The New York City Charter And The Question Of Scale, Richard Briffault Jan 1998

The New York City Charter And The Question Of Scale, Richard Briffault

Faculty Scholarship

A central issue for the New York City Charter – from the consolidation of Greater New York City a century ago until today – has been the question of scale. Or perhaps I should say the questions of scale. There really have been two questions: Is New York City large enough to deal with problems of regional scope? Does New York City have the necessary mechanisms to deal with problems that are of sublocal scope? In other words, can the City of New York provide both the regional and local governance New Yorkers need?

The creation of Greater New York …

Theses

Loneliness is a common experience for individuals studying in foreign countries. Where cultures, communications, and social structures are unfamiliar feelings of loneliness can present a difficult component within the adjustment process. Social support has a direct influence on a person's ability to adjust to an unfamiliar environment. Feelings of loneliness experienced by a person can be attributed to that person's perception of social support. Students who are studying in the United States from abroad are subject to a multitude of unfamiliar environments that promote uncertain social supports and increased levels of loneliness. Understanding differences between cultures and their effects on …

Recruitment And Selection: Finding The Best Candidate For The Company, Aaron T. Strcker

Theses

This thesis will focus on the recruitment and selection techniques used by organizations, while searching for candidates. and the legal issues surrounding recruitment and selection. In many organizations, the recruitment and selection of employees is a function that is not assigned a great deal of importance. However, organizations consistently talk of employees as being their biggest asset. With that statement in mind, it becomes increasingly important to uncover a recruitment and selection process that will find the best possible candidate.

The purpose of this thesis is to gather and analyze literature and research on recruitment and selection techniques and legal …

An In-Depth Look At Demographics And Psychographics To Show How Data About Consumers Have Changed To Meet The Need Of Marketers, Susan L. Sebacher Jan 1998

An In-Depth Look At Demographics And Psychographics To Show How Data About Consumers Have Changed To Meet The Need Of Marketers, Susan L. Sebacher

Theses

Consumers are constantly changing. The generations are aging, causing their wants and needs to change. Products are also changing. They have gone from standardized to specialized. The market for consumer goods has gone from a mass market to niche markets. As consumers' sophistication grows so does their skepticism about advertising and claims advertisers make about their products. This creates a tough environment for marketers.

Demographic information provides marketers with a profile of their customers. Demographic information includes: gender, race, age, education, income, marital status, and number of children Demographic information groups consumers into generational groups. Generational groups are designated by …

Indiana and on 1-65, south of Lafayette, Indiana Concurrently, two speed-readings were acquired from the passing vehicles in the vicinity of the air monitoring system using a hand-held laser gun. The speeds were integrated to determine the speeds and accelerations of the passing vehicles at the spectrometer. An 8-mm camcorder …

Modeling And Optimization Of The Indiana Lane Merge Control System On Approaches To Freeway Work Zones, Part I, Andrzej P. Tarko, Sreenivasulu R. Kanipakapatnam, Jason S. Wasson Jan 1998

Modeling And Optimization Of The Indiana Lane Merge Control System On Approaches To Freeway Work Zones, Part I, Andrzej P. Tarko, Sreenivasulu R. Kanipakapatnam, Jason S. Wasson

JTRP Technical Reports

Severe traffic turbulence on entry sections of freeway work zones increases the delays and risk of crash. A new Indiana Department of Transportation system called Indiana Merge Lane System (IMLS) creates a dynamic no passing zone on the approach to the freeway work zone through the sequence of DO NOT PASS signs. The system is thought to encourage drivers to switch lanes well upstream of the discontinuous lane taper where the merging maneuver is safer and less intrusive. The IMLS is expected to impact drivers’ behavior, their perception of the traffic conditions, and traffic safety.

This research is focused on: …

Part I dealt with the theoretical study and Part II dealt with the experimental. Part I, the theoretical part, illustrates the effect of ITZ on the concrete properties by assuming its elastic moduli to be varied continuously in the region. A four-phase composite model is employed and three functions are chosen to model the moduli variation in the ITZ. A theoretical solution for an n-layered spherical inclusion model is used to estimate the …

Gender Sex Agency And Discrimination: A Reply To Professor Abrams, Katherine M. Franke Jan 1998

Gender Sex Agency And Discrimination: A Reply To Professor Abrams, Katherine M. Franke

Faculty Scholarship

According to the Equal Employment Opportunity Commission, sexual harassment is the fastest-growing area of employment discrimination. In fact, the annual number of sexual harassment complaints filed with the EEOC has more than doubled in the last six years. No one, or at least no one who has given this problem her serious attention, can deny that workplace sexual harassment is a grave problem and that it significantly impedes women's entrance into many sectors of the wage labor market.

Notwithstanding these impressive numbers, sexual harassment legal doctrine remains remarkably undertheorized – particularly by the Supreme Court. For these and other reasons, …

Is There A Future For Future Claimants After Amchem Products, Inc. V. Windsor?, Alex Raskolnikov

Faculty Scholarship

In September 1990, the Chief Justice of the U.S. Supreme Court appointed an Ad Hoc Committee on Asbestos Litigation in response to what was widely perceived as a "'failure of the federal court system to perform one of its vital roles in our society.'" Less than a year later, the Judicial Panel on Multidistrict Litigation transferred all untried asbestos cases to the eastern district of Pennsylvania for pretrial proceedings. In January 1993, these proceedings produced a global settlement class action of historic proportions, which the district court eventually approved in August 1994. In May 1996, in Georgine v. Amchem Products, …

