Victim Standing, Susan Bandes Jan 1999

Victim Standing, Susan Bandes

Utah Law Review

The most cynical conclusion regarding the judicial role in protecting victims' interests is that, for standing purposes, the only collective interest cognizable is the government's own definition of its own interests, which it buttresses when necessary by claiming to represent victims or society as a whole. There are less cynical conclusions as well. Federalism, separation of powers, and prosecutorial discretion all play important and legitimate roles, when properly defined and limited. We can debate what those limits ought to be. For the purposes of this conference, however, the question is not so much the judicial role, or even the prosecutorial …

Revisiting Victim's Rights, Lynne Henderson Jan 1999

Revisiting Victim's Rights, Lynne Henderson

Utah Law Review

In a 1982 referendum, the voters of California approved Proposition 8-the first state "victim's rights" amendment-revising a number, of provisions of the California Constitution. I wrote The Wrongs of Victim's Rights in response to that referendum and the Reagan Administration's Task Force on Victims of Crime Final Report. At the time I wrote the article, I had recently been a victim of a violent rape committed by a burglar; I had had two friends murdered in separate killings; and I knew others who had had family members killed, as well as many friends who were victims of other crimes. I …

Fragmenting The Copyleft Movement. The Public Wll Not Prevail, Teresa Hill Jan 1999

Fragmenting The Copyleft Movement. The Public Wll Not Prevail, Teresa Hill

Utah Law Review

Copyright protection has been applied to computer software since 1976, when Congress amended the federal copyright statutes. Since then, legal scholars and computer experts have criticized the compatibility of copyright, designed to protect traditional forms of authored works, and its expansion into new technologies. These criticisms are bolstered by courts' contradictory application of even the most basic copyright principles to computer software. Such uncertainty arguably impedes innovation in computer software.

Predictive Head Tracking For Virtual Reality, Donald C. Wunsch, Emad W. Saad, T. P. Caudell Jan 1999

Predictive Head Tracking For Virtual Reality, Donald C. Wunsch, Emad W. Saad, T. P. Caudell

Electrical and Computer Engineering Faculty Research & Creative Works

In virtual reality (VR), head movement is tracked through inertial and optical sensors. Computation and communication times result in delays between measurements and updating of the new frame in the head mounted display(HMD). These delays result in problems, including motion sickness. We use recurrent and time delay neural networks to predict the head location and use it to calculate the new frame. A predictability analysis is used in designing the prediction system

Double-Talk Robust Fast Converging Algorithms For Network Echo Cancellation, T. Gansler, Steven L. Grant, J. Benesty, M. M. Sondhi Jan 1999

Double-Talk Robust Fast Converging Algorithms For Network Echo Cancellation, T. Gansler, Steven L. Grant, J. Benesty, M. M. Sondhi

Electrical and Computer Engineering Faculty Research & Creative Works

Echo cancelers which cover longer impulse responses (greater than or equal to 64 ms) are desirable. Long responses create a need for more rapidly converging algorithms in order to meet the specifications for network echo cancelers devised by the ITU (International Telecommunication Union). In general, faster convergence implies a higher sensitivity to near-end disturbances, especially "double-talk". Recently, a fast converging algorithm called proportionate NLMS (normalized least mean squares) algorithm (PNLMS) has been proposed. This algorithm exploits the sparseness of the echo path. In this paper we propose a method for making the PNLMS algorithm more robust against double-talk. The slower …

Electrical and Computer Engineering Faculty Research & Creative Works

This paper investigates integrating power engineering material over the breadth of an electrical engineering curriculum. Electrical engineering curricula have a large number of required courses and many subareas for students to study. By introducing power concepts in a variety of courses, students may be motivated to take additional courses in the power area and are better prepared for the diverse background which will be required of them as practising power engineers. The important interrelationships between subareas of electrical engineering are better understood by students when cross discipline applications are discussed. This paper describes the introduction of power concepts and applications …

Speaker Identification Using A Combination Of Different Parameters As Feature Inputs To An Artificial Neural Network Classifier, Viresh Moonasar, Ganesh K. Venayagamoorthy

Electrical and Computer Engineering Faculty Research & Creative Works

This paper presents a technique using artificial neural networks (ANNs) for speaker identification that results in a better success rate compared to other techniques. The technique used in this paper uses both power spectral densities (PSDs) and linear prediction coefficients (LPCs) as feature inputs to a self organizing feature map to achieve a better identification performance. Results for speaker identification with different methods are presented and compared.

Functional Interdependence And Product Similarity Based On Customer Needs, Daniel A. Mcadams, Robert B. Stone, Kristin L. Wood Jan 1999

Functional Interdependence And Product Similarity Based On Customer Needs, Daniel A. Mcadams, Robert B. Stone, Kristin L. Wood

Mechanical and Aerospace Engineering Faculty Research & Creative Works

In this paper, related product functions are determined for a group of approximately 70 consumer products. Using customer need data, a new matrix approach is introduced to identify these relationships. Techniques are then created for determining product similarity. These techniques are clarified and validated through three case studies, including beverage brewers and material-removal products. The results of these case studies are argued to have significant impact on design-by-analogy procedures, benchmarking methods, mass customization strategies and modular design. The paper concludes with a discussion of applications and related procedures for product development.

Exploiting Expertise Through Knowledge Networks, Michael N. Huhns, Larry M. Stevens Jan 1999

Exploiting Expertise Through Knowledge Networks, Michael N. Huhns, Larry M. Stevens

Faculty Publications

The paper discusses the necessary capabilities of knowledge networks: categorizing (the ability to classify Web pages and other unstructured data automatically); hyperlinking (the ability to add to each item of information appropriate pointers to other relevant items of information); alerting (the automatic notification of users and agents to new information that might be of interest to them); and profiling (the construction of models of users and agents to describe their interests and expertise).

