State Regulation Of Federal Prosecutors: The Impact On Contact With Represented Persons In Virginia, Robert H. Burger Jan 1999

State Regulation Of Federal Prosecutors: The Impact On Contact With Represented Persons In Virginia, Robert H. Burger

Richmond Journal of Law and the Public Interest

The first section of this paper analyzes the ethics rule promulgated by the Department of Justice. The DOJ rule governs those circumstances in which federal prosecutors may communicate with individuals known to be represented by counsel, without the consent of such counsel. The second and third sections of this paper discuss the judicial and statutory rejection of the DOJ rule respectively. First, in O'Keefe v. McDonnell Douglas," the U.S. Court of Appeals for the Eighth Circuit reasoned that the DOJ lacked authority to promulgate their ethics rule. As a result of this conclusion, the Eighth Circuit held the DOJ rule …

Women In The New Millennium: The Promises Of The Past Are Now The Problems For The Millennium, Lundy Langston Jan 1999

Women In The New Millennium: The Promises Of The Past Are Now The Problems For The Millennium, Lundy Langston

Journal Publications

In this Article, I will explore the roles of women and the expectations that society maintains for them in the past and the expectations for the present and future. As we enter the millennium, the courts appear to administer the law in the same way as laws were administered prior to the women's rights movement. Judges appear to implement notions of equal rights while society attaches the notions of the "difference group" without any special treatment for the dual roles. Something interesting appears to be happening to the dual roles of women. There is one standard stating that women must …

On Protecting Accountability, Eric M. Freedman Jan 1999

On Protecting Accountability, Eric M. Freedman

Hofstra Law Review

Today's subject, whether a sitting President may be indicted, is one that I have addressed in print over many years, dating back to the Nixon Administration. In particular, I am the author of The Law as King and the King as Law: Is a President Immune from Criminal Prosecution Before Impeachment?' which I believe remains the most complete and thoroughly-documented scholarly study of the issue. Since it contains a good deal of additional legal and historical data backing up the principal points I will be making, I hope you will read it in full (or at least refer to its …

Demonstration Of Tritrichomonas Foetus In The External Genitalia And Of Specific Antibodies In Preputial Secretions Of Naturally Infected Bulls, J. C. Rhyan, K. L. Wilson, B. Wagner, M. L. Anderson, R. H. Bondurant, D. E. Burgess, G. K. Mutwiri, L. B. Corbeil

United States Department of Agriculture Wildlife Services: Staff Publications

Portions of penis and prepuce were collected from 24 bulls with current or recent Tritrichomonas foetus infection. Epididymides were collected from seven of the bulls, and seminal vesicles and prostate were collected from four. Following immunohistochemical staining with two monoclonal antibodies (34.7C4.4 and TF1.15) prepared against T. foetus surface antigens, trichomonads were identified in sections from 15 of the bulls. Organisms were most often located in penile crypts in the midshaft and caudal regions and less often in preputial crypts. Trichomonads were not observed in sections from other genitalia or in subepithelial tissue. T. foetus antigen, however, was present in …

The Future Of Genocide: A Spectacle For The New Millenium?, David M. Smolin Jan 1999

The Future Of Genocide: A Spectacle For The New Millenium?, David M. Smolin

Fordham International Law Journal

The lines between bearing witness and producing entertainment, between genuine outrage and self-righteous apathy can be initially difficult to discern. Such differences lie in the difficult areas of ethics, religion, and the hidden recesses of the human heart. Nonetheless, over thousands of years various world religions have sought to come to terms with the deepest questions pertaining to intention, action, and ethics, and particularly with the manner in which human beings are trained in ways of life or death. This Essay shall include some specifically Christian theological perspectives on the dilemmas that draw us toward the specter of genocide as …

Competition Law And Regulation Law From An Ec Perspective, John Temple Lang Jan 1999

Competition Law And Regulation Law From An Ec Perspective, John Temple Lang

Fordham International Law Journal

These comments look at the subject from a legal viewpoint, in contrast to the Essay by Professor Dr. Günter Knieps, which uses an economic approach. His Essay raises several issues concerning access: (1) who should be obliged to give it; (2) to whom; (3) in what circumstances; and (4) on what terms? In practice, the precise answers will depend on whether European Community (“Community” or “EC”) competition law, national competition law, or national telecommunications law based on Community directives, are being applied. As far as possible, the same answer should be given in all cases.

