Vertebrate Pest Conference Proceedings: 18th (1998)

The Wildlife Services (WS) Program manages wildlife/human conflicts by using an integrated approach employing some vertebrate pesticides. These are used in such small quantities that private industry cannot afford to register and produce them profitably. On behalf of WS, the Animal and Plant Health Inspection Service (APHIS) maintains about 30 federal and state pesticide registrations, containing seven active ingredients, with the U.S. Environmental Protection Agency (EPA). These include: the Compound 1080 Livestock Protection Collar, DRC-1339 Concentrates (Starlicide), Gas Cartridges (carbon and sodium nitrate), the M-44 (sodium cyanide), and a number of baits and concentrates containing Strychnine Alkaloid and Zinc Phosphide. …

On August 29, 1997, the Nebraska Supreme Court issued its first decision interpreting the provisions of Initiative 300 (I300), Nebraska’s family farm constitutional amendment. In its Pig Pro decision, a unanimous court ruled five Dawson county farmers who sought to form a non-profit cooperative corporation would violate article XII §12 of the Nebraska Constitution (I300). The decision means Nebraska farmers cannot network their operations and receive limited liability protection under I300.

Managing the environmental risk associated with livestock production is a significant challenge. The degree of imbalance between the amount of nutrient input and nutrient output for a livestock operation provides insight into the underlying causes of nutrient-related environmental challenges. A nitrogen and phosphorus balance was constructed for 33 Nebraska livestock operations (including 17 swine operations). On most farms, substantially more nitrogen entered the farm (through purchased feed, fertilizer, etc) than left it in the form of animals, crops and manure sold. Objective. To determine whether the prevalence of overweight in preschool children has increased among the US low-income population.

Design. Analysis using weight-for-height percentiles of surveillance data adjusted for age, sex, and race or ethnicity.

Setting. Data from 18 states and the District of Columbia were examined.

Subjects. Low-income children <5 years of age who were included in the Centers for Disease Control and Prevention Pediatric Nutrition Surveillance System.

Results. The prevalence of overweight increased from 18.6% in 1983 to 21.6% in 1995 based on the 85th percentile cutoff point for weight-for-height, and from 8.5% to 10.2% for the same period based on the 95th percentile cutoff point. Analyses by single age, sex, and race …

Identification and assessment of the relative importance of factors affecting duckling growth and survival are essential for effective management of mallards on breeding areas. For each of 3 years (1993-95), we placed Fl-generation wild mallard (Anas platyrhynchos) females on experimental wetlands and allowed them to mate, nest, and rear broods for 17 days. We manipulated invertebrate densities by introducing fathead minnows (Pimephales promelas) at high densities in half of the wetlands on which broods were confined. Concern exists over the effects of interacting environmental stresses on the ecological integrity of temperate forests. Coincidence of sensitivity to drought, increasing occurrence of defoliation, and elevated pollutant deposition has produced speculation that northern hardwood forests may be susceptible to the increased climatic stresses projected for the Great Lakes region. The objective of our study was to examine relationships among environmental stress factors, vigor, mortality, and growth in northern hardwood forests located along a pollution-climate gradient in the Great Lakes region. Limitations of policy makers and health care providers understanding about living conditions in later adulthood continually constrains mature adults from doing more for themselves, and society. These circumstances move society to devalue mature adults. Less valued mature adults tend to become even more dependent, that is, increasingly less willing to care for themselves, and less able to contribute to the social good. As a result, a vicious cycle was created, and it caused mature adults to live lower quality lives, and become increasingly dependent on others. Assimilationist Bias In Equal Protection: The Visibility Presumption And The Case Of "Don't Ask, Don't Tell", Kenji Yoshino

Under current equal protection doctrine, the courts are more likely to accord heightened scrutiny to a classification if its defining trait is immutable or visible. This means that groups that can assimilate into mainstream society by changing or altering their defining trait are less likely to benefit from judicial solicitude. By withholding protection from these groups, the judiciary is subtly encouraging them to assimilate when faced with burdensome legislation. This Article critiques that assimilationist bias by demonstrating that the immutability and visibility factors cannot be justified on either substantive or processual theories of judicial review.
