Conflict Resolution And Distributive Justice: Reflections On The Burton-Laue Debate, Richard E. Rubenstein, Frank O. Blechman Nov 1999

Conflict Resolution And Distributive Justice: Reflections On The Burton-Laue Debate, Richard E. Rubenstein, Frank O. Blechman

Peace and Conflict Studies

Excerpt

From its inception, the field of conflict resolution has appealed strongly to practitioners, researchers, and theorists interested in social betterment. Most conflict resolvers would probably agree that their efforts are motivated, at least in part, by the conception of a Good (or at least a Better) Society considerably less violent and contentious, more peaceful and cooperative, than the existing social order. Many would also affirm that in order to reach this goal, the sources of violence and contention, which include cultural norms sanctioning or glorifying violence, invidious and discriminatory "isms" (racism, sexism, etc.), gross socioeconomic and political inequities, and …

We, the editors of this Issue, began by saying that both the concept of conflict resolution and social justice are used in multiple ways. We noted that some forms or definitions of each seemed to exclude the other.

Privacy And Democracy In Cyberspace, Paul M. Schwartz Nov 1999

Privacy And Democracy In Cyberspace, Paul M. Schwartz

Vanderbilt Law Review

In this Article, Professor Schwartz depicts the widespread, silent collection of personal information in cyberspace. At present, it is impossible to know the fate of the personal data that one generates online. Professor Schwartz argues that this state of affairs degrades the health of a deliberative democracy; it cloaks in dark uncertainty the transmutation of Internet activity into personal information that will follow one into other areas and discourage civic participation. This situation also will have a negative impact on individual self- determination by deterring individuals from engaging in the necessary thinking out loud and deliberation with others upon which …

Monitoring Governmental Disposition Of Assets: Fashioning Regulatory Substitutes For Market Controls, Harold J. Krent, Nicholas S. Zeppos Nov 1999

Monitoring Governmental Disposition Of Assets: Fashioning Regulatory Substitutes For Market Controls, Harold J. Krent, Nicholas S. Zeppos

Vanderbilt Law Review

Each year, the government sells and leases public assets worth billions of dollars. FCC auctions to allocate rights to electromagnetic spectrum generated over twenty billion dollars within a three-year period, and proceeds from mineral leases, timber sales, and disposition of real estate from defaulting thrifts have surpassed several billion dollars annually.

From the taxpayer's perspective, however, government sales and leases have been deplorable. The government has donated valuable resources to preferred claimants, allocated scarce broadcast and oil rights resources by lottery, and sold both public land and mineral rights to private parties at a fraction of the market price. Although …

The Predictive Use Of Event-Related Potentials In Language Development And The Treatment Of Language Disorders, Dennis L. Molfese, Victoria J. Molfese, K. A. Espy

Developmental Cognitive Neuroscience Laboratory: Faculty Publications

Attempts to relate what is currently known regarding the brain's involvement in language processing during the early years of life. The authors focus on the event related potential (ERP) as a means to study the neuroelectrical correlates of language in the brains of infants and children. After reviewing general information concerning ERPs and language, this presentation relates how neonatal ERP measures of phonetic discrimination predict later language and reading abilities.

Nebraska Business Forecast Council Expects State's Economic Growth To Fall Below Potential, John Austin, Nebraska Business Forest Council Nov 1999

Nebraska Business Forecast Council Expects State's Economic Growth To Fall Below Potential, John Austin, Nebraska Business Forest Council

Business in Nebraska

The Nebraska Business Forecast Council expects that jobs will continue to grow in Nebraska; but, the rate of job growth will slow as labor markets in Nebraska and surrounding states continue to tighten. Nebraska's total nonfarm jobs will grow just under 2 percent in both 1999 and 2000. Total job growth then will slow to 1.6 percent in 2001 (Figure 1).

In addition to restraining job growth, tight labor markets will exert upward pressure on wages. Moderate job growth, combined with increasing wage rates, will yield moderately rapid growth in wages and salaries. Consequently, total nonfarm personal income will increase …

Exploring Deeper Wisdoms Of Mediation: Notes From The Edge, Margaret S. Herrman Nov 1999

Exploring Deeper Wisdoms Of Mediation: Notes From The Edge, Margaret S. Herrman

Peace and Conflict Studies

Excerpt

Mediation draws many people into the field of conflict resolution with a promise of rewards like an income stream added to an existing professional practice or agreements pulled from the fires of bitterness and frustration. But for Jim Laue there was more. As a consummate mediator, Jim was equally comfortable mediating technically complex regional disputes, potentially explosive community disputes, and emotionally charged interpersonal disputes. His career began years before a well defined field existed. He came to this work as did others of his and the next generation, determined to address issues of social justice. His mediations during the …

A Near-Surface Microstructure Sensor System Used During Toga Coare. Part Ii: Turbulence Measurements, Alexander Soloviev, Roger Lukas, Peter Hacker, H. Schoeberlein, M. Baker, A. Arjannikov

