The Legitimacy Of Leadership Studies As An Academic Field Of Study, Megan Moran, Joy Shortlidge Jan 1999

The Legitimacy Of Leadership Studies As An Academic Field Of Study, Megan Moran, Joy Shortlidge

Honors Theses

Before exploring the legitimacy of leadership studies as an academic field of study, we will first explore the characteristics of a liberal arts education and establish its legitimacy (through historical analyses) as the "standard" of higher education in America, and the educational approach most associated with cultivating an enlightened citizenry in a democratic society. Once the legitimacy of a liberal arts education is established, this form of education will serve as the benchmark to which we will compare leadership studies. We will apply the same criteria that established the legitimacy of a liberal arts education to the field of leadership …

Execution Of Angel Breard: The United States Federalist System As Scapegoat For The Violation Of An Icj Order, Jane Amory Allen Jan 1999

Execution Of Angel Breard: The United States Federalist System As Scapegoat For The Violation Of An Icj Order, Jane Amory Allen

Richmond Journal of Law and the Public Interest

To quote the famous case, The Paquete Habana, "International law is a part of our law." When the Commonwealth of Virginia executed Angel Breard, the United States violated international law. Not only did the Commonwealth of Virginia violate the treaty obligations of its federal government, but the United States failed to comply with the Order of Provisional Measures set forth by the International Court of Justice (ICJ). The outpouring of official dualism through all stages of the case as well as the failure to afford the decision of the ICJ its due respect were affronts to the international community. Mr. …

Dickerson And The Future Of Miranda, Brenda E. Mallinak

Richmond Journal of Law and the Public Interest

Dickerson v. United States is one such case where the Fourth Circuit considered §3501 sua sponte and applied the statute in the absence of Miranda warnings. This action by the Fourth Circuit raises four issues which will be addressed in this paper. Part I addresses the issue of whether the federal executive branch can decline to enforce a law passed by Congress will be examined, as well as the related question of whether, in the face of executive refusal to use a law, can the courts sua sponte rely on that law to decide a case. In Part 11 the …

On Protecting Accountability, Eric M. Freedman

Hofstra Law Review

Today's subject, whether a sitting President may be indicted, is one that I have addressed in print over many years, dating back to the Nixon Administration. In particular, I am the author of The Law as King and the King as Law: Is a President Immune from Criminal Prosecution Before Impeachment?' which I believe remains the most complete and thoroughly-documented scholarly study of the issue. Since it contains a good deal of additional legal and historical data backing up the principal points I will be making, I hope you will read it in full (or at least refer to its …

Developmental Changes In The Nicotinic Responses Of Ciliary Ganglion Neurons, Edward M. Blumenthal, Richard D. Shoop, Darwin K. Berg Jan 1999

Developmental Changes In The Nicotinic Responses Of Ciliary Ganglion Neurons, Edward M. Blumenthal, Richard D. Shoop, Darwin K. Berg

Biological Sciences Faculty Research and Publications

Developmental changes in the nicotinic responses of ciliary ganglion neurons. J. Neurophysiol. 81: 111–120, 1999. The accumulation of functional neurotransmitter receptors by neurons during development is an essential part of synapse formation. Chick ciliary ganglion neurons express two kinds of nicotinic receptors. One is abundant, contains the α7 gene product, rapidly desensitizes, and binds α-bungarotoxin. The other is less abundant, contains multiple gene products (α3, β4, α5, and β2 subunits), slowly desensitizes, and binds the monoclonal antibody mAb 35. Rapid application of agonist to freshly dissociated neurons elicits responses from both classes of receptors. Between embryonic days 8 and 15, …

New International Legal Process, Mary Ellen O'Connell Jan 1999

New International Legal Process, Mary Ellen O'Connell

Journal Articles

International legal process (ILP) emphasizes understanding how international law works. It concentrates not so much on the exposition of rules and their content as on how international legal rules are actually used by the makers of foreign policy. It is a more limited methodology than some others discussed in the symposium in that it did not, as originally developed, expose the normative values of the methodology, or how the methodology could be used to achieve those values. Nevertheless, ILP, as a study of international law in its actual operation and the consideration of how international law could work better, has …