Benevolent Agents, Michael N. Huhns, Abdulla Mohamed Jan 1999

Benevolent Agents, Michael N. Huhns, Abdulla Mohamed

Faculty Publications

Some agents roaming the Web these days are benevolent-for example, they may clean up stalled or failed database transactions, or share query results that may have cost substantial resources to acquire and might consume more to share. The Agent Behavior Testbed is a tool for studying the economics of agent altruism. As more agents hit the Internet, benevolence and cooperation will help with overall efficiency and productivity. The paper discusses benevolent agents on the Web.

Networking Embedded Agents, Michael N. Huhns Jan 1999

Networking Embedded Agents, Michael N. Huhns

Faculty Publications

Most of us will soon be managing an intranet in our homes, though we might not realize it. We might also be surprised at the devices that will be networked together. Just about every electrical device now contains one or more microprocessors. Designers typically find this a cost-effective way to provide device functionality, even when much of a processor's power is unnecessary or unused. For example, my coffee maker contains a processor, even though the appliance needn't be very smart and wastes most of its CPU cycles. Nevertheless, it is cheaper to include a general-purpose microprocessor than to incorporate custom …

Article Extract:

You've just helped a mid-sized company, Allwell Corp., to reach a settlement in an action brought by a disgruntled former employee. The CEO turns to you and says, "Even though I still believe that we didn't do anything wrong, I'm glad this lawsuit is over. I can't believe how much money and time we've wasted in defending ourselves. Now, how can we keep this from happening in the future? I've been reading about companies putting arbitration clauses in all kinds of contracts. I want to know whether we can require our employees to arbitrate and maybe even require …

Caution! Estoppel Ahead: Cleveland V. Policy Management Systems Corporation, Lawrence B. Solum Jan 1999

Caution! Estoppel Ahead: Cleveland V. Policy Management Systems Corporation, Lawrence B. Solum

Faculty Scholarship

The aim of this Commentary is not to argue for a particular resolution of the dispute between Ms. Cleveland and her former employer. Rather, the goal is to address a more general question: Is the Cleveland case an appropriate vehicle for the Supreme Court to endorse the seldom invoked and controversial doctrine of judicial estoppel? That doctrine originated in the needs of a procedural system that was substantially different from the contemporary system, which is shaped by the Federal Rules of Civil Procedure and the Federal Rules of Evidence. Contemporary understandings of the respective role of judge and jury and …

Adaptive Resource Management Via Modular Feedback Control, Ashvin Goel, David Steere, Calton Pu, Jonathan Walpole Jan 1999

Adaptive Resource Management Via Modular Feedback Control, Ashvin Goel, David Steere, Calton Pu, Jonathan Walpole

Computer Science Faculty Publications and Presentations

A key feature of tomorrow’s operating systems and runtime environments is their ability to adapt. Current state of the art uses an ad-hoc approach to building adaptive software, resulting in systems that can be complex, unpredictable and brittle. We advocate a modular and methodical approach for building adaptive system software based on feedback control. The use of feedback allows a system to automatically adapt to dynamically varying environments and loads, and allows the system designer to utilize the substantial body of knowledge in other engineering disciplines for building adaptive systems. We have developed a toolkit called SWiFT that embodies this …

Nastygram Federalism: A Look At Federal Self-Audit Policy, David N. Cassuto Jan 1999

Nastygram Federalism: A Look At Federal Self-Audit Policy, David N. Cassuto

Elisabeth Haub School of Law Faculty Publications

This Article examines the evolution of EPA's audit policy, explores the reasons for states' dissatisfaction with it, and then discusses whether the federal policy should have been issued as a rule under the Administrative Procedure Act (APA). Part I examines the evolution of the federal audit policy and then analyzes the strengths and weaknesses of the policy in its current form. Part II explores various types of evidentiary privilege and looks at the arguments for and against extending the privilege to audit reports. It then offers a similar analysis of the case for limited immunity, concluding that neither an expanded …

The National Association Of Honest Lawyers: An Essay On Honesty, "Lawyer Honesty" And Public Trust In The Legal System, John A. Humbach Jan 1999

The National Association Of Honest Lawyers: An Essay On Honesty, "Lawyer Honesty" And Public Trust In The Legal System, John A. Humbach

Elisabeth Haub School of Law Faculty Publications

The growing public disquiet about lawyer ethics is not mainly because people think lawyers neglect their professional standards. Rather, the main problem is the belief among lawyers that the duty of loyalty to clients requires a lawyer to mislead. Specifically, the ethical duty of confidentiality and the ethical duty of zealous advocacy are interpreted together to mean that lawyers must conceal some facts (‘confidentiality‘) while forcefully asserting others. This mis-coupling of these two key ethical duties has an inevitable tendency to produce a kind of partial-truth advocacy in which the lawyer knowingly distracts attention from the truth and fosters misconceptions …

Grassroots Regionalism Through Intermunicipal Land Use Compacts, John R. Nolon Jan 1999

Grassroots Regionalism Through Intermunicipal Land Use Compacts, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

The question raised by this article is whether these statutes and this experience provide an opportunity to develop an effective regional approach fitted to the great diversity of New York's regions. It examines first the role local governments play in determining land use and then the statutes that authorize municipalities to cooperate with respect to land use planning and control. The article traces the use of this authority through two phases of evolution revealing ever more complex and potentially effective intermunicipal strategies. It ends with some thoughts as to how the state government could facilitate effective regional processes by providing …
