Deterrence, Brutalization, And The Death Penalty: Another Examination Of Oklahoma's Return To Capital Punishment, William C. Bailey

A replication and extension of a weekly ARIMA analysis (1989–1991) by Cochran et al. (1994), which appeared in Criminology, confirms that Oklahoma's return to capital punishment in 1990, after a 25-year moratorium, was followed by a significant increase in killings involving strangers. Moreover, a multivariate autoregressive analysis, which includes measures of the frequency of executions, the level of print media attention devoted to executions, and selected sociodemographic variables, produced results consistent with the brutalization hypothesis for total homicides, as well as a variety of different types of killing involving both strangers and nonstrangers. The daily injustices mount. The front line professionals who administer the system cry out for more discretion to depart from the rigid rules that bind them, Congress finally hears their call, and is poised to enact sweeping reforms.
Are improvements in federal sentencing law on the way? Probably not in the near future. But the new Congress will surely take up proposals to regulate the managed health care industry, and the impending debate over a proposed "Patients' Bill of Rights" law offers important lessons for federal sentencing policy.

In 1988, hundreds of federal district judges were suddenly confronted with the need to render a decision on the constitutionality of the Sentencing Reform Act and the newly promulgated criminal Sentencing Guidelines. Never before has a question of such importance and involving such significant issues of constitutional law mandated the immediate and simultaneous attention of such a large segment of the federal trial bench. Accordingly, this event provides an archetypal model for exploring the influence of social background, ideology, judicial role and institution, and other factors on judicial decisionmaking. Multiple Out-Of-Home Placements & Children's Psychosocial Functioning, Brittawni Lee Olson

This study examined the relationship between multiple out-of-home placements and children’s psychosocial functioning. Psychosocial functioning was measured by the number of mental health services recommended to the child by a licensed mental health professional and the number of negative behaviors exhibited by the child as recorded in the caseworkers’ narratives or mental health professional’s report. Independent variables included total number of placements experienced per child and average placement duration. Data were extracted from the administrative database and case files of the State of Nebraska Foster Care Review Board Tracking System (N=443). This comment examines the crime of infanticide. The comment includes a brief history of infanticide and an explanation of how the crime is treated in common law countries. A comparison of the United States and other common law countries leads the author to suggest that the United States should adopt an infanticide statute similar to that of other common law countries.

The relationship between race and crime has long been a primary concern of criminal justice researchers. Numerous studies have examined this relationship through the use of official statistics, self-reports, and victimization surveys. The results of these studies present multiple and often conflicting results. Studies examining official statistics and victimization data have generally found a significant difference in delinquency between White and minority juveniles, with minority juveniles responsible for more delinquency than White youth in terms of both incidence and seriousness. Self-report studies, on the other hand, have often found no differences between minority and White youth, or smaller differences than …

For much of this century, American foreign affairs law has assumed that there is a sharp distinction between what is foreign and what is domestic, between what is external and what is internal. This assumption underlies a dual regime of constitutional law, in which federal regulation of foreign affairs is subject to a different, and generally more relaxed, set of constitutional restraints than federal regulation of domestic affairs. This research report updates the socioeconomic picture of Latinos in Massachusetts. According to estimates contained in this report, the Latino population in Massachusetts experienced vigorous growth during the first half of the 1990s. Not since the 1990 census has there been a broad profile of this rapidly growing segment of the state’s population.
