A Comparison Of Networked Data Acquisition Devices And Their Capabilities, Jon H. Anderson Jan 1999

A Comparison Of Networked Data Acquisition Devices And Their Capabilities, Jon H. Anderson

Graduate Research Papers

The invention and extensive usage of digital electronics, microprocessors, and communication networks has resulted in significant changes to the process of gathering information. One indication of this is the popularity of the Internet, or aptly named information highway. Another indication is the increased availability of low cost equipment to gather, process, and transfer data (Masi, 1999). The measurement professional now has a large variety of hardware, software, and communication protocols from which to choose to best fit an application. These applications may require the use of a networked data acquisition device. This study was prompted by the need to evaluate …

It provides some concrete suggestions on how law schools can enhance learning. It is a good primer for ASP professionals because it points out the various factors that can hinder students' learning or academic performance.

Colonialism And Modern Constructions Of Race: A Preliminary Inquiry, Tayyab Mahmud Jan 1999

Colonialism And Modern Constructions Of Race: A Preliminary Inquiry, Tayyab Mahmud

Faculty Articles

This article aims at an examination of the colonial career of the modern construction of race and its traces in post-coloniality. It locates race in regimes of legality and illegality attendant to British colonial rule over India to underscore the defining role of colonialism in modern constructions of race. The first part recounts the modern grammar of racial difference rooted in the colonial encounter between modern Europe and its colonies. The second part identifies three specific sites of deployment of colonial racial stereotypes in colonial India, namely, "martial races," "criminal tribes," and indentured labor. The last part traces the shadow …

America's Preoccupation With Ethics In Government Essay., Vincent R. Johnson Jan 1999

America's Preoccupation With Ethics In Government Essay., Vincent R. Johnson

St. Mary's Law Journal

Many Americans today expect that the law can, should, and will be used to ensure a level playing field in public life. Americans expect the law to eliminate, insofar as possible, any unfair advantage that might be gained through the use of special connections to those who exercise the power of government. There are numerous rules applicable to judges, lawyers, and public officials that each seek to promote equal treatment for all persons by limiting the ability of persons to use special connections and privileged relationships to gain an advantage in public affairs. There were two threads of development in …

From Little Acorns Great Oaks Grow: The Constitutionality Of Protecting Minors From Harmful Internet Material In Public Libraries Comment., Kimberly S. Keller

St. Mary's Law Journal

Congress should focus on the receiver's end of Internet transmissions to overcome the anonymity and transmogrification elements of the Internet to protect minors from harmful material. Throughout the years, librarians have struggled with monitoring minors’ access to the accumulating number of controversial texts in the library. The Internet’s unique infrastructure affords librarians virtually no opportunity for the pre-shelf review available with books and videos. Congress enacted the Communications Decency Act (CDA) in 1996 in an attempt to protect minors from the underbelly of the internet. The United States Supreme Court, in Reno v. ACLU, struck down the CDA ruling that …

Barbarians At The Gates? A Reply To The Critics Of The Victims' Rights Amendment, Paul G. Cassell Jan 1999

Barbarians At The Gates? A Reply To The Critics Of The Victims' Rights Amendment, Paul G. Cassell

Utah Law Review

Until we have further analysis of the data, lack of firm proof that Payne increased the number of death penalty convictions should count heavily against Professor Bandes and others who argue against admitting victim impact statements because of their effects on juries.31 9 Allowing surviving family members to make impact statements clearly improves the perceived fairness of the process32° and we have no proof that juries have been influenced, let alone unfairly influenced.

