist prevent viable use of the defense. In …

The Civil Law Trust, Maurizio Lupoi Jan 1999

The Civil Law Trust, Maurizio Lupoi

Vanderbilt Journal of Transnational Law

It is generally held that trusts are incompatible with the basic assumptions of civil law systems. In order to discuss this statement one would have to inquire, first, what is meant by the term "trusts"; second, what assumed common characteristics of the civil law systems are being envisaged and declared to bein compatible with trusts; and third, why those characteristics should be incompatible with trusts. It is also commonly held that the Hague Convention of 1984 on the law applicable to and the recognition of trusts concerns only those trusts that are foreign to the jurisdiction in which the rules …

The Role Of Legal Doctrine In The Decline Of The Islamic Waqf: A Comparison With The Trust, Jeffrey A. Schoenblum Jan 1999

The Role Of Legal Doctrine In The Decline Of The Islamic Waqf: A Comparison With The Trust, Jeffrey A. Schoenblum

Vanderbilt Journal of Transnational Law

The starting point of this article is that the same impulses present in societies with Western legal systems to manage family wealth over time have been present in Islamic societies as well. But unlike other legal regimes regulating such impulses, waqf law has been largely unresponsive, especially in light of changing typologies of wealth and socio-economic conditions. A number of factors explain the failure of legal doctrine to respond. The first of these is the religious or divine grounding of waqf law, making it difficult for the law to evolve in a responsive and uncontroversial manner, one that does not …

International Recognition And Adaptation Of Trusts: The Influence Of The Hague Convention, Adair Dyere Jan 1999

International Recognition And Adaptation Of Trusts: The Influence Of The Hague Convention, Adair Dyere

Vanderbilt Journal of Transnational Law

The process of bringing English-style trusts into systems that do not have a similar device is fraught with difficulties. This is especially true with respect to efforts directed towards the creation of a domestic trust law within such a system, but it is also true about the adaptation of legal institutions that is necessary in order to recognize trusts created under foreign law, in accordance with Article 11 of the Hague Trusts Convention. Thus far, it can be said that no country that did not have trusts before the Hague Trusts Convention has reacted to the Convention by adopting a …

In Memoriam: Lord Lowry Of Crossgar (1919-1999): A Tribute, John Eric Smithburn Jan 1999

In Memoriam: Lord Lowry Of Crossgar (1919-1999): A Tribute, John Eric Smithburn

Journal Articles

In the Summer of 1985, I participated in a program in London on international judicial education, sponsored by the Judicial Administration Division of the American Bar Association. The keynote speaker for the program was Robert Lowry, The Lord Chief Justice of Northern Ireland. Lord Lowry noted that there was very little judicial training in Britain at the time and that before the 1960s judicial education didn't exist in Britain. In his address, Lord Lowry boldly advocated compulsory judicial education courses for all judges through the Judicial Studies Board. Our mutual interest in the judiciary and the education of judges began …

What Spending Clause? (Or The President's Paramour): An Examination Of The Views Of Hamilton, Madison, And Story On Article I, Section 8, Clause 1 Of The United States Constitution, Jeffrey T. Renz Jan 1999

What Spending Clause? (Or The President's Paramour): An Examination Of The Views Of Hamilton, Madison, And Story On Article I, Section 8, Clause 1 Of The United States Constitution, Jeffrey T. Renz

Faculty Law Review Articles

This article tests three interpretations of the General Welfare Clause that persisted prior to the U.S. v. Butler decision against the text of the Constitution and discusses historical conditions that add to the understanding of that clause of the U.S. Constitution. Specifically, the author examines: the "strong" Hamiltonian interpretation, the Madison interpretation, and the "weak" Hamiltonian or Story interpretation. The author concludes that in the course of testing each hypothesis, a surprising conclusion was reached: all interpretations failed to survive.

The "Rewritten" Bible At Qumran: A Look At Three Texts, Sidnie White Crawford Jan 1999

The "Rewritten" Bible At Qumran: A Look At Three Texts, Sidnie White Crawford

Department of Classics and Religious Studies: Faculty Publications

Since the discovery of the Qumran scrolls in the late 1940s and 1950s, certain manuscripts of the collection have been described by the term “Rewritten Bible." This grouping has been rather loosely defined, but the criteria for membership in this category include a close attachment, either through narrative or themes, to some book contained in the present Jewish canon of Scripture, and some type of reworking, whether through rearrangement, conflation, or supplementation, of the present canonical biblical text. Thus, works such as Pseudo-Ezekiel or Pseudo-Daniel would be excluded from the category, since, although thematically related to a biblical text (Ezekiel, …

Review Of Moses: A Life By Jonathan Kirsch, Sidnie White Crawford Jan 1999

Review Of Moses: A Life By Jonathan Kirsch, Sidnie White Crawford

Department of Classics and Religious Studies: Faculty Publications

Meek and arrogant, mild and unrelentingly harsh, merciful and cruel—Moses is one of the most difficult characters in the Bible. But Jonathan Kirsch, in this readable and well-researched account of Moses the lawgiver, does not shy away from those contradictions; instead, he emphasizes them. In so doing, Kirsch, a book columnist for the Los Angeles Times and also a lawyer, has made accessible one of the great figures of the Bible.

Roberto Busa, S.J., And The Invention Of The Machine-Generated Concordance, Thomas Nelson Winter Jan 1999

Roberto Busa, S.J., And The Invention Of The Machine-Generated Concordance, Thomas Nelson Winter

Department of Classics and Religious Studies: Faculty Publications

This is a story from early in the technological revolution, when the application was out searching for the hardware, from a time before the Internet, a time before the PC, before the chip, before the mainframe. From a time even before programming itself.

Tasman's 1957 prophecy was no shot in the dark. His view of the future was a projection from his recent past. Thomas J. Watson, Sr. had assigned him in 1949 to be IBM liaison and support person for a young Jesuit's daring project to produce an index to the complete writings of St. Thomas Aquinas. First, Tasman's …

Protecting Communication Departments: Reflections On The Nebraska Experience, Ronald Lee, William J. Seiler Jan 1999

Protecting Communication Departments: Reflections On The Nebraska Experience, Ronald Lee, William J. Seiler

Department of Communication Studies: Faculty Publications

Eight years ago, in the first week of the 1991 fall semester, the Acting Senior Vice Chancellor for Academic Affairs announced a series of vertical budget cuts that included the elimination of the University of Nebraska–Lincoln’s department of Speech Communication (now Communication Studies). Over the next seven months the department fought against the proposed action. In March 1992, the Budget Reduction Review Committee voted against the Vice Chancellor’s recommendation. Later in the month, the Academic Planning Committee also voted to rescind the budget cutting measure.

These actions ended the battle and assured the continuation of the department. In an earlier …

Reality And Theory In A Collision, Norman Derby, Robert Fuller Jan 1999

Reality And Theory In A Collision, Norman Derby, Robert Fuller

Robert G. Fuller Publications

Billiard-ball collisions are frequently cited in introductory physics textbooks, usually as examples of elastic collisions. Many articles describing such collisions have appeared in this journal and elsewhere, but comparisons between theoretical results and actual collisions are rare, and most of the theoretical analyses have simply assumed friction to be negligible during the collision time. Students trying to simulate billiard-ball collisions on a popular simulation program such as Interactive Physics® may encounter interesting collisions, such as ones in which the cue ball is thrown up into the air when the frictional coefficients are set at even modest levels. We decided …
