Alaska Justice Forum ; Vol. 14, No. 4 (Winter 1998), Riley N/A, N/A Uaa Justice Center
Vols 11-20 (1994-2004)
The Winter 1998 issue of the Alaska Justice Forum features several articles on juvenile justice, including figures on juvenile arrests in Alaska over from 1987 to 1996, during which the Alaska juvenile arrest rate actually declined; the provisions under Alaska Statutes for juveniles to be waivered into the adult justice system; and procedures and laws regarding the disclosure of records of juvenile offenders in Alaska and nationally. Research on the informal conversational patterns of correctional officers at Spring Creek Correctional Center, a maximum security prison in Seward, Alaska, shows how practices of cultural interpretation common to all work groups may …

The Burdens And Benefits Of Race In America, Charles J. Ogletree Jr.
The Burdens And Benefits Of Race In America, Charles J. Ogletree Jr.
UC Law Constitutional Quarterly
Beginning with the ideals expressed in the Declaration of Independence, America has promised its citizens "equality." The underlying assumption implicit in such ideals is that equal treatment is to be applied regardless of the race of individual citizens. Such an ambitious goal of color-blindness, however, ignores the reality of dual- Americas-one for the majority, and one for the rest-and consequently fails in its attempt at fulfilling the promise. This Article, based on the author's lecture at the 1996 Matthew 0. Tobriner Memorial Lecture, examines ways in which the problems of race have been and should be addressed in legal discourse. …
Fetal Homicide Laws: Shield Against Domestic Violence Or Sword To Pierce Abortion Rights, Alison Tsao
Fetal Homicide Laws: Shield Against Domestic Violence Or Sword To Pierce Abortion Rights, Alison Tsao
UC Law Constitutional Quarterly
Under the common law, the intentional killing of a fetus by a party other than the pregnant woman did not constitute murder. A child had to be born alive for homicide statutes to apply. The primitive state of medicine during the common law period necessitated this "born alive" rule because doctors could not determine whether a fetus was capable of independent existence before the baby was born. Nor could doctors accurately determine the cause of death of a fetus. The present sophistication of the medical profession has largely removed the difficulties in determining the exact stage of fetal development and …
Kentucky Domestic Violence And Abuse Act: Civil Remedies For Victims, Carol E. Jordan, Karen Quinn
Kentucky Domestic Violence And Abuse Act: Civil Remedies For Victims, Carol E. Jordan, Karen Quinn
Office for Policy Studies on Violence Against Women Publications
Advocates for victims of domestic violence have long argued that this specifi form of violence is no less an offense than an assault by a stranger. In fact, because domestic violence invovles closely related victims and offenders, it poses additional and very serious risks to victims. Such risks led advocates to promote the creation of civil remedies for victims of domestic violence. The Domestic violence and abuse Act and its civil protections were created by the 1984 General Assembly, not to replace criminal sanctions, but to afford victims additional civil protections which the criminal justice system does not provide.

Crime Or Punishment: The Parental Corporal Punishment Defense - Reasonable And Necessary, Or Excused Abuse, Kandice Johnson
Crime Or Punishment: The Parental Corporal Punishment Defense - Reasonable And Necessary, Or Excused Abuse, Kandice Johnson
Faculty Publications
The parental right to use physical force to discipline and restrain children is a privilege firmly rooted in the American system of jurisprudence. This privilege is often asserted as a defense when parents are charged with a crime of aggression against their child. While the privilege to use disciplinary force is universally recognized as a defense in criminal actions, it is equally acknowledged that child abuse is a pervasive reality of American life. This article postulates that current laws, addressing assertion of the parental privilege defense in criminal actions, fail either to provide adequate guidance to parents or to sufficiently …

The React Security Belt: Stunning Prisoners And Human Rights Groups Into Questioning Whether Its Use Is Permissible Under The United States And Texas Constitutions Comment., Shelley A. Nieto Dahlberg
St. Mary's Law Journal
The Remote Electronically Activated Control Technology (REACT) belt infringes upon criminal defendants’ and prisoners’ fundamental rights; therefore, it cannot withstand judicial scrutiny under the United States and Texas Constitutions. This Comment attempts to address and answer issues regarding the REACT belt. The belt constitutes cruel and unusual punishment with the potential to deprive prisoners of their due process rights. The belt disrupts attorney-client communication and destroys a criminal defendant’s presumption of innocence. Furthermore, other alternatives provide effective means to prevent unruly prisoners from destroying the integrity of the courts. Part II of this Comment discusses how the belt works, and …

"The Worst Of Both Worlds" Or Was The Therapeutic Mission Of The Juvenile Court System A One-Way-Street? - The German Juvenile Court System Compared To The American Situation, Joerg Fries
LLM Theses and Essays
Juvenile delinquency and convictions are on a record high in the United States and Germany, and there are concerns about balancing the diversionary interests of the juvenile justice system with the need for public safety. This thesis focuses on a comparison between the German and American Juvenile Court systems by exploring the different theories of punishment, sentencing, criminal law, juvenile delinquency and public safety. The thesis examines the birth of the parens patriae concept and establishment of the American juvenile court, as well as the problems of balancing the penal nature of the criminal law, rehabilitative goals of the juvenile …
