Effective Assistance: Reconceiving The Role Of The Chief Public Defender, Kim A. Taylor-Thompson Jan 1999

Effective Assistance: Reconceiving The Role Of The Chief Public Defender, Kim A. Taylor-Thompson

Faculty Articles

In recent years, scholars have raised critical questions about the role of public defenders. Some have critiqued the ways that defender offices function, and even openly questioned their continuing need. Still others have examined the visions of defender offices, suggesting that more coherence in their missions might ultimately serve their clients better in the future. But for all their variety, most have presumed that the compelling issues occur in the direct representation of clients. In limiting their sphere of analysis, though, they have ignored fundamental questions about an individual who centrally affects the offices' external policies and internal operations: the …

Collaboration Between Lawyers And Social Workers: Re-Examining The Nature And Potential Of The Relationship, Paula Galowitz Jan 1999

Collaboration Between Lawyers And Social Workers: Re-Examining The Nature And Potential Of The Relationship, Paula Galowitz

Faculty Articles

The impetus for this Article was a case handled this past year by the Civil Legal Services Clinic which I teach at New York University Law School. In the clinic, third-year students represent clients in a variety of cases, including housing, government benefits, immigration, guardianship planning for clients who are HIV positive, and education. The students, who work in pairs, select from the clinic's docket the kinds of cases on which they want to work. The two students in this particular case chose to work on a case for a client who was HIV positive. The clinic's experience in that …

Forms Of Formalism, Richard H. Pildes Jan 1999

Forms Of Formalism, Richard H. Pildes

Faculty Articles

Does modern American legal formalism exist, and what might that question mean? Three modes of self-styled legal formalism are presented at this Symposium: (1) formalism as anticonsequential morality in law; (2) formalism as apurposive rulefollowing; and (3) formalism as a regulatory tool for producing optimally efficient mixes of law and norms in contract enforcement regimes. Even superficially, the problems these "formalisms" aim to solve and their operational structures share little in common. But beyond their obvious structural differences, these modern "formalisms" diverge even more profoundly in their underlying conceptions of morals, politics, and society. Indeed, the animating conceptions of morality …

Do You Want To Know A Trade Secret? How Article 2b Will Make Licensing Trade Secrets Easier (But Innovation More Difficult), Rochelle C. Dreyfuss Jan 1999

Do You Want To Know A Trade Secret? How Article 2b Will Make Licensing Trade Secrets Easier (But Innovation More Difficult), Rochelle C. Dreyfuss

Faculty Articles

Proposed U.C.C. Article 2B's coverage of trade secrets is welcome in many ways. Article 2B recognizes the special characteristics of intangibles, such as the difficulty of inspecting delivery, monitoring use, and effectively returning information. For trade secrets, which are state-law-based, nationally uniform licensing rules are especially desirable; they will surely lead to a reduction in the risk of disclosure. Article 2B does not, however, fully account for the differences between copyrights and trade secrets. For example, the remedies provisions do not treat losses created by disclosure; the formation provisions do not consider the impact of licensing on the patentability of …

Hayekian Socialism, Richard A. Epstein Jan 1999

Hayekian Socialism, Richard A. Epstein

Faculty Articles

My motivation is simple. In order to understand the evolution of political theory, it is important to identify the strands of socialist thought in Hayek that with time have become the mainstays of the political left. Hayek's effort to find some common ground with his opponents led him to make unwise concessions to the benevolent use of state power. Of course, Hayek did not conceive of himself as the champion of the expansion of government power; nor has he ever been construed that way by friend or foe. But nonetheless, his substantive positions helped to make respectable the growth of …

The Anxiety Of Influence, Stephen Gillers Jan 1999

The Anxiety Of Influence, Stephen Gillers

Faculty Articles

Another category of rule might be called the Danger Zone Rules (DZRs). These rules do not so much forbid bad conduct, but rather describe situations that could lead to bad conduct. Those situations comprise a danger zone that lawyers are forbidden to occupy, either at all or without a client's informed agreement. DZRs are of two types..One type is matter-specific. It focuses on particular clients and matters or on particular kinds of transactions between lawyer and client. Let's call these Matter Danger Zone Rules (MDZRs). Another type of a Danger Zone Rule, the type I wish to discuss here, focuses …

Generative Concern, Political Commitment, And Charitable Actions, Bill E. Peterson, Lauren Duncan Jan 1999

Generative Concern, Political Commitment, And Charitable Actions, Bill E. Peterson, Lauren Duncan

Psychology: Faculty Publications

The implications of psychosocial generativity (Erikson, 1950) for understanding contemporary politics were explored. Study 1 replicated, in two samples, previous findings that generativity concerns are related to a variety of political activities, including the expenditure of time and money in support of political organizations. Using path analyses, Study 2 extended these findings and demonstrated how midlife generativity concerns interacted with political orientation and interest in politics to produce stronger relationships with giving. These findings suggest that people view the political arena as one important way to improve society and thereby manifest cultural generativity. Although focusing on the domain of politics, …

Stretchability Of Star-Like Pseudo-Visibility Graphs, Ileana Streinu Jan 1999

Stretchability Of Star-Like Pseudo-Visibility Graphs, Ileana Streinu

Computer Science: Faculty Publications

We present advances on the open problem of characterizing vertex-edge visibility graphs (ve-graphs), reduced by results of O'Rourke and Streinu to a stretchability question for pseudo-polygons. We introduce star-like pseudo-polygons as a special subclass containing all the known instances of non-stretchable pseudo-polygons. We give a complete combinatorial characterization and a linear-time decision procedure for star-like pseudo-polygon stretchability and star-like ve-graph recognition. To the best of our knowledge, this is the first problem in computational geometry for which a combinatorial characterization was found by first isolating the oriented matroid substructure and then separately solving the stretchability question. It is also the …
