A Defense Of Analogical Reasoning In Law, Emily Sherwin Oct 1999

A Defense Of Analogical Reasoning In Law, Emily Sherwin

Cornell Law Faculty Publications

This Article defends the practice of reasoning by analogy on the basis of its epistemic and institutional advantages. The advantages identified for analogical reasoning include that it produces a wealth of data for decisonmaking; it represents the collaborative effort of a number of judges over time; it tends to correct biases that might lead judges to discount the force of prior decisions; and it exerts a conservative force in law, holding the development of law to a gradual pace. Notably, these advantages do not depend on the rational force of analogical reasoning. Rather, the author contends that, as open-ended reasoning …

A Phenomenological Inquiry Into The Nature Of The Sacred, Ana Maria Janssen Oct 1999

A Phenomenological Inquiry Into The Nature Of The Sacred, Ana Maria Janssen

Institute for the Humanities Theses

There is good reason to believe that sacred experience is available to all humans. Yet the question of the sacred is frequently reduced to a debate between believers of various religions. As the focus of contention narrows, the ubiquity of sacred experience is neglected. Keeping this in mind, this analysis of the sacred confines itself strictly to the phenomenon of the sacred as a human experience, without confirming or denying the existence of a god or the veracity of any system of belief. Heidegger's Phenomenology is a useful model for such an analysis precisely because it lays aside conjecture about …

A Generic Object-Oriented Random Variate Model For Discrete Event Simulations Separating The Data Model From The Process Model, Palathingal Frank Oct 1999

A Generic Object-Oriented Random Variate Model For Discrete Event Simulations Separating The Data Model From The Process Model, Palathingal Frank

Computational Modeling & Simulation Engineering Theses & Dissertations

Data is the lifeline of any simulation model. The validity of the data is a primary determining factor on the accuracy of a simulation. Hence the data model is an important part of any simulation model. But this is, in most occasions, the most neglected part of any model. Most people view the model correctness in te1ms of the process model functionality rather than the data that is being used in the simulation. As simulation gets more accepted as a reliable problem-solving tool, it is increasingly important to pay careful attention to the accuracy of the simulation and that can …

The Trust Offshore, Antony G.D. Duckworth Oct 1999

The Trust Offshore, Antony G.D. Duckworth

Vanderbilt Journal of Transnational Law

I was not present at the birth of the offshore financial centers or of their trust business, but I am told that the mother was taxation. Perhaps that is an oversimplification, but I do not doubt that taxation was the major influence. The typical settlor was a taxpayer from one of the major common law countries, and his primary motive for going offshore was tax avoidance. But there were also a few settlors from other places, some motivated by estate planning considerations (the trust allowing them to make property arrangements which could not be made at home), some by fear …

Measurement Of B0-B̅0 Flavor Oscillations Using Jet-Charge And Lepton Flavor Tagging In Pp̅ Collisions At √S =1.8 Tev, F. Abe, Kenneth A. Bloom, Collider Detector At Fermilab Collaboration Oct 1999

Measurement Of B0-B̅0 Flavor Oscillations Using Jet-Charge And Lepton Flavor Tagging In Pp̅ Collisions At √S =1.8 Tev, F. Abe, Kenneth A. Bloom, Collider Detector At Fermilab Collaboration

Kenneth Bloom Publications

We present a measurement of the mass difference Δmd for the B0 meson and the statistical power of the b flavor tagging methods used. The measurement uses 90 pb-1 of data from pp̅ collisions at √s =1.8 TeV collected with the CDF detector. An inclusive lepton trigger is used to collect a large sample of B hadron semileptonic decays. The mass difference Δmd is determined from the proper time dependence of the fraction of B hadrons that undergo flavor oscillations. The flavor at decay is inferred from the charge of the lepton from semileptonic …

Differentiation Of Mexican Species Of Haematoloechus Looss, 1899 (Digenea: Plagiorchiformes): Molecular And Morphological Evidence, Virginia León-Règagnon, Daniel R. Brooks, Gerardo Perez-Ponce De Leon Oct 1999

Differentiation Of Mexican Species Of Haematoloechus Looss, 1899 (Digenea: Plagiorchiformes): Molecular And Morphological Evidence, Virginia León-Règagnon, Daniel R. Brooks, Gerardo Perez-Ponce De Leon

