Spatial Patterns In Ocean Color And Temperature Maps: Fronts, Fractals, And Ecological Considerations, Christine Chan
Spatial Patterns In Ocean Color And Temperature Maps: Fronts, Fractals, And Ecological Considerations, Christine Chan
Open Access Dissertations
Heterogeneity in ocean patterns is at once intriguing and problematic. Processes such as primary production or mixing occur on a range of scales in time and in space; variability must be captured at appropriate scales with tools flexible enough to detect changes in pattern-generating processes. Frontal and fractal analyses were applied to satellite-derived sea surface temperature and ocean color imagery to describe patterns in Northwestern Atlantic shelf and slope seas. On a seasonal scale, climatological thermal fronts were most frequent in winter and were found on the continental shelf south of the NY Bight and alongshore in the Gulf of …
Regulation Of Stability Of Marketed Pharmaceuticals, Brahmaiah Kommanaboyina
Regulation Of Stability Of Marketed Pharmaceuticals, Brahmaiah Kommanaboyina
Open Access Master's Theses
The United States Pharmacopeia I National Formulary (USP/NF) sets the standards and maintains monographs for the evaluation of various dosage forms, especially during the storage and distribution channels. This document is compiled with the critical review of the stability testing of pharmaceutical products. In particular, it considers the progress toward globalization and harmonization, attention being directed to monitoring stability in the distribution channels. It is also focussed on the implications of Mean Kinetic Tempearature (MKT) concept and the effect of temperature spikes on MKT values, thus effecting the stability of drug products. The assignment of conformance period to the tablets …

Objective: Using prescription claims data, the objectives of this study were: (1) to compare the proportion of variation in cost of pharmaceuticals that could be explained by available demographic variables and plan characteristics within various therapeutic categories; (2) to examine the relationships among plan characteristics and cost of pharmaceuticals; and (3) to evaluate whether utilization differed among various demographic variables and plan characteristics after controlling for appropriate covariates.
Design: Retrospective, cross-sectional study. Data
Collection: Data for this study were obtained from 1996 prescription claims information for the commercial population administered by a Rhode Island-based pharmacy benefit management …
The Foundation Of Radical Ecological Philosophy In Karl Marx’S View Of Nature, Elizabeth Marsis
The Foundation Of Radical Ecological Philosophy In Karl Marx’S View Of Nature, Elizabeth Marsis
Open Access Master's Theses
The three main non-traditional schools of environmental philosophy - social ecology, feminism and deep ecology - contain divergent views of and claims regarding the universalization of their particular world views. One example of this divergence of views concerns the status of human/non-human relationships. Like many other contemporary non-traditional liberation movements and theories, these three environmental movements and schools of thought have been influenced by the theories of Karl Marx.
Therefore, in order to clarify and understand the way in which, and the extent to which, key proponents of each of these environmental movements and philosophies universalize their particular philosophic world …

Adverse clinical outcomes were measured by severe asthma exacerbations resulting in: …
How Subject Characteristics Influence Attention Task Performance: A Structural Modeling Approach, Kristen A. Mckiernan
How Subject Characteristics Influence Attention Task Performance: A Structural Modeling Approach, Kristen A. Mckiernan
Open Access Dissertations
This research project presented and tested a theoretical model of auditory sustained attention. The model includes the personal, or subject characteristics that are believed to influence a person's ability to sustain attention. These characteristics are positive affect, negative affect, motivation, arousal, and concentration. Auditory sustained attention is represented by performance on a computerized continuous performance test (CPT); the CPT is widely used in both research and clinical settings. Three hundred and eleven participants were recruited for this study. Data from 286 of them were included in these analyses. All participants received some form of course credit for their participation. The …
Between Two Faiths: The Arabization Of The Knights Templar During The Crusades, Paula Regina Stiles
Between Two Faiths: The Arabization Of The Knights Templar During The Crusades, Paula Regina Stiles
Open Access Master's Theses
The military orders , especially the first, the Order of the Poor Knights of the Temple of Solomon (Knights Templar) played a critical role in the preservation of the Crusader kingdoms in Palestine between 1119 and their fall in 1291. It is generally acknowledged that part of the Templars' success, in both Palestine and Spain, stemmed from their ability to deal with the Muslim enemy in a variety of situations. This naturally involved some assimilation of the Templars into the local culture during the 12th and 13th centuries.
