What Is The Common Good, And Why Does It Concern The Client's Lawyer?, John M. Finnis Jan 1999

What Is The Common Good, And Why Does It Concern The Client's Lawyer?, John M. Finnis

Journal Articles

Why is anything of real concern to any of us? Because, besides our simply emotional motives, we have reasons for action (which may be supported or opposed by our emotions). What are reasons for action? Some are instrumental, means to further ends: I have reason to start reading this paper to you, and you had reason to come back into the room to hear it. What reasons? Well, doing so is my contribution to this symposium's reflection on its subject-matter. That reflection, in turn, is intended to be instrumental in promoting a wider and deeper understanding of an important set …

Health And Educational Outcomes Of Children Who Experienced Severe Neonatal Medical Complications, Timothy B. Smith, Glenna C. Boyce, Glendon Castro

Faculty Publications

To determine the long-term developmental and educational outcomes of a sample of low birthweight infants with intraventricular hemorrhage (IVH), developmental assessments and interviews were conducted eight years after the initiation of an early intervention project. At the time of the follow-up, 62% of children were experiencing some developmental or behavior problems, with visual impairments, cerebral palsy, and attention deficits occurring most frequently. Grade of IVH and the number of days spent in the neonatal intensive care unit were the best predictors of later developmental delays. The sample also scored below average on school achievement; approximately 30% of those in school …

Attorney Expertise, Litigant Success, And Judicial Decisionmaking In The U.S. Courts Of Appeals, Stefanie A. Lindquist, Susan Brodie Haire, Roger E. Hartley

Scholarship@WashULaw

In the U.S. legal system, litigants frequently retain counsel to represent their interests in civil cases, particularly when the stakes are high. Scholarly work and anecdotal evidence suggest that variation in the quality of advocacy has the potential to affect litigant success. We examine the relationship between attorney characteristics, case outcomes, and judicial voting in products liability decisions of the U.S. Courts of Appeals. Our analysis found some differences in the levels of experience and specialization of counsel representing defendants and plaintiffs and that counsel expertise was, at times, related to litigant success. In a multivariate model of decisionmaking, judges …

Dam Nation: A Geographic Census Of American Dams And Their Large-Scale Hydrologic Impacts, William L. Graf Jan 1999

Dam Nation: A Geographic Census Of American Dams And Their Large-Scale Hydrologic Impacts, William L. Graf

Faculty Publications

Newly available data indicate that darns fragment the fluvial system of the continental United States and that their impact on river discharge is several times greater than impacts deemed likely as a result of global climate change. The 75,000 dams in the continental United States are capable of storing a volume of water almost equaling one year's mean runoff, but there is considerable geographic variation in potential surface water impacts. In some western mountain and plains regions, darns can store more than 3 year's runoff, while in the Northeast and Northwest, storage is as little as 25% of the annual …
