Hayekian Socialism, Richard A. Epstein Jan 1999

Hayekian Socialism, Richard A. Epstein

Faculty Articles

My motivation is simple. In order to understand the evolution of political theory, it is important to identify the strands of socialist thought in Hayek that with time have become the mainstays of the political left. Hayek's effort to find some common ground with his opponents led him to make unwise concessions to the benevolent use of state power. Of course, Hayek did not conceive of himself as the champion of the expansion of government power; nor has he ever been construed that way by friend or foe. But nonetheless, his substantive positions helped to make respectable the growth of …

Civics 2000: Process Constitutionalism At Yale, Daniel J. Hulsebosch Jan 1999

Civics 2000: Process Constitutionalism At Yale, Daniel J. Hulsebosch

Faculty Articles

A review of 2 books is presented: 1. We the People: Transformations, by Bruce Ackerman, and 2. The Bill of Rights: Creation and Reconstruction, by Akhil Reed Amar. These are 2 recent explorations of how, and why, the Constitution has changed. Each of these well-written books is a rich contribution to the historical and theoretical literature of the Constitution and deserves a large readership. Although they differ in style and substance, both convey the same main point: the federal Constitution is premised on popular sovereignty by the People and for the People.

White Privilege And Affirmative Action, Sylvia A. Law Jan 1999

White Privilege And Affirmative Action, Sylvia A. Law

Faculty Articles

As we approach the new century, the Nation is at a critical juncture with respect to race relations and the law. For the past two decades “affirmative action” has been the central mechanism through which we have promoted racial integration, and, at the same time, a central issue of controversy. Since 1996, many authoritative voices challenge the legitimacy of affirmative efforts to achieve racial integration. The Supreme Court has struck down many affirmative action programs. The Court has not upheld any affirmative action program since 1989, when, by a 5-4 decision, it approved a narrowly targeted Congressional program to encourage …

The Content Of Our Characterizations, Paulette M. Caldwell Jan 1999

The Content Of Our Characterizations, Paulette M. Caldwell

Faculty Articles

I argue at the beginning of this Essay that Professor Yamamoto's claim that there exists a divide of chasmic proportions between progressive race theory and legal and political practice asserts too much. Nevertheless, my view of the relationship between theory and practice leads me to suggest that the guidelines he proposes for critical race praxis should be applied to progressive race theory. The tensions he describes in contemporary civil rights litigation exist in, though they do not derive from, progressive race theory.

Rooker-Feldman, From The Ground Up, Barry Friedman, James E. Gaylord Jan 1999

Rooker-Feldman, From The Ground Up, Barry Friedman, James E. Gaylord

Faculty Articles

Our conclusions may be summarized simply: Feldman itself should be overruled. The Rooker-Feldman doctrine should be abolished. Doubt should be cast on state supreme court management of the essentially regulatory function of licensing attorneys and disciplining attorneys and judges. Finally, there might be a need for a new doctrine to plug the small hole left by the Younger and preclusion doctrines - in other words, to bar state plaintiffs from jumping ship to federal court in midstream if they become dissatisfied with state court proceedings.

Search For Charginos And Neutralinos In E+E- Collisions At Centre-Of-Mass Energies Near 183 Gev And Constraints On The Mssm Parameter Space, R. Barate, M. Thulasidas

Research Collection School Of Computing and Information Systems

Searches for charginos and neutralinos are performed with the data collected by the ALEPH detector at LEP at centre-of-mass energies near 183 GeV. In these searches, it is assumed that R-parity is conserved and that the lightest neutralino is the LSP. No evidence of a signal is observed in the 57 pb−1−1 accumulated, which excludes chargino and associated neutralino production up to the kinematic limit over large regions of the MSSM parameter space. Under the assumptions of common gaugino and common sfermion masses at the unification scale, the interplay between the chargino, neutralino and slepton exclusion limits allows a lower …

6 | Ancient Settlement Of The Central Negev, Volume I: The Chalcolithic Period , The Early Bronze Age And The Middle Bronze Age I, Rudolph Cohen

IAA Reports—Monograph Series of the Israel Antiquities Authority

This volume presents the results of the study by Rudolph Cohen of sedentarization in the Central Negev during the Chalcolithic period, Early Bronze Age and Middle Bronze Age 1 (Intermediate Bronze Age), including the finds, settlement patterns, economy, etc. The reports of the surveys and excavations and the finds are in Hebrew, with a summary and a number of specialist reports presented in English.

A Study Of Single W Production In E+E- Collisions At √S = 161-183 Gev, R. Barate, Manoj Thulasidas Jan 1999

A Study Of Single W Production In E+E- Collisions At √S = 161-183 Gev, R. Barate, Manoj Thulasidas

Research Collection School Of Computing and Information Systems

Single W production is studied in the data recorded with the ALEPH detector at LEP at centre-of-mass energies between 161 and 183 GeV. The cross section is measured to be σw = 0.41 ± 0.17(stat.) ± 0.04(syst.) pb at 183 GeV, consistent with the Standard Model expectation. Limits on non-standard WWγ couplings are deduced as -1.6 γ γ = 0) and -1.6 γ γ = 1) at 95% C.L. A search for effectively invisible decays of the W boson in W pair production is performed, leading to an upper limit on the branching ratio of 1.3% (Γinv = 27 MeV) …

Study Of T Decays Involving Kaons, Spectral Functions And Determination Of The Strange Quark Mass, R. Barate, M. Thulasidas Jan 1999

Study Of T Decays Involving Kaons, Spectral Functions And Determination Of The Strange Quark Mass, R. Barate, M. Thulasidas

Research Collection School Of Computing and Information Systems

All ALEPH measurements of branching ratios of ττ decays involving kaons are summarized including a combination of results obtained with K0SKS0 and K0LKL0 detection. The decay dynamics are studied, leading to the determination of contributions from vector K∗(892)K∗(892) and K∗(1410)K∗(1410), and axial-vector K1(1270)K1(1270) and K1(1400)K1(1400) resonances. Agreement with isospin symmetry is observed among the different final states. Under the hypothesis of the conserved vector current, the spectral function for the KK¯¯¯¯¯πKK¯π mode is compared with the corresponding cross section for low energy e+e−e+e− annihilation, yielding an axial-vector fraction of (94+6−8)%(94−8+6)% for this mode. The branching ratio for ττ decay into …