Marine & Environmental Sciences Faculty Articles

New techniques developed for near-surface turbulence measurements during the Tropical Ocean Global Atmosphere (TOGA) Coupled Ocean–Atmosphere Response Experiment (COARE) employ a difference in spatial scales of turbulence and surface waves. According to this approach, high relative speed of the measurements provides separation of the turbulence and surface wave signals. During the TOGA COARE field studies, highresolution probes of pressure, temperature, conductivity, fluctuation velocity, and acceleration were mounted on the bow of the vessel at a 1.7-m depth in an undisturbed region ahead of the moving vessel. The localization in narrow frequency bands of the vibrations of the bow sensors allows …

Historical Case Study Of Stella L. Wood, Bonnie G. Ostlund

Theses and Graduate Projects

The focus of this historical case study is to examine the life of Stella Louise Wood, an educator recognized for her leadership in public kindergarten and teacher training in Minneapolis, Minnesota. She spearheaded the campaign for free public kindergartens in the city in 1896, and was the leader of its teacher training school for the following fifty-two years. In that time, Stella Wood shared her strong commitment to the youngest students and her dynamic spirit with over 2,500 teacher trainees, known as Miss Wood's girls. She lived to approve a merger of her school with Macalester College in St. Paul, …

Illinois V. Perkins, Marty Jaquez Nov 1999

Illinois V. Perkins, Marty Jaquez

San Diego Law Review

In Illinois v. Perkins, the United States Supreme Court held that an undercover police officer need not give Miranda warnings before questioning an incarcerated suspect. In doing so, the Court found that the interests protected by Miranda are not implicated when a suspect does not know the identity of his interrogator. This Note analyzes the Court's reasoning in light of the concerns that motivated the Miranda Court. The analysis reveals that the Perkins reflects the Court's propensity to undermine the Miranda. Unlike other Supreme Court cases creating exceptions to Miranda, Perkins permits deliberate police deception in obtaining an unwarned confession …

Mpeg-4 Systems And Applications, Hari Kalva, Lai-Tee Cheok, Alexandros Eleftheriadis

Research Collection School Of Computing and Information Systems

MPEG-4, under the auspices of the ISO, is specifying tools to enable object-based audio-visual presentations [3]. These include tools to encode individual objects, compose presentations with objects, store these object-based presentations and access these presentations in a distributed manner over networks. The main distinguishing feature of object-based audio-visual presentations is the scene composition at the user terminal. The objects that are part of a scene are composed and displayed at the user end as opposed to encoding the composed scenes as is done in the case of MPEG-2. Such object-based representation and presentation has several benefits including compression efficiency and …

An Assessment Of The Efficacy Of Deep Drains Constructed In The Wheatbelt Of Western Australia Part 1 A Discussion On Drainage Implmentation In The Wheatbelt : A Case Study Review, Summary, Conclusions And Recommendations, N A. Coles, Richard J. George Dr, A D. Bathgate

Bulletins 4000 -

Australia has undertaken a strategic review of current and historical deep drainage projects. A 'rapid appraisal' methodology was utilised, based principally on existing hydrological investigations and interpretation and anecdotal evidence provided by landholders to clarify the role of drainage in managing water in dry land rural landscapes.

The objectives of this discussion paper are to:

1. Review the current status of groundwater drainage practice

2. Provide an assessment of deep drains in the landscape and

3. Propose recommendations on the development of drainage policy to enable the application of best management practice in groundwater drainage.

Attorneys Beware: Obtaining Credit Reports On Opposing Party May Lead To Punitive Damages, Matthew S. Criscimagna Nov 1999

Attorneys Beware: Obtaining Credit Reports On Opposing Party May Lead To Punitive Damages, Matthew S. Criscimagna

Missouri Law Review

Knowledge is power, and a credit report is a great way to obtain knowledge. An attorney could gain useful information from a credit report when preparing for litigation, especially in determining who to sue or whether to sue. However, under the Fair Credit Reporting Act ("ECRA" or "Act"), an attorney may face punitive damages if he or she uses a credit report in a manner that is not authorized by the FCRA. This is exactly what happened to an Arkansas attorney who, while aggressively representing her clients, obtained credit reports on the opposing party. She could have avoided the imposed …

Common Law Misappropriation In The Digital Era, Dale P. Olson Nov 1999

Common Law Misappropriation In The Digital Era, Dale P. Olson

Missouri Law Review

Information is often valuable and when publicly disclosed may be difficult to protect or control.' Such information, whether in the form of data or a product configuration, unless it can be exploited while keeping it secret,2 is accordingly susceptible to copying by competitors absent legal protection. The law, however, has not provided a framework that supplements the armamentarium of federal intellectual property law3 because the protection authorized by federal constitutional limits also thrust works into the public domain. The evolving technological developments which permit the effectively instantaneous transmission of information, as well as the inexpensive copying of trade values in …

Clean Water Act Compliance Audit Program For Pork Producers: How Was Such An Agreement Between Epa And The National Pork Producers Reached , Anita K. Chancey

Missouri Law Review

A recent agreement between the Environmental Protection Agency and the National Pork Producers Council puts into place a voluntary inspection program that may lead to reduced fines for pork producers who report and correct Clean Water Act violations This agreement represents the first of its kind between an agriculture group and the Environmental Protection Agency.2 This Article explores the background that led to the agreement. The evolution from small family farming to large corporate livestock production, along with the environmental concerns such evolution has produced, is traced. The next section lays out some of the federal and state statutory and …