First Amendment Imperialisn, Daniel J.H. Greenwood Jan 1999

First Amendment Imperialisn, Daniel J.H. Greenwood

Utah Law Review

In a society that has become suspicious of politics and a legal culture that tends to view political struggle as simply an unprincipled, unprofessional and sloppy version of courtroom procedure, the First Amendment principle of abstention has expanded beyond a program of making politics safe to become a primary vehicle in a post-New Deal attempt to reduce the scope of conscious collective control over the market. The First Amendment, understood in this way as a fundamental limitation on the scope of government, has become the locus of a new Lochnerism-or rather, a revival of the old Lochnerism under a new …

"Fair" Value-The Utah Supreme Court Appraises Fair Value For Minority Shareholders Under The Appraisal Remedy: Oakridge Energy, Inc. V. Clifton, Randall Larsen Jan 1999

"Fair" Value-The Utah Supreme Court Appraises Fair Value For Minority Shareholders Under The Appraisal Remedy: Oakridge Energy, Inc. V. Clifton, Randall Larsen

Utah Law Review

The Utah Supreme Court's decision in Oakridge Energy, Inc. v. Clifton represents a case of first impression under Utah's appraisal remedy. The appraisal remedy grants minority shareholders the right to dissent from unfair transactions mandated by the majority. However, Oakridge Energy sets a difficult precedent for minority shareholders to overcome in order to receive this protection. The Utah Supreme Court ignores modem appraisal remedy precedents, fails to recognize the unique structures of various corporations, and implicitly limits Utah's appraisal remedy to an outdated Delaware standard (a standard overruled in Delaware in 1983). Ultimately, the Oakridge Energy decision fails to recognize …

School-To-Work : What Does This Mean For Our Schools?, Amy K. Leonhart Jan 1999

School-To-Work : What Does This Mean For Our Schools?, Amy K. Leonhart

Graduate Research Papers

Over the course of fifty years the academic content of schools has changed dramatically. Today, employers are looking for different skills from their employees than they were in the 1950s. Therefore, schools have been given the assignment to teach young adults about surviving in the work force.

Where do these skills fit into the schools' curriculum? Is this just another item that is added to the plate of teachers? What time is the "right" time to start teaching these critical skills to youngsters? This paper examines those questions. It also focuses on the different aspects of the school-to-work initiative.

Creating A Purposeful, Powerful Web Site For The Cedar Falls Historical Society, Douglas B. Moore Jan 1999

Creating A Purposeful, Powerful Web Site For The Cedar Falls Historical Society, Douglas B. Moore

Graduate Research Papers

With communication becoming more instantaneous then ever, one fear is losing the message in the medium. Creating the web site for the Cedar Falls Historical Society was much more than giving the Historical Society a presence on the World Wide Web. It was extremely important that the Cedar Falls Historical Society web site promote the true intentions of the Historical Society with integrity and dignity. Many times, when web sites are developed, the technology overshadows the content. The Board of Directors of the Historical Society insisted their site be built with both professionalism and historical accuracy.

The Society members took …

State-Wide Training Sessions For County Office Personnel Using The Blue Ribbon Data Management System, Rebecca L. Nibe Jan 1999

State-Wide Training Sessions For County Office Personnel Using The Blue Ribbon Data Management System, Rebecca L. Nibe

Graduate Research Papers

A statewide training initiative was necessitated by the upgrade of the statistical database management program required by the State 4-H Office. The upgrade was released in the fall of 1998, but was flawed and buggy, resulting in much frustration among users. Additionally, I was the newly-hired State Support Specialist, and had not established any credibility with the users I was hired to support. The Associate State Director and I decided that an ambitious early spring training program would be beneficial to all parties involved.

I believe that this project was both a personal and a professional success. I was able …

The Teaching Of Digital Vs. Traditional Photography, Carolyn Prins Jan 1999

The Teaching Of Digital Vs. Traditional Photography, Carolyn Prins

Graduate Research Papers

I have been teaching photography in the traditional sense for over fifteen years. I have seen photography shift in those years from a silver-based medium to encompass the digital world, a filmless kind of art. The two media are very different, and the teaching of them are correspondingly different, yet the end result should be the same: a student who can produce an image that is visually satisfying, whether the image is informative in nature or is considered fine art. In this project, I want to compare instructional strategies for traditional photography tools to teaching strategies for digital photography.
