Digital Millennium Copyright Act And Protecting Individual Creative Rights: A Proposal For On-Line Copyright Arbitration, Susan Hong Jan 1999

Digital Millennium Copyright Act And Protecting Individual Creative Rights: A Proposal For On-Line Copyright Arbitration, Susan Hong

Cardozo Journal of Conflict Resolution

This Note argues that even though the DMCA may protect the ISPs from unwarranted copyright liability, it tilts the balance of interests between the individual creator and the ISP too far in favor of the ISP by granting them almost unbridled and arbitrary discretion to eliminate and take down allegedly infringing copyrighted work. As a result, the DMCA undermines the objective of promoting independently created works by legitimate authors. The DMCA essentially allows the ISPs to act as their own on-line copyright judges and take down creative works that are merely alleged to be infringing, but not infringing in fact …

Report Of The Grains Working Group (Rice, Sorghum And Wheat), Donna Mitten Jan 1999

Report Of The Grains Working Group (Rice, Sorghum And Wheat), Donna Mitten

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The grains working group identified three crops which have sexually compatible weedy relatives likely to be subject to gene flow in US agricultural systems (Table 1). The ease of cross pollination and the successful production of a fertile hybrid vary with each case. If the selective advantage of an introduced trait is positive, however, introgression of the new trait into an existing weed population is possible. The risk of ecological harm is then dependent upon the habitat of the weed. In the crop-weed complexes considered here, in which the habitat of the weedy relative is limited to agricultural systems, the …

Signifying Nothing?: Martin Ritt's The Sound And The Fury (1959) As Deconstructive Adaptation, Walter C. Metz

Publications

This essay defends Martin Ritt's film version of The Sound and the Fury (1959), starring Yul Brynner as a Cajun Jason Compson, traditionally positioned as one of the most ill-conceived film adaptations ever made, by highlighting how an academic modernist reading of the works of William Faulkner overwrites the intriguing possibilities of melodrama.

Enterprise Business Objects : Design And Implementation Of A Business Object Framework, Kai-Uwe Schafer Jan 1999

Enterprise Business Objects : Design And Implementation Of A Business Object Framework, Kai-Uwe Schafer

Theses

Software components representing business entities like customer or purchase order introduce a new way of Online Transaction Processing to business applications. Collaborating business objects allow to complete whole business processes as a single distributed transaction, instead of dividing it into queued steps, which sometimes even require user intervention. This IS due to the fact that business objects contain both business data and logic and that they incorporate multiple databases from different vendors and different geographic locations in a single transaction.

Business objects cannot be used as stand-alone components, but require a framework of services that manage persistence, concurrent transactions, and …

Extraction And Characterisation Of Essential Oils From Waste Eucalyptus Foliage, Hugh O'Reilly Jan 1999

Extraction And Characterisation Of Essential Oils From Waste Eucalyptus Foliage, Hugh O'Reilly

Theses

Extraction procedures such as steam distillation, solvent and soxhlet extraction have been investigated to determine the most effective method of extracting essential oil from the foliage of a number of species of Eucalyptus cultivated in Co. Kerry. Steam distillation has been found to be the most effective method of extraction. The steam distillation extraction method has been thoroughly studied in order to determine the factors affecting yield and composition of the distillate. Alteration of the distillation time has been found to produce oil high in 1,8-cineole content, a requirement of medicinal quality oil. The choice of individual distillation still used …

Computer Based Methodologies For On-Line Scanning Force Microscopic Detection Of Immunological Binding Events, Patrick Joseph O'Mahony Jan 1999

Computer Based Methodologies For On-Line Scanning Force Microscopic Detection Of Immunological Binding Events, Patrick Joseph O'Mahony

Theses

The overall aim of this work was to develop computer based methodologies for the on-line scanning force microscopic detection of immunological binding events. To achieve this aim it was necessary to develop a rapid, high-resolution data acquisition system to digitise scanning force microscope (SFM) data on-line and then to develop an effective method for extracting the scanner induced background curvature from this data to reveal the nanoscale height binding events. Four techniques were investigated in terms of operational speed and performance accuracy; namely, polynomial interpolation; least squares approximation; real-time recursive least squares approximation; and wavelet approximation.

