A Hierarchical Analysis Approach For High Performance Computing And Communication Applications, Salim Hariri, Pramod Varshney, Luying Zhou, Vinod V. Menon, Shihab Ghaya

Electrical Engineering and Computer Science - All Scholarship

The proliferation of high performance computers and high-speed networks has made parallel and distributed computing feasible and cost-effective on High Performance Computing and Communication Systems (HPCC). However, the design, analysis and development of parallel and distributed applications on such computing systems are still very challenging tasks. Therefore, there is a great need for an integrated multilevel analysis methodology to assist in designing and analyzing the performance of both existing and proposed systems. Currently, there are no comprehensive analysis methods that address such diverse needs. This paper presents a three-level hierarchical modeling approach for analyzing the end-to-end performance of an application …

Responses Of Glossina Fuscipes Fuscipes (Diptera: Glossinidae) And Other Diptera To Carbon Dioxide In Linear And Dense Forests, M. M. Mohamed-Ahmed, S. Mihok

All Peer-Reviewed Publications

The responses of Glossina fuscipes fuscipes Newstead and other Diptera to carbon dioxide were studied in linear and dense forests along the shores of Lake Victoria, Kenya. Flies were caught in biconical traps and were intercepted with electric nets while in flight near traps. Carbon dioxide dispensed at a high rate (51 min-1) in linear forest failed to increase the numbers of tsetse attracted to or caught in traps. In contrast, catches of non-biting Muscidae, Stomoxyinae and Tabanidae were improved by up to 11 times. Inside dense forest, carbon dioxide released at half this rate increased both the numbers of …

Frustration, Richard F. Devlin Frsc Jan 1999

Frustration, Richard F. Devlin Frsc

Articles, Book Chapters, & Popular Press

As noted elsewhere in this book, "sanctity of contract" has been identified as one of the cornerstones of the classical model of contracts. However, as the previous chapter on mistake indicated, in certain limited situations parties may be excused from their contractual obligations. Frustration provides another example of an excuse from performance obligations. Whereas mistake deals with inaccurate assumptions or lack of knowledge about past or existing circumstances, frustration relates to inaccurate assumptions about future circumstances. Sometimes it is not clear whether a mistake or a frustration analysis is appropriate.

More Lessons From The Laboratories: Cy Pres Distributions In Parens Patriae Antitrust Actions Brought By State Attorneys General, Susan Beth Farmer Jan 1999

More Lessons From The Laboratories: Cy Pres Distributions In Parens Patriae Antitrust Actions Brought By State Attorneys General, Susan Beth Farmer

Faculty Scholarship

The structure of the article is outlined in the Table of Contents. First, the article introduces a problem - the denial of an effective remedy for consumers overcharged by antitrust conspiracies, then it describes the legislative solution and identifies the unintended consequences that followed. Next, it proposes two alternative means to resolve the newly discovered issue and, finally, structures a proposed test for courts seeking to order the most efficient and effective remedy for consumers in these cases. The article explains that the Hart-Scott-Rodino Antitrust Improvements Act was adopted to fill a gap in antitrust remedies, which had made treble …

A Model For Arbitration: Autonomy, Cooperation And Curtailment Of State Power, Kenneth Jan 1999

A Model For Arbitration: Autonomy, Cooperation And Curtailment Of State Power, Kenneth

Fordham Urban Law Journal

As compared with the formal pleadings, massive discovery, aggressive motion practice, and endless appeals of litigation, arbitration is undoubtedly more efficient as a dispute resolution mechanism. However, efficiency is only one of many advantages of arbitration. Arbitration empowers disputing parties, promotes individual autonomy and cooperation, and curtails the power of government in the process. Still, the state should not wholly limit its involvement in arbitral processes; the courts do and should have a substantial role in determining the enforceability of arbitration agreements and awards in a few select contexts. Overall, courts should enforce arbitration agreements and only limit enforceability that …

The High Cost Of Efficiency: Mandatory Arbitration In The Securities Industry, Beth E. Sullivan Jan 1999

The High Cost Of Efficiency: Mandatory Arbitration In The Securities Industry, Beth E. Sullivan

Fordham Urban Law Journal

Mandatory arbitration agreements have become standard in the securities industry via the required Form U-4 for anyone seeking a license to buy or sell a security. However, the arbitration agreements generally submits a claimant to a panel of "white males in their sixties," and often claimants do not fare well before such panels. The article explores the claims of proponents of such agreements, such as the efficiency of resolving the dispute, which allegedly benefits both employers and employees, notions of freedom of contract, and ability to foster employment relationships which otherwise would be difficult to enact. However, the article examines …

A Vocation For Law? American Jewish Lawyers And Their Antecedents, Marc Galanter Jan 1999

