Drawing The Line: Religion And Politics, Michael Walzer Jan 1999

Drawing The Line: Religion And Politics, Michael Walzer

Utah Law Review

Politics separated from religion in this extended and qualified sense-that all the crusaders, religious and secular alike, are denied the sword, but allowed to fly their banners-is an open-ended conflict over interests and values among people who understand that they have to coexist with one another. Both the conflict and the coexistence are permanent conditions, which need to be protected from the temptations of eternity. We have to set ourselves against the closure that God's name, again and again, has licensed-but also against every other kind of closure, licensed by any of the secular substitutes for God's name. Only someone …

Piercing The Facade Of Utah's "Improved" Elective Share Statute, Terry S. Kogan, Michael F. Thomson Jan 1999

Piercing The Facade Of Utah's "Improved" Elective Share Statute, Terry S. Kogan, Michael F. Thomson

Utah Law Review

So long as the Utah Legislature insists on a distinction between marital and non-marital assets, a decedent will be able to disinherit a surviving spouse by depleting marital assets and living on non-marital assets. However, we believe this problem is less significant than the other two. To begin with, it requires that a decedent have had during lifetime significant non-marital assets that were not commingled and are readily identifiable. Moreover, it requires that the scheme of disinheritance can be contemplated at least two years before death, since marital assets alienated during this period will be largely recoverable.

The Redefinition Of Arbitration By Those With Superior Bargaining Power, Margaret M. Harding Jan 1999

The Redefinition Of Arbitration By Those With Superior Bargaining Power, Margaret M. Harding

Utah Law Review

Use of the arbitration clause and arbitral process to gain unfair and unexpected advantages over the adhering party has redefined arbitration. Arbitration can no longer be counted on to provide a fair, efficient, and expert resolution of a claim. Although courts appear willing to provide the kind of review needed to uncover "redefined" arbitration, and various legal mechanisms exist to assist courts in restoring the arbitral process to its core principles, courts can only act if the adhering party has the resources to challenge the agreement in court. Because it is unlikely that such resources will be sufficientto exposemany abusive …

School-To-Work : What Does This Mean For Our Schools?, Amy K. Leonhart Jan 1999

School-To-Work : What Does This Mean For Our Schools?, Amy K. Leonhart

Graduate Research Papers

Over the course of fifty years the academic content of schools has changed dramatically. Today, employers are looking for different skills from their employees than they were in the 1950s. Therefore, schools have been given the assignment to teach young adults about surviving in the work force.

Where do these skills fit into the schools' curriculum? Is this just another item that is added to the plate of teachers? What time is the "right" time to start teaching these critical skills to youngsters? This paper examines those questions. It also focuses on the different aspects of the school-to-work initiative.

Educating Parents On The Reading Recovery Program, Amy Colette Williams Sorenson Jan 1999

Educating Parents On The Reading Recovery Program, Amy Colette Williams Sorenson

Graduate Research Papers

Just as the African proverb states that it takes a village to raise a child, it also takes a village to help some children read. The significance of the home environment on literacy development has long been recognized (Danielson, 1997; Cairney & Munsie, 1995). Even pa~ents are aware that their interest in their child's literacy learning is important (Hayden, 1995/1996). Learning to read is an educational objective that is valued highly by both parents and teachers (Berger, 1998) and the sharing of knowledge and information about learning to read empowers teacher, parents, and most importantly, children (Holland, 1991 ). Successful …

The Ethics Of Intimate Student-Faculty Relationships, Brian Craig Steinberg Jan 1999

The Ethics Of Intimate Student-Faculty Relationships, Brian Craig Steinberg

Graduate Research Papers

What are the ethics behind intimate student-faculty relationships in higher education? Should such relationships be allowed? Can they be legally controlled? Should there be a penalty for faculty and students who engage in these relationships? Consenting romantic and/or sexual relationships between faculty and student, or between student services professional and student, although usually not expressly forbidden, are generally deemed unwise (Cahn, 1986). According to Svinicki (1994), codes of ethics for most professional associations forbid "professional-client" sexual relationships. In an educational institution, the professor-student and student affairs professional-student relationships are thus such "professional-client" relationships. The respect and trust accorded a professor …

Edge Of House, Dzvinia Orlowsky Jan 1999

Edge Of House, Dzvinia Orlowsky

English Faculty Publications

Joseph Brodsky, in one of the essays in On Grief and Reason, writes that the twentieth century is the century of the displaced person. Writers in this century more than any other—from James Joyce and Ernest Hemingway to Paul Celan and Czeslaw Milosz to Seamus Heaney and Brodsky himself—have explored the ordeal of abandoning, voluntarily or involuntarily, a home that had become culturally or socially oppressive. Ukrainian-American poet Dzvinia Orlowsky, in Edge of House and Cuban-American poet Aleida Rodriguez, in Garden of Exile, while eschewing the political concerns of many of these writers, similarly draw on the impact of displacement …