It was found that …

The Relationship Between Percent Deficit Ideal Body Weight And The Prevalence, Severity, And Healing Of Pressure Ulcers, Cheryl Anne Masters Jan 1999

The Relationship Between Percent Deficit Ideal Body Weight And The Prevalence, Severity, And Healing Of Pressure Ulcers, Cheryl Anne Masters

UNF Graduate Theses and Dissertations

This retrospective study determined whether percent deficit ideal body weight (IBW) was a risk factor for the prevalence, severity or healing of pressure ulcers. This study hypothesized that nursing home residents below their IBW with pressure ulcers have more severe, higher prevalence, and a slower healing rate than resident who are above their IBW. Medical record data were analyzed for all subjects that met the selection criteria from April, 1997 to April, 1998. Fifty-eight subjects aged 39 to 104 years were assigned to one of two groups (Group 1(n=28) were less than 99% of IBW; Group 2 (n=30) were greater …

North Dakota Needs And Feasibility Assessment For A Statewide Family-To-Family Network, Laurie Betting Jan 1999

North Dakota Needs And Feasibility Assessment For A Statewide Family-To-Family Network, Laurie Betting

Physical Therapy Scholarly Projects

The purpose of this study was to determine the need and feasibility of a family-to-family network within the state of North Dakota. The model for this family support network would include a process of matching experienced or "veteran" parents or a family member who has a child with a disability with parents or other family members who are just beginning to meet the challenge of a disability within the family.

The research was designed to determine priorities of families with children with disabilities as well as effective methods of recruitment, referral, and training. Furthermore, the research identified agencies and programs …

The Effects Of Balance Retraining Exercises On The Neurocom Balance Master® In Subjects With Multiple Sclerosis, Becky Coy Jan 1999

The Effects Of Balance Retraining Exercises On The Neurocom Balance Master® In Subjects With Multiple Sclerosis, Becky Coy

Physical Therapy Scholarly Projects

Multiple sclerosis (MS) is the most common demyelinating disease of the central nervous system (CNS) and is becoming an increasing concern for individuals between the ages of 15 to 50. Multiple sclerosis is a chronic, often progressive disease that may result in difficulties with vision, verbal communication, sensation, bowel and bladder function, balance, and ambulation.

The purpose of this study was to determine if significant changes occurred in static steadiness, symmetry, and dynamic stability in subjects with MS following a retraining program using the NeuroCom Balance Master® (NBM®). Ten subjects (6 females, 4 males) were placed in a control or …

A Comparison Of The Maximal Torque Production Of The Quadriceps Muscle During Morning And Afternoon Strength Assessment, Shawn Dockter Jan 1999

A Comparison Of The Maximal Torque Production Of The Quadriceps Muscle During Morning And Afternoon Strength Assessment, Shawn Dockter

Physical Therapy Scholarly Projects

The purpose of this study was to compare maximal quadriceps torque production between morning (AM) and afternoon (PM) hours. Thirty healthy male subjects between the ages of 21 and 43 were tested during an AM and PM session on the Kin-Com dynamometer. Six concentric isokinetic contractions of the right quadriceps were tested at a speed of 60° Is. The maximal peak torque measurements were compared between the AM and PM sessions to establish the validity of results taken at differing times of day. No significant difference in strength assessment due to time of day was found. The data collected in …

Stroke Rehabilitation: A Case Study, Darrin Goyn Jan 1999

Stroke Rehabilitation: A Case Study, Darrin Goyn

Physical Therapy Scholarly Projects

Stroke is the largest single cause of neurologic crippling in the United States, with approximately 550 000 Americans having a new or recurrent stroke each year. The costs associated with strokes are estimated at $30 billion annually. Due to the continuing decline of the health care dollar, stroke rehabilitation units must be designed to reduce functional limitations and disabilities in both a timely and cost effective manner.

The goals of stroke rehabilitation are to reduce functional limitations, prevent complications, educate the patient and family, and improve the patient's quality of life. A proper rehabilitation setting and active participation by the …

Holistic Medicine: Therapeutic Touch And Implications For Physical Therapy, Lea Hoff Jan 1999

Holistic Medicine: Therapeutic Touch And Implications For Physical Therapy, Lea Hoff

Physical Therapy Scholarly Projects

Alternative therapies and holistic medicine have been gaining popularity recently. It is important that health care providers have a general knowledge of holistic medicine and some of the approaches being used. Being informed will help health care providers make wise treatment choices.

Therapeutic touch (TI) is a holistic treatment approach which claims to induce physiologic effects through modulating the "human energy field ." Proponents of TI claim that healing is facilitated through conscious intent of practitioners to help the patient and rebalance the patient's energy field. TI research findings are controversial. Much of the research is based on qualitative data, …