Marriage As Relational Contract, Elizabeth S. Scott, Robert E. Scott Jan 1998

Marriage As Relational Contract, Elizabeth S. Scott, Robert E. Scott

Faculty Scholarship

The evolution of marriage from a relationship based on status to one that is regulated by contractual norms achieved a milestone of sorts recently with the enactment of the Louisiana Covenant Marriage Act. Under this statute, couples entering marriage can choose to have the termination of their relationship regulated under conventional no-fault divorce rules, or they can voluntarily undertake a greater commitment to their marriage. For couples who select covenant marriage, either party can terminate the relationship on fault grounds, but unilateral termination of the marriage is available only after a substantial waiting period. The principal impact of the statute …

Spiritual Assessment And Care Plan Development In A Long Term Care Facility, Eugene J. Neff Jan 1998

Spiritual Assessment And Care Plan Development In A Long Term Care Facility, Eugene J. Neff

Theses

A healthy spirituality in the long term care resident is an important factor in holistic care. A review of literature coupled with the knowledge and experience of the author, an ordained clergy person with pastoral care training, and experience in the long term care setting, has indicated a growing need to ensure that the long term care resident's spiritual needs are properly assessed. The results of that assessment must be incorporated into the care plan. Appropriate steps must be taken to respond to surfaced needs and reinforce the areas of spiritual strength.

The purpose of this thesis will be to …

An Overview Of The Long-Term Care Industry: Current Issues And Future Considerations, Angela L. Onermaa Jan 1998

An Overview Of The Long-Term Care Industry: Current Issues And Future Considerations, Angela L. Onermaa

Theses

Americans today live longer than their parents did, often two to three decades after retirement. For many, modern medicine's gift of time is a blessing. But when independent living is no longer possible, few elderly people or their families are prepared for the confusing and emotionally wrenching world of long-term care. Despite reforms passed by Congress, nursing homes remain controversial. Moreover, they are too expensive for many people, and the federal Medicare and Medicaid insurance programs provide limited benefits for nursing home care. Although innovative alternatives to nursing homes have emerged in recent years, long-term care remains a costly and …

Identification And Quantification Of Radionuclides In Coal Ash, James E. Alleman, Franklyn M. Clikeman, Thomas Skronski Jan 1998

Identification And Quantification Of Radionuclides In Coal Ash, James E. Alleman, Franklyn M. Clikeman, Thomas Skronski

JTRP Technical Reports

One of the important environmental issues raised recently in regard to coal ash reuse for highway construction purposes (e.g., embankment development) is that of worker, and public, exposure to radiation which might possibly be emitted by these types of residuals. Radiation emission is, in fact, a natural phenomenon for most materials, both natural and man-made, but in the case of coal ash residuals the process of combustion produces an inevitable concentration of radionuclides from the original virgin coal. INDOT’s corresponding environmental concern consequently focuses on the following basic question: does this magnification of radionuclides found within these coal ash residuals …

The Americans With Disabilities Act: Is It The Next Civil Rights Movement?, Edwina H. Wallace Jan 1998

The Americans With Disabilities Act: Is It The Next Civil Rights Movement?, Edwina H. Wallace

Theses

This thesis will focus on the plight of disabled individuals. Many, many years ago, people with disabilities were looked upon as being demons or as being some cruel misfortune of nature. As time progressed, our views were not as naïve but the understanding and the empathy were not present.

Since the inception of The Americans with Disabilities Act, employers have been forced to open their doors to a new group of working individuals. The ADA laws have not only allowed individuals to become employed, but have opened doors in other areas as well. It is no longer difficult for disabled …

Performance Evaluation Of A Highway Embankment Constructed Using Waste Foundry Sand, Barry K. Partridge, James E. Alleman

JTRP Technical Reports

Over 9 million Mg of waste foundry sands (WFS) are produced annually in the United States as a by-product of the metal casting industry. The majority of WFS are deposited in restricted or sanitary waste landfills. Considerable savings is available to the metal casting industry through the development of reuse applications for their WFS and generators are often willing to provide WFS to a job site at no cost to the end user. Laboratory investigations have indicated that WFS from ferrous foundries can provide the necessary engineering properties for a highway embankment and that the MicrotoxTM bioassay test can be …

St. Louis Juvenile Rehabilitation Facilities: Current State And Future Needs, Phillip Eugene Hyslop

Theses

Juvenile crime has steadily risen in the United States over the past ten years. There appears to be no decrease in the juvenile crime rate in sight. New facilities to hold juvenile offenders are being built, but the juvenile crime rate continues to rise. Most states are passing tougher laws against juvenile offenders. Many states are certifying juveniles who commit violent crimes as adults.

Both California and Florida spend more on corrections than they spend on higher education. Other states are not far behind. The average cost of incarcerating a juvenile for one year is between $35,000 to $641 000. …

The Imperative That African-American Authors Define The Nature Of African-American Heroes In Literature: Or Uncle Tom To Jedediah West, Harry Jackson Jr. Jan 1998

The Imperative That African-American Authors Define The Nature Of African-American Heroes In Literature: Or Uncle Tom To Jedediah West, Harry Jackson Jr.

Theses

This document will demonstrate the need for African-American authors to define the essential and fundamental characteristics, disposition and purpose of the literary heroes of African Americans by way of an analysis of the novel, Cowboy, the Saga of Jedediah West, which I wrote between 1995 and 1998. The creation of a distinct literary heroic tradition for African Americans is necessary, I contend, because the culture virtually has been deprived and devoid of literary, imaginary heroes. Because people of every culture require heroes for healthy evolution, African Americans have weighted their heroic tradition with living heroes exclusively who are accepted …
