The existence of the moral obligation principle in American case law has been recognized in the Restatement (Second) of Contracts section 86 (1): "A promise made in recognition of a benefit previously received by the promisor from the promisee is binding to the extent necessary to prevent injustice." Among common law countries, American jurisdictions are unique in recognizing this ameliorating doctrine. An analysis of the development and scope of this doctrine is buried in the centuries of case law surrounding the tension between the past consideration rule and the moral obligation principle. Only a few legal scholars have attempted to work out what jurisprudence might look like if lawmakers and judges took their religious world-views seriously-and explicitly-in their work, in a way respectful of "the fact of pluralism." My task is to imagine the concrete case: what a judge's jurisprudence might look like if a judge considered the wisdom of his own religious tradition in constitutional cases. This article explores broad jurisprudential themes and specific First Amendment and social welfare opinions of Justice William Rehnquist, who for some years has been a member of a Lutheran congregation, my own denomination. Community Awareness Of Adolescent Depression For Wenatchee Public Schools Wenatchee, Washington, Mary Carlsen, Steve Donaldson

The purpose of this project was to develop a community awareness of adolescent depression and its impact in the public schools, home environment and relationships with peers. To accomplish this purpose, a review of current literature and resear·ch regarding adolescent depression was conducted. This review led to the development of informational brochures for parents, peers and educators. In addition a resource guide stressing healthy living choices was developed for use by teachers in the Wenatchee School District.

An Evaluation Of The Wenatchee High School Connections Program, Norlinda Connolly, Michael Lee Mills

The purpose of this study is to assess student opinion of the Connections Program. Connections is a program offered to freshmen at Wenatchee High School to assist students with the transition from middle school. This program offers block schedule as well as curriculum and technology integration, job shadows and community service projects. In order to assess the program and offer improvements, two populations of Connections students were surveyed and data were analyzed. The literature related to integration of technology and curriculum, job shadows and community service projects was reviewed.

A Model Student Personalized Education Plan Into A Portfolio Through The Use Of Career Pathways In South Kitsap High School, Charla R. Cole

The purpose of this project was to create a Personalized Education Plan and Portfolio system to support secondary students to acquire the skills necessary to ensure employment in South Kitsap High School Port Orchard, Washington. To accomplish this purpose, current research and information related to Personalized Education Plans and Portfolios were reviewed. Additionally, career pathways were established, personal data, resume, individual career planning portfolio, and career goals inventory review worksheets were adapted and developed.

Parent Perceptions Of The Value Of The Juanita Apartment School Program, Stanley B. Hughes

The purpose of this project was to determine parent perceptions of the value of the Juanita Apartment School program. To accomplish this task interview questions were developed and family interviews conducted. Transcriptions of audio interview tapes were made and all data studied to determine response patterns. Families interviewed indicated the Juanita Apartment School program had either been "very helpful" or "helpful" in making their children feel more positive about and be more successful in elementary school.

An Interdisciplinary Research Project For The Middle School Study Skills Curriculum, Colleen M. Kinney

An integrated curriculum correlating endangered species with the disciplines of life science, math, language arts, geography, and study skills, for seventh grade students at Lewis and Clark Middle School in Yakima, Washington, was developed. A literature review supports the premise that integrated units enable students to make connections between the concepts taught in school and the real world. The literature review also indicated the need for schools to teach study skills to better prepare students for the future.

Enhancing Student Learning Through Brain-Based Learning Techniques: A Handbook For Educators, Cynthia Gail Mcfarland

The significance of utilizing a brain-based approach to learning and teaching was researched. Current brain research indicates that often traditional educational methods are not conducive or are even detrimental to student learning. Several sources supported the brain-based learning, multiple intelligence, and learning styles theories. The research suggested that the brain-based learning approach has been beneficial not only to student learning but also to an increase in student motivation and self-esteem. A handbook for educators was created to compliment existing curriculum. Educators and administrators have begun to place a high priority on connecting classrooms to the Internet. However, classroom computer use remains at least one step removed from teachers and is used to sustain existing curricula rather than serving as a catalyst for educational improvement. Professional communication is a major instrument for initiating and implementing educational reform; the Internet represents a primary computer-based forum for professional development. The purpose of the project was to develop a sample in-service curriculum focusing on the use of e-mail, newsgroups, and listservs as tools for professional development and communication among secondary educators.