This thesis explores the nature of that assimilation (either arabization or islamization), …
Residential Perception Of Tourism In Towns Neighboring Cancun, Mexico, Alison Macrae
Residential Perception Of Tourism In Towns Neighboring Cancun, Mexico, Alison Macrae
Open Access Master's Theses
This thesis examines local perception of tourism in two towns neighboring Cancun, Mexico. In response to the economic success of Cancun, tourism development in other nearby towns is growing at a rapid pace. In order to mitigate unwanted impacts and guide tourism development in smaller towns, it is necessary to identify residential attitudes toward local tourism as well as the type of tourism displayed in Cancun. The two towns chosen for this study are experiencing different stages of tourism development, and are also differentially located with respect to Cancun. This thesis tests three hypotheses: a) the two towns will demonstrate …
Gravity-Capillary Waves And Their Influence On Air-Sea Interaction Under Non-Stationary Conditions, B. Mete Uz
Gravity-Capillary Waves And Their Influence On Air-Sea Interaction Under Non-Stationary Conditions, B. Mete Uz
Open Access Dissertations
There is renewed interest in short wind-waves because they are actively involved in most exchange processes between the ocean and the atmosphere, because they are the basis of radar remote sensing measurements, and also because new methods are available to measure them. Wind generated gravity-capillary waves have been measured along with wind parameters both in a wind-wave tank, using a scanning laser slope gauge capable of good wavenumber and frequency resolution. The experiments address the classical issues of the generation and subsequent evolution of short wind-waves, their modulation by fluctuating wind forcing and their contribution to the momentum flux from …

Employer Liability For Harassment Under Title Vii: A Functional Rationale For Faragher And Ellerth, Michael C. Harper
Employer Liability For Harassment Under Title Vii: A Functional Rationale For Faragher And Ellerth, Michael C. Harper
San Diego Law Review
In two decisions concerning sexual harassment, Faragher v. City of Boca Raton' and Burlington Industries, Inc. v. Ellerth, The Supreme Court, on the last day of its 1997-1998 term finally articulated coherent vicarious liability rules critical for bounding the scope of the discrimination prohibitions in Title VII of the Civil Rights Act of 1964. The Court did so by explaining the meaning of the inclusion of "any agent" in Title VII's definition of "employer.'" The meaning of "agent" in this definition is critical for establishing employer liability because almost all Title VII-protected employees work for corporations and other legal fictions …
The First Women Members Of The Supreme Court Bar, 1879-1900, Mary L. Clark
The First Women Members Of The Supreme Court Bar, 1879-1900, Mary L. Clark
San Diego Law Review
In 1879, Belva A. Lockwood of Washington, D.C., became the first woman member of the bar of the U. S. Supreme Court. Lockwood had applied for admission to the bar three years earlier, but had been refused on the ground that no woman had ever been admitted and thus there was no precedent for women's admission. Not easily defeated, Lockwood lobbied Congress to amend the rules governing admission of attorneys to the Supreme Court bar to allow for women as well as men. In February, 1879, Congress adopted "an Act to relieve certain legal disabilities of women," which authorized women …

Jerry-Building The Road To The Future: An Evaluation Of The White Commission Report On Structural Alternatives For The Federal Courts Of Appeals, Joseph N. Akrotirianakis, Paul Garo Arshagouni, Zareh A. Jalotorssian
San Diego Law Review
For years, critics have argued that the United States Court of Appeals for the Ninth Circuit should be divided because it has grown too large to manage its caseload effectively.' They blame the Ninth Circuit's size for alleged increases in intra-circuit conflicts, inefficiency, delay, and a lack of collegiality among its judges.! In recent years, conservative
congressmen in the Pacific Northwest have criticized the San Francisco- based circuit for its "liberal" rulings on everything from the environment
to the death penalty?