A Vocation For Law? American Jewish Lawyers And Their Antecedents, Marc Galanter

Fordham Urban Law Journal

Louis D. Brandeis is the presiding eminence in the story of the encounter of Jewish with the American legal order. In the centuries since Brandeis started practicing law, Jews have flourished exceedingly in both the legal professional mainstream (practitioners, judiciaries, academics) and the public interest sector. Can this extravagant participation in both hemispheres of the world of American lawyering be explained by something unique to the Jewish tradition or experience? This Essay addresses that question by focusing on Brandeis, who manifests in his person both sides of this extraordinary flourishing. Brandeis seems a felicitous path to understanding, not because he …

Federalism For The New Millennium: Accounting For The Values Of Federalism, Dennis M. Cariello Jan 1999

Federalism For The New Millennium: Accounting For The Values Of Federalism, Dennis M. Cariello

Fordham Urban Law Journal

This Article explores the long and intricate history of federalism, the arrangement between the federal and local governments to serve the people, in the United States. It begins with the beginnings of federalism in pre-colonial times and continues to discuss how recent Supreme Court decisions have failed to articulate a cohesive test for federalism issues. Ultimately, the Article proposes a method for resolving federalism disputes. This method focuses on the sociopolitical and economic benefits of federalism as the Framers intended. Further, it argues that courts should inquire as to the utility of either the federal or local government regulating a …

What Is Critical Literacy?, Ira Shor Jan 1999

What Is Critical Literacy?, Ira Shor

Journal of Pedagogy, Pluralism, and Practice

We are what we say and do. The way we speak and are spoken to help shape us into the people we become. Through words and other actions, we build ourselves in a world that is building us. That world addresses us to produce the different identities we carry forward in life: men are addressed differently than are women, people of color differently than whites, elite students differently than those from working families. Yet, though language is fateful in teaching us what kind of people to become and what kind of society to make, discourse is not destiny. We can …

A Study To Determine Beliefs Of Vocational Directors And L.E.A. Superintendents Toward The Implementation Of School-To-Work In Indiana, Mary Elizabeth Yoder Jan 1999

A Study To Determine Beliefs Of Vocational Directors And L.E.A. Superintendents Toward The Implementation Of School-To-Work In Indiana, Mary Elizabeth Yoder

All-Inclusive List of Electronic Theses and Dissertations

The problem of this study was to determine the beliefs of LocalEducation Agency (L.E.A.) superintendents and regional vocational directors, who administer area vocational schools in Indiana, toward the federal and state school-to-work initiatives. Specifically the study sought to investigate what the impact is on the implementation of school-to-work in Indiana using the five parameters of the Putnam-Theuerkauf study which are hypothesized to be suppositions that can impede the development and implementation of school-to-work initiatives in America. The Delphi method was used in this study. It allowed the researcher to compare the judgements of a group of experts on school-to-work in …

Can Community Clinics Survive?: A Comparative Study Of Law Centres In Australia, Ontario And England, Frederick H. Zemans, Aneurin Thomas

Articles & Book Chapters

This Chapter grows out of the authors' research into contemporary developments in legal aid in Canada and the international environment. It focuses particularly on community clinics and their equivalents jn Australia, Ontario and England. All three jurisdictions have adapted the American store-front legal clinic model to the needs and legal cultures of their society. Jn Ontario and England, legal aid has been dominated by the j udicare system, emphasising the case-by-case delivery of legal services by private members of the legal profession (Zemans, 1994). J\.ustralia has a mixed model, in which over half of individual casework is dealt with by …

Economic Development, Legality, And The Transplant Effect, Katharina Pistor, Daniel Berkowitz, Jean-Francois Richard Jan 1999

Economic Development, Legality, And The Transplant Effect, Katharina Pistor, Daniel Berkowitz, Jean-Francois Richard

Faculty Scholarship

This paper analyzes the determinants of effective legal institutions (legality) and their impact on economic development today using data from 49 countries. We show that the way the law was initially transplanted and received is a more important determinant than the supply of law from a particular legal family (i.e. English, French, German, or Scandinavian). Countries that have developed legal orders internally, adapted the transplanted law to local conditions, and/or had a population that was already familiar with basic legal principles of the transplanted law have more effective legality than "transplant effect" countries that received foreign law without any similar …

"High Crimes And Misdemeanors": Recovering The Intentions Of The Founders, Gary L. Mcdowell Jan 1999

"High Crimes And Misdemeanors": Recovering The Intentions Of The Founders, Gary L. Mcdowell

Law Faculty Publications

Such serious charges by so many distinguished historians demand a careful consideration of what the Founders meant by "high Crimes and Misdemeanors": Were they only indictable crimes or did they include what one of the Framers called "political crimes and misdemeanors?" Were they offenses that a President would commit only in "the exercise of executive power" or did they also include a President's malfeasance committed in his private capacity? Were they subject to a reasonably fixed meaning or were they to be determined simply by the exercise of the "awful discretion" of those in Congress called upon to impeach and …