Harold W. Manter Laboratory of Parasitology: Faculty Publications

Molecular evidence is interpreted in the light of morphology to examine the validity of several species of Haematoloechus described as Mexican endemics. Internal transcribed spacers 1 and 2 and 28S ribosomal genes were sequenced for 11 isolates. Phylogenetic analysis of separate partitions and combined databases was conducted. Results were analyzed, in the light of morphological evidence. Haematoloechus macrorchis is proposed as a junior synonym of Haematoloechus longiplexus. Haematoloechus pulcher is a sibling species with Haematoloechus complexus in Lerma wetlands. In Mexico, Haematoloechus medioplexus is distributed along the east coast coinciding with the distribution of Rana berlandieri. The sister …

Class War: Ontario Teachers And The Courts, Harry J. Glasbeek Oct 1999

Class War: Ontario Teachers And The Courts, Harry J. Glasbeek

Osgoode Hall Law Journal

In 1997, the government of Ontario met with unexpected opposition to its changes to the education system with the introduction of Bill 160, the Education Quality Improvement Act, culminating in a province-wide strike by teachers. In reaction, the government sought to divert the conflict into the courts. Although the teachers were initially successful in court, the strike was not, and many of the strikers' objectives were not met. The author argues that the law of injunctions and collective bargaining shifted and narrowed the scope of the conflict, and reduced the political power of the teachers. The litigation surrounding Bill 160 …

Vincent In Translation, Marie Poole D.C. Oct 1999

Vincent In Translation, Marie Poole D.C.

Vincentian Studies

The Vincent Translation Project began in 1973 with the goal of producing “a modern American English edition of the extant works” of Vincent de Paul. Marie Poole explains the way the project is conducted, its challenges, and its contributions to scholarship. It is particularly through Vincent’s correspondence that we understand who he was as a person. Poole describes his time and his personality, especially as the latter was impacted by his Gascon heritage. She also specifies his relevance for many types of people today.

Alj Final Orders On Appeal: Balancing Independence With Accountability, Jim Rossi Oct 1999

Alj Final Orders On Appeal: Balancing Independence With Accountability, Jim Rossi

Vanderbilt Law School Faculty Publications

This essay addresses how ALJ final order authority in many state systems of administrative governance (among them Florida, Louisiana, Missouri, and South Carolina) poses a tension between independence and accountability. It is argued that political accountability is sacrificed where reviewing courts defer to ALJ final orders on issues of law and policy. Standards of review provide state courts with a way of restoring the balance between independence and accountability, but reviewing courts should heighten the deference they give to the agency's legal and policy positions -- giving little or no deference to the ALJ on these issues -- even where …

The Governmental Composition Of The Insurance Costs Of Smoking, W. Kip Viscusi Oct 1999

The Governmental Composition Of The Insurance Costs Of Smoking, W. Kip Viscusi

Vanderbilt Law School Faculty Publications

The estimated health risks from smoking have significant external financial consequences for society. Studies at the national level indicate that cigarettes are self-financing since external costs such as those due to illnesses are offset by cost savings associated with premature death, chiefly pension costs. This paper extends this analysis to all 50 states and considers the costs considered in the state attorneys general suits against the cigarette industry. Cigarettes are always self-financing from the standpoint of costs to each state. The extent of the cost savings is less than at the federal level. However, smokers' higher medical costs are outweighed …

Using Warnings To Extend The Boundaries Of Consumer Sovereignty, W. Kip Viscusi Oct 1999

Using Warnings To Extend The Boundaries Of Consumer Sovereignty, W. Kip Viscusi

Vanderbilt Law School Faculty Publications

We make decisions every day for which we may not have full information. Not all such decisions lead to negative consequences, however. For example, scientists still know very little about why aspirin has its beneficial effects. However, the lack of our knowledge does not necessarily imply that our decisions are in error or that our freedom to make these decisions should be constrained. Almost invariably, we must make decisions with uncertain implications when we fail to have complete information, whether it be with respect to today's weather forecast or the chemical composition of the foods we eat, but this does …

Sanctioning A Tyranny: The Diminishment Of Ex Parte Young, Expansion Of Hans Immunity, And Denial Of Indian Rights In Coeur D'Alene Tribe, John P. Lavelle

Faculty Scholarship

This Article analyzes a recent decision of the Supreme Court that illustrates the enormous destructive power of the Rehnquist Court's peculiar brand of anti-tribal activism, Idaho v. Coeur d'Alene Tribe. Coeur d'Alene Tribe is likely to heighten the urgency with which Eleventh Amendment scholars have called for an overruling of Hans to ameliorate the damage that Hans and its progeny already have done to the regime of federally protected rights under the Constitution, laws and treaties of the United States-a regime at the core of the Framers' vision of paramount federal law and essential to securing true liberty for all …
