An Overview Of Medicaid Managed Care Litigation, Sara J. Rosenbaum, Joel B. Teitelbaum, Christopher Kirby, Linda Priebe, Tal Klement

Health Policy and Management Issue Briefs

This Issue Brief is intended as one of several in the Managed Behavioral Health Care Issue Brief Series that deals with managed behavioral health care from a purely legal point of view.

Since the enactment of Medicaid in 1965, states have had the option of offering beneficiaries enrollment in managed care arrangements. With the advent of mandatory managed care reaching millions of beneficiaries (including a growing proportion of disabled recipients), the amount and scope of litigation involving Medicaid managed care plans can be expected to grow. A review of the current litigation regarding Medicaid managed care reveals two basic types …

The Bicameral Form Of The 1787 Constitution Of The United States As A Model For The Formation Of The Swiss Federal State In 1848, Simon Netzle Nov 1998

The Bicameral Form Of The 1787 Constitution Of The United States As A Model For The Formation Of The Swiss Federal State In 1848, Simon Netzle

Swiss American Historical Society Review

In 1848, the year of the creation of the present-day form of the Swiss Confederation, Switzerland adopted some of the main elements of the American constitution: the federal constitution and the bicameral legislative. This happened not only for practical reasons to unite the conservative and the liberal cantons after the Sonderbund War in 1847, but was rather the result of a particular Swiss perception of America which had prevailed since the late Enlightenment when the United States of America were regarded as an identical Sister Republic. In this way, Switzerland was given an adequate example of identification for its own …

Prefatory Note, Leo Schelbert Nov 1998

Prefatory Note, Leo Schelbert

Swiss American Historical Society Review

The final issue of Volume 34 of the SAHS Review commemorates, first, the transformation of the Swiss polity undertaken a hundred years ago, that is its transformation from a league of states into a federal state. Simon Netzle explores specifically how the bicameral system adopted in 1787 by the framers of the second constitution of the United States became a feature also of the Swiss political system in 1848.

Sequence Analysis Of Bacterial Dna In The Colon Of An Andean Mummy, Massimo Ubaldi, Stefania Luciani, Isolina Marota, Gino Fornaciari, Raul J. Cano, Franco Rollo

Biological Sciences

We have isolated DNA from 14 tissue samples from the internal organs of an Andean human mummy (10th–11th century A.D.) and have checked the persistence of the original human and bacterial templates using the following main approaches: 1) amino acid racemization test; 2) quantification of mitochondrial DNA copy number; 3) survey of bacterial DNA in the different organs; 4) sequence analysis of bacterial amplicons of different lengths. The results demonstrate that both the original human DNA and the DNA of the bacteria of the mummy gut are preserved. In particular, sequence analysis of two (respectively 100 and 196 bp in …

Cognitive And Affective Learning In The Basic Course: Effects Of Delivery Format, Immediacy, And Communication Apprehension, Susan J. Messman, Jennifer Jones-Corley, David Mezzacappa, Deborah J. Crusan Nov 1998

Cognitive And Affective Learning In The Basic Course: Effects Of Delivery Format, Immediacy, And Communication Apprehension, Susan J. Messman, Jennifer Jones-Corley, David Mezzacappa, Deborah J. Crusan

English Language and Literatures Faculty Publications

A quasi-experimental design was used to investigate changes in learning outcomes for students enrolled in large-lecture/break-out sections versus in self-contained sections of the basic communication course.More precisely, the study explores the relationship between communication apprehension, immediacy and learning outcomes for the two class formats. Results indicate that students' cognitive learning outcomes are slightly higher in the large-lecture/break-out sections versus self-contained sections. In addition, affective learning decreases for all students from the first day of class and slightly more for students in the large-lecture/break-out sections. However, when the teacher is perceived as highly immediate, there is no difference in formats. (Contains 5 …

Opportunities For The Holding/Fattening/Processing And Aquaculture Of Western Rock Lobster (Panulirus Cygnus), Fisheries Western Australia

Fisheries Management Papers

The objective of this discussion paper is to describe policy options for dealing with rock lobster enhancement, grow-out and aquaculture issues. It is designed to serve as a policy framework for dealing with future applications to hold/fatten/process and aquaculture western rock lobster and administer existing practices.

Dynamics Of Biomolecules: Assignment Of Local Motions By Fluorescence Anisotropy Decay, Carl N. Bialik, Barnabas Wolf, Edward L. Rachofsky, J. B. A. Ross, William Laws Nov 1998

Dynamics Of Biomolecules: Assignment Of Local Motions By Fluorescence Anisotropy Decay, Carl N. Bialik, Barnabas Wolf, Edward L. Rachofsky, J. B. A. Ross, William Laws

Chemistry and Biochemistry Faculty Publications

Many biological systems have multiple fluorophores that experience multiple depolarizing motions, requiring multiple lifetimes and correlation times to define the fluorescence intensity and anisotropy decays, respectively. To simplify analyses, an assumption often made is that all fluorophores experience all depolarizing motions. However, this assumption usually is invalid, because each lifetime is not necessarily associated with each correlation time. To help establish the correct associations and recover accurate kinetic parameters, a general kinetic scheme that can examine all possible associations is presented. Using synthetic data sets, the ability of the scheme to discriminate among all nine association models possible for two …

Mutations In Bartonella Bacilliformis Gyrb Confer Resistance To Coumermycin A(1), James M. Battisti, Laura A. Smitherman, D. Scott Samuels, Michael F. Minnick Nov 1998

Mutations In Bartonella Bacilliformis Gyrb Confer Resistance To Coumermycin A(1), James M. Battisti, Laura A. Smitherman, D. Scott Samuels, Michael F. Minnick

Biological Sciences Faculty Publications

This study describes the first isolation and characterization of spontaneous mutants conferring natural resistance to an antibiotic for any Bartonella species. The Bartonella bacilliformis gyrB gene, which encodes the B subunit of DNA gyrase, was cloned and sequenced. The gyrB open reading frame (ORF) is 2,079 bp and encodes a deduced amino acid sequence of 692 residues, corresponding to a predicted protein of similar to 77.5 kDa. Sequence alignment indicates that B. bacilliformis GyrB is most similar to the GyrB protein from Bacillus subtilis (40.1% amino acid sequence identity) and that it contains the longest N-terminal tail (52 residues) of …

Deterrence, Brutalization, And The Death Penalty: Another Examination Of Oklahoma's Return To Capital Punishment, William C. Bailey Nov 1998

Deterrence, Brutalization, And The Death Penalty: Another Examination Of Oklahoma's Return To Capital Punishment, William C. Bailey

Sociology & Criminology Faculty Publications

A replication and extension of a weekly ARIMA analysis (1989–1991) by Cochran et al. (1994), which appeared in Criminology, confirms that Oklahoma's return to capital punishment in 1990, after a 25-year moratorium, was followed by a significant increase in killings involving strangers. Moreover, a multivariate autoregressive analysis, which includes measures of the frequency of executions, the level of print media attention devoted to executions, and selected sociodemographic variables, produced results consistent with the brutalization hypothesis for total homicides, as well as a variety of different types of killing involving both strangers and nonstrangers. No prior study has shown such strong …