Atrocities, Deterrence, And The Limits Of International Justice, David Wippman Jan 1999

Atrocities, Deterrence, And The Limits Of International Justice, David Wippman

Fordham International Law Journal

Unfortunately, the connection between international prosecutions and the actual deterrence of future atrocities is at best a plausible but largely untested assumption. Actual experience with efforts at deterrence is not encouraging. Before placing too much reliance on deterrence as a basis for supporting international criminal prosecutions, especially over possible alternatives such as truth and reconciliation commissions, we ought at least to consider carefully the obstacles to achieving effective deterrence.

The Future Of Genocide: A Spectacle For The New Millenium?, David M. Smolin

Fordham International Law Journal

The lines between bearing witness and producing entertainment, between genuine outrage and self-righteous apathy can be initially difficult to discern. Such differences lie in the difficult areas of ethics, religion, and the hidden recesses of the human heart. Nonetheless, over thousands of years various world religions have sought to come to terms with the deepest questions pertaining to intention, action, and ethics, and particularly with the manner in which human beings are trained in ways of life or death. This Essay shall include some specifically Christian theological perspectives on the dilemmas that draw us toward the specter of genocide as …

Competition Law And Regulation Law From An Ec Perspective, John Temple Lang Jan 1999

Competition Law And Regulation Law From An Ec Perspective, John Temple Lang

Fordham International Law Journal

These comments look at the subject from a legal viewpoint, in contrast to the Essay by Professor Dr. Günter Knieps, which uses an economic approach. His Essay raises several issues concerning access: (1) who should be obliged to give it; (2) to whom; (3) in what circumstances; and (4) on what terms? In practice, the precise answers will depend on whether European Community (“Community” or “EC”) competition law, national competition law, or national telecommunications law based on Community directives, are being applied. As far as possible, the same answer should be given in all cases.

A Multi-Faceted Program To Recruit And Develop African Seventh-Day Adventist Writers, Enock Okari Omosa Jan 1999

A Multi-Faceted Program To Recruit And Develop African Seventh-Day Adventist Writers, Enock Okari Omosa

Doctor of Ministry Projects

Problem

Although the Seventh-day Adventist Church (SDA) in Kenya has about 500,000 believers, most of the literature read and used by its members was originally written by Christians from the West. This study identifies some of the problems caused by the lack of African Adventist writers producing acceptable African Adventist literature for Adventist members and other Africans in Kenya, and points the way toward positive measures to remedy the situation.

Method

In order to design an appropriate program to recruit and develop African Seventh-day Adventist writers in Kenya, an attempt is made to examine the kind of literature needed and …

The Development Of A Program For The Retention Of New Members In The New Jerusalem Seventh-Day Adventist Church, Enell Oswald Hall

Doctor of Ministry Projects

This dissertation evaluates a program that was developed for the retention of new members in the New Jerusalem Seventh-day Adventist Church. One of the greatest needs of new Christians is help in establishing a meaningful relationship within the body of Christ. The church, not the new converts, is primarily responsible for the process of assimilation. Two strategies were implemented at the New Jerusalem Church: 1. A study was conducted to analyze the growth pattern of the church for the past ten years. Two groups of members were surveyed— those baptized within the past eighteen Reproduced with permission of the copyright …

The Topic. The topic of this project is evangelistic theory. Because of the large-scale secularization of Western society, the evangelistic method that has prevailed for decades is becoming less and less effective. The Purpose. This project was to experiment with evangelistic theory, proposing and testing a new paradigm for speaking to secular people that uses a philosophical strategy.

The Sources. The original source for this project was material presented in a doctoral class. It was augmented with pertinent literature from …