Legal Rules And Social Reform, Emily Sherwin
Legal Rules And Social Reform, Emily Sherwin
San Diego Law Review
Rules are designed to reduce error by prescribing actions that, in the run of cases, will produce better results than the subjects of rules would obtain if they judged for themselves what to do. At the same time, rules sometimes produce errors when applied to particular cases. If the sum of error under rules is less than the sum of error rules prevent, then the rule-making authority has reason to issue "serious" rules-rules to be followed in every case. Because rules are imperfect, however, the subjects of rules do not always have good reason to follow them. This means that …
The Rule In A Contribution Action Between Third-Party Insurers Wherein The Plaintiff Insurer Seeks Reimbursement Of Defense Costs From The Defendant Insurer After A Collusive Fraud On The Plaintiff Insurer Under California Law
San Diego Law Review
This Comment addresses five sub- issues, as follows:
1. Does or should an insurer have a duty to defend when it "knows" that the insured is involved in collusive fraud? 2. Assuming there is "substantial" but inconclusive evidence of collusive fraud, does an insurer who refuses to defend thereby commit a breach of duty? 3. In connection with a contribution action, are there any "gatekeeper" duties owed by the payer to the non-payer which must be satisfied? 4. Given that the non-payer denied coverage on the basis of collusive fraud, what must be proven in a subsequent contribution action? 5. …
The Devil Made Me Do It: Replacing Corporate Directors' Veil Of Secrecy With The Mantle Of Stewardship, Constance E. Bagley, Karen L. Page
The Devil Made Me Do It: Replacing Corporate Directors' Veil Of Secrecy With The Mantle Of Stewardship, Constance E. Bagley, Karen L. Page
San Diego Law Review
This Article argues that the nature of the corporate form coupled with an exclusive focus on shareholder value leads to economically and socially inefficient results. The "profit maximization" view of directors' duties ignores the historical reasons why corporations were given special privileges, such as limited liability, by the state. This narrow view should be replaced with a doctrine of stewardship that imposes a more comprehensive view of the corporation's and directors' responsibility to manage the vast resources held in corporate form. This broader view is consistent not only with the values of a free market economy, but also with modem …
A Jurisprudence In Disarray: On Battery, Wrongful Living, And The Right To Bodily Integrity, Mark Strasser
A Jurisprudence In Disarray: On Battery, Wrongful Living, And The Right To Bodily Integrity, Mark Strasser
San Diego Law Review
The right to bodily integrity is firmly entrenched in the right to privacy jurisprudence. An individual who has that right violated by being subjected to an unwanted touching can sue for damages. For example, an individual who receives medical treatment against her will can bring an action for battery, even if that treatment provides her a net benefit.' Yet, the determination of whether our current system provides either sufficient compensation for the victim of a nonconsensual physical invasion or a sufficient disincentive to possible tortfeasors to prevent such invasions is only possible after the potential damages for such invasions are …
The Juvenile Justice System Of Richmond : Progression Into The Future, Elizabeth Ann Teixeira
The Juvenile Justice System Of Richmond : Progression Into The Future, Elizabeth Ann Teixeira
Honors Theses
The area of juvenile justice in America is a growing concern among both urban and rural community leaders. According to the Community Collaborative for Youth, the juvenile violent crime rate in Richmond is triple the state average. 1 The juvenile violent crime rate is the percentage of violent crime committed by a person under the age of eighteen. This is merely one aspect of the adversity facing the juvenile justice system in the eyes of the community. As a result of the growing need for information on the subject, a great deal of literature has been published about the risk …
Gender Discrimination Within The Reproductive Health Care System: Viagra V. Birth Control, Lisa A. Hayden
Gender Discrimination Within The Reproductive Health Care System: Viagra V. Birth Control, Lisa A. Hayden
Journal of Law and Health
This Article begins with an examination of the prescription drug, Viagra and the medical condition it is intended to aid. Additionally, this Article evaluates the five most common, and FDA approved forms of contraceptives: contraceptive pills, intrauterine devices (IUD's), Depo-Provera shots, Norplant inserts and diaphragms. A basic understanding of the above prescriptions is necessary to determine if health care inequity exists between men and women in the area of prescriptive coverage, or if there is such a difference between the medical conditions involved that insurance companies are justified in excluding contraceptive coverage while including Viagra coverage. Part III of this …
Domestic Partnership Benefits: Why Not Offer Them To Same-Sex Partners And Unmarried Opposite Sex Partners, Debbie Zielinski
Domestic Partnership Benefits: Why Not Offer Them To Same-Sex Partners And Unmarried Opposite Sex Partners, Debbie Zielinski
