Daubert Readiness Of Texas Judiciary: A Study Of The Qualifications, Experience, And Capacity Of The Members Of The Texas Judiciary To Determine The Admissibility Of Expert Testimony Under The Daubert, Kelly, Robinson, And Havner Tests, Cynthia Stevens Kent

Texas Wesleyan Law Review

This article will look at the results of a survey conducted among Texas judges regarding their background, experience, training, and confidence in performing this gate-keeping function. First, it is important to review the history of judicial decision-making as it applies to the admissibility of expert testimony. What have been the legal guidelines for admissibility and how has the recent case law changed those legal standards? Second, what did the survey of Texas judges tell us about their education and perceived ability to perform the gate-keeping role? Finally, what future issues does the judicial gate-keeping rule raise for experts, lawyers, and …

Reading Between Librarians’ Lines, Mark Y. Herring Oct 1999

Reading Between Librarians’ Lines, Mark Y. Herring

Dacus Library Faculty Publications

It is a well known fact that librarians, as professionals go, are not among the world's most demonstrative people. I can say that with impunity because I am one. It's one thing for a man to slight his own profession; quite another when someone else presumes to do it. But given that librarians are a placid sort, just mention the phrase "intellectual freedom," or utter the word "censorship," and the usually calm demeanor of the librarian becomes as agitated as the water between Charybdis and Scylla! This article addresses three aspects of the issue of intellectual freedom and attempts to …

A Geometric Approach To Classification Of Trash In Ginned Cotton, Murali Siddaiah, Michael A. Lieberman, Nadipuram R. Prasad, Vladik Kreinovich Oct 1999

A Geometric Approach To Classification Of Trash In Ginned Cotton, Murali Siddaiah, Michael A. Lieberman, Nadipuram R. Prasad, Vladik Kreinovich

Departmental Technical Reports (CS)

This paper discusses the use of geometric approach to classify different types of trash (non-lint, non-fiber material) in ginned cotton. Pieces of trash can have complicated shapes, so we would like to find a good approximating family of sets. Which approximating family is the best? We reduce the corresponding optimization problem to a geometric one: namely, we show that, under some reasonable conditions, an optimal family must be shift-, rotation- and scale-invariant. We then use this geometric reduction to conclude that the best approximating low-dimensional families consist of sets with linear or circular boundaries.

This result is in good agreement …

Are Journalists Qualified To Write About Health And Science?, Burnis R. Morris

SOJMC Faculty Research

This article examines the preparation of journalists to report on health and science issues. It traces the historical linkage between the news media and health and science and reports the results of a survey of college professors who teach reporting courses at 86 departments and schools of journalism and mass communication. The article, also intended to help explain the journalistic method to scientists, concludes that many young journalists are qualified to cover simple stories about health and science and other topics when they leave college and acquire the skills to report on more complex issues through on-the-job training and specialized …

Simultaneous Photometry And Spectroscopy Of The Newly Discovered Γ Doradus Variable Hr 8330=Hd 207223, Anthony B. Kaye, Gregory W. Henry, Francis C. Fekel, Douglas S. Hall

Information Systems and Engineering Management Research Publications

We present BV photometry and simultaneous high-resolution, high signal-to-noise ratio spectroscopy of the newly-discovered γ Doradus variable HR 8330 taken during the 1997 and 1998 observing seasons. We calculate power spectra for the B- and V-band data sets and for the time series defined throughout the observing season at each point across the Fe iiλ4508.289 and the Ti iiλ4501.278 line profiles to search for periodic variability. Period analysis reveals a single, 2.6-d period in both the photometric and the spectroscopic data, with a 237° phase lag between them. Based on the location of HR 8330 in the HR diagram and …

The Impact Of Landmines Yesterday And Today, A. G. Marangione

The Journal of Conventional Weapons Destruction

On April 20, 1945, at about 5 a.m., still dark, I and two of my companions from Troop A 16th Cavalry, were on a reconnaissance patrol on the outskirts of Dusseldorf, Germany. I was in the passenger seat of a jeep. I had a driver and one man in the rear manning a .30-caliber machine gun. His name was Clarence Brown, but because he was a huge fellow we affectionately called him "Bear." We had been together since our Cavalry-Squadron was formed in 1942 in Fort Oglethorpe, Georgia. On April 20 we were part of a very proud and successful …

Clemency In Texas - A Question Of Mercy?, Allen L. Williamson Oct 1999

Clemency In Texas - A Question Of Mercy?, Allen L. Williamson

Texas Wesleyan Law Review

A man and a woman each brutally murdered multiple victims. Both experienced difficult childhoods. Both received a fair trial and were sentenced to die by a jury of their peers. Both were convicted in the State of Texas. Both exhausted all viable appeals. While incarcerated, one became a model prisoner and religious leader, the other confessed to killing over 600 people and took great delight in recounting the gruesome details of the crime. Each one attracted national media attention and was scheduled to die in 1998. Both asked the same governor for clemency. One was granted clemency and the other …