A Psychosocial Support System For Seventh-Day Adventist Pastors In West Indonesia, Edison Pandjaitan Jan 1999

A Psychosocial Support System For Seventh-Day Adventist Pastors In West Indonesia, Edison Pandjaitan

Doctor of Ministry Projects

Problem The adjustment that many SDA Indonesian pastors go through in the early years of their ministry and the feeling on the part of some ministers that they lack essential psychosocial support suggest the importance of designing a systematic support system. Therefore the dissertation addresses the following questions: (1) How do SDA pastors in the West Indonesia Union indicate their need of a support system? (2) What resources are available to meet the needs of Indonesian pastors? (3) What can the minister, the local church, and the hiring organization do to strengthen this support system?

Method The project is descriptive-prescriptive. …

A Christian Approach To Traditional Male Circumcision Customs In Malawi, Harry Godfrey Mtike Jan 1999

A Christian Approach To Traditional Male Circumcision Customs In Malawi, Harry Godfrey Mtike

Doctor of Ministry Projects

Problem

The Lorn we and Yao tribes in Malawi practice traditional male circumcision rituals which are damaging the Malawian society. While these rituals have value and fill key functions in society, they are at the same time troublesome. The lack of proper medical equipment and training in performing actual circumcision, as well as accompanying teachings which encourage sexual promiscuity, makes these ceremonies physically, spiritually, and morally dangerous. The AIDS epidemic in Malawi can also be partly traced to these rituals. This study seeks to find a Christian answer which preserves the value of these practices while avoiding the problems connected …

Creative Bible Teaching For Seventh-Day Adventist Youth Ages 13-18, Michael Kwaku Owusu Jan 1999

Creative Bible Teaching For Seventh-Day Adventist Youth Ages 13-18, Michael Kwaku Owusu

Doctor of Ministry Projects

Problem

Studies regarding how adolescents learn have found that the traditional approach of teaching as information or knowledge to be passed on with an emphasis on the mastery of content is not very effective. In view of this, many Christian educators and youth ministry specialists recommend a shift from the traditional methods of teaching the Bible to creative ways of teaching with a focus on active student participation in the teaching-learning process, and on meaning of Bible truths.

Method

The method used to complete this project was a review of representative literature dealing with theories and concepts of teaching and …

Equipping Laity For Ministry In Multi-Church Districts In Brazil, Paulo Cesar Nogueira Jan 1999

Equipping Laity For Ministry In Multi-Church Districts In Brazil, Paulo Cesar Nogueira

Doctor of Ministry Projects

Problem

Most church districts in Brazil are comprised of many churches and companies. The average load of pastoral care is one pastor for seven congregations. In addition, members have high expectations their pastors and both lack a clear understanding of the role of lay ministry. Thus pastors feel a heavy work load.

Method

A survey of biblical insights, current literature, and other studies on the priesthood of all believers, lay ministry, and effective pastoral work was undertaken. A program designed to enhance pastoral work in multi-church districts in Brazil was developed.

Results

The concept of the priesthood of all believers …

The Courage Of Our Convictions, Sherman J. Clark Jan 1999

The Courage Of Our Convictions, Sherman J. Clark

Michigan Law Review

This article argues that criminal trial juries perform an important but inadequately appreciated social function. I suggest that jury trials serve as a means through which we as a community take responsibility for - own up to - inherently problematic judgments regarding the blameworthiness or culpability of our fellow citizens. This is distinct from saying that jury trials are a method of making judgments about culpability. They are that; but they are also a means through which we confront our own agency in those judgments. The jury is an institution through which we as individuals take a turn acknowledging and …