Journal of Law and Health
Employers offering these benefits to same-sex domestic partners only, may face legal challenges such as marital status and sexual orientation discrimination or equal protection arguments from their unmarried heterosexual employees. In addition, states and municipalities have been increasing the potential of such litigation by passing laws that prohibit discrimination based on sexual orientation and marital status especially in the areas of housing and employment. This Note examines the potential of such legal challenges when employers use the narrow definition in structuring their domestic partner benefit programs. In addition, avoiding challenges by simply not offering benefits will be discussed. However, before …
Beyond Washington V. Glucksberg: Oregon's Death With Dignity Act Analyzed From Medical And Constitutional Perspectives , Steven B. Datlof
Beyond Washington V. Glucksberg: Oregon's Death With Dignity Act Analyzed From Medical And Constitutional Perspectives , Steven B. Datlof
Journal of Law and Health
This Article examines several aspects of the medical and legal debate on physician-assisted suicide. Part I describes the Oregon Death with Dignity Act, the only existing American law legalizing physician assisted suicide. Understanding the provisions of the DWDA provides a concrete, practical framework for discussing the medical and constitutional issues central to the PAS debate. Part II considers the wisdom of the DWDA in light of current medical knowledge and practice. The law allows a patient, with only a few months to live, a human end to intolerable suffering under controlled conditions. It is carefully crafted to ensure that patient …
Directors' Duty Of Care To Monitor Information Systems In Hmos: Some Lessons From The Oxford Health Plan, Mary E. O'Byrne
Directors' Duty Of Care To Monitor Information Systems In Hmos: Some Lessons From The Oxford Health Plan, Mary E. O'Byrne
Journal of Law and Health
Given this scale of investment, the centrality of information systems to the success of an HMO, the obligation of regulatory compliance, plus the attention now focused on the year 2000 "millenium bug" problem, information systems are clearly a major area of concern and oversight by corporate directors. This paper analyzes the role of information systems in HMOs and the nature of the HMO directors' duty of care in monitoring the integrity of the information systems to determine when directors may be held personally liable for losses suffered by the corporation when the systems collapse. Section I addresses in general the …

Part II of this article provides a brie explanation of peanut allergies. Part III contains an overview of Title II and Title III of the ADA and their interpretive regulations. Part IV analyzes whether an individual asserting a Title II claim under the ADA, where the relief sought is also available under the Individual with Disabilities Education Act before asserting his or her ADA …
An Analysis Of The Traveler's Dilemma With Experimental Evidence, Eduard A. Pelz
An Analysis Of The Traveler's Dilemma With Experimental Evidence, Eduard A. Pelz
Honors Papers
Game theory studies how people should respond in strategic situations and is naturally used for predictive purposes. The optimal strategy predictions yielded by game theoretic reasoning can be surprising when they conflict with preconceived notions of how to play, i.e. the "common sense" strategy. Consequently, the game theoretically optimal strategy may be a poor predictor of how individuals actually behave in real-life strategic situations. In order to accurately model such situations for predictive purposes it is important to know the limitations of the current game theoretic tools.
In the traveler's dilemma, Kaushik Basu presents a parable to illustrate how game …
A Tale Of Two Proteins, Robert A. Bohrer
A Tale Of Two Proteins, Robert A. Bohrer
Faculty Scholarship
In this article we examine the Orphan Drug Act and one of the most important incentives it provides for the development of new drugs for rare diseases, a seven-year period of market exclusivity for new orphan drugs. The FDA has had difficulty interpreting the market exclusivity provisions of the Orphan Drug Act since its enactment. The continuing uncertainties about the scope of protection that the Act provides for innovative products threaten the basic purposes of the Act. The FDA's recent interpretation of the Act raises numerous questions: Should market protection from the Orphan Drug Act depend on the physical and …

Earth and Environmental Geosciences Faculty Research
The N 1.08-Ga Pikes Peak composite batholith of central Colorado is a type example of an Atype granitic system. From the 1970s through the 1990s, details of the field relations, mineralogy, major and trace element compositions, and isotopic geochemistry of Pikes Peak rocks were documented, and they reveal the existence of two chemical groups, a potassic and a sodic series. The potassic series (~64-78 wt % SiO2) includes the Pikes Peak Granite, which is mostly coarse-grained biotite f hornblende syenogranite and minor monzogranite that dominates the batholith. The potassic series also includes fine- to medium-grained biotite granite found …