A Comparative Study Of 1-12 Public School Systems Of The United States And People's Republic Of China, Sean Xiong Chi

The purpose ofthis study was to recognize and extrapolate the major similarities and/or differences between the public education systems of the United States and the People's Republic of China. The researcher was primarily concerned with the examination of similarities and differences in origin, evolution, structure, organization, curriculum, funding, law and governmental regulations in Grades 1-12 school systems in the two countries. The researcher's analysis of the project was intended to provide other educators and researchers with a picture of the nature of the two school systems. There is no value judgement of either country's educational system in this comparative study.

Bellum Americanum: The U.S. View Of Twenty-First Century War And Its Possible Implications For The Law Of Armed Conflict, Michael N. Schmitt

After describing Bellum Americanum at some length, the article turns to the "stressors" it presents for the current law of armed conflict. The term stressors is used to suggest that law evolves as it is stressed by changing circumstances. Much as water seeks a constant level, law inevitably moves to fill normative lacunae. Correspondingly, law loses its normative valence when it no longer serves "community"-a relative concept-ends. Thus, law is contextual and directional. It is contextual in the sense that it is understood and applied based upon the specific social, economic, political, and military milieu in which it operates. …

Parasitic Hymenoptera can be difficult to identify by conventional taxonomic techniques. Examination of the cuticular hydrocarbons (CHCs) provides a basis for chemotaxonomic differentiation, which may lead to the discovery of pheromones, and can be a means of examining colonies for species cross-contamination. The parasitic wasps examined were Muscidifurax raptor, M. zaraptor, M. uniraptor, and the gregarious form of M. raptorellus. Species within the genus Muscidifurax, as well as the sex, can clearly be differentiated by examining the gas chromatograms of the CHCs. Identification of the alkanes by mass spectrometry shows uncommon dimethylalkanes and trimethylalkanes for members of the …

A common and confusing problem in analyses of insect hydrocarbons is in making sense of complicated gas chromatograms and interpreting mass spectra since branched chain compounds differing by one or two carbons in backbone or chain length may elute from the column at nearly the same time. To address this confusing situation, relative gas chromatography (GC) retention times are presented for typical mono-, di-, tri-, and tetramethylalkanes comprising most of the commonly appearing series of homologous methyl-branched alkanes up to 53 carbons that are found in insect cuticular hydrocarbons. Florida occasionally experiences outbreaks of black flies, though this is a rare occurance, and these large populations are caused by rainfall extremes. Common names for this pest include black flies and turkey gnats, as well as a number of new names applied by Floridians which are not repeatable here. Because of the hump visible behind their head when viewed in profile, black flies are also called buffalo gnats. Montane moist meadows of western North America are relatively unique in that they are characterized by annual cycles of spring inundation followed by summer drought. Thus, plants adapted to these ecosystems must cope with a wide range of environmental conditions. We compared gas exchange and water relations of upper canopy leaves and leaf area index (LAI) of three dominant montane meadow graminoids growing at both streamside and mid-meadow locations (2.5 and 20.0 m, respectively from the stream edge). The blastoderm (fertilized ovum) and unfertilized germinal disc (UGD) of fresh laid eggs and eggs stored prior to incubation exhibit subtle but definable morphological variations. Such variations may lead to difficulty when attempting to determine true flock fertility based on the appearance of the blastoderm/UGD. The objectives of this study were to define and categorize such morphological variations and to determine whether sperm influence the frequency distribution of the different categories.
