Resurrecting The Dodo: The Unfortunate Re-Emergence Of The Puffery Defense In Private Securities Actions, Jennifer O'Hare Jan 1998

Resurrecting The Dodo: The Unfortunate Re-Emergence Of The Puffery Defense In Private Securities Actions, Jennifer O'Hare

Faculty Publications

The conventional wisdom is that the puffery defense is inapplicable in securities regulation. However, appellate courts in almost every federal circuit have recently used the puffery defense to dismiss private securities fraud actions that were based on vague statements of corporate optimism. This Article demonstrates that the courts have misused the puffery defense and have improperly insulated companies from liability for their misrepresentations. It contends that the assumptions justifying the use of the puffery defense are not present in securities transactions and that the federal securities laws have expressly rejected the very doctrine underlying the puffery defense-caveat emptor. Arguing that …

Book Discussions : Guiding Students In Creating Their Own Questioning, Christine Matthew Jan 1998

Book Discussions : Guiding Students In Creating Their Own Questioning, Christine Matthew

Graduate Research Papers

Book discussions increase the understanding and personal meaning of books through the students' active participation during the reading process. Previous to book discussions the students would give a statement from the book or paraphrase the book. With the new format students are able to talk about the character's feelings, predict the happenings in the story, discuss the circumstances in the story and how the story could have been written differently.

The success of the book discussions makes it an easy decision to continue the program. This process is very enjoyable and can be adapted for any classroom and teacher. The …

The Cave Exploration Group Of East Africa And Volcanic Caves In Kenya, Michael Declan Kennedy

International Journal of Speleology

This paper looks at the history of the Cave Exploration Group of East Africa with special reference to the exploration of volcanic caves. It demonstrates that the group has concentrated on two main areas, the Chyulu HiIls and Mt. Suswa, although other areas have also been studied. The Cave Exploration Group of East Africa has had to cope with various problems. The most important of which are related to the socio-economic conditions of a developing country. These problems have not prevented the group from making a valuable contribution to vulcanospeleology.

Rights, Wrongs, And Recourse In The Law Of Torts, Benjamin C. Zipursky Jan 1998

Rights, Wrongs, And Recourse In The Law Of Torts, Benjamin C. Zipursky

Vanderbilt Law Review

Cardozo's opinion in Palsgraf v. Long Island Railroad Co.' hinges on a stark assertion about rights and wrongs: A plaintiff has no right of action unless she can show "'a wrong' to herself; i.e., a violation of her own right." Cardozo himself made this principle the core of his analysis, yet scholars typically regard it as impenetrable, circular, vacuous, or, as Posner put it, "eloquent bluff." Small wonder, then, that readers typically turn to "reasonable foreseeability" as the essence of the case. Leading scholars treat Palsgraf as a proximate cause case, despite Cardozo's pronouncement that "W[the law of causation, remote …

Relationship Between Professional Development And Education, Christine A. Frederick Jan 1998

Relationship Between Professional Development And Education, Christine A. Frederick

Masters Theses

Nursing is a profession. It is important for nurses to know what impacts professional development. Educational preparation plays a large role in professional development.

Data were originally collected in 1995 through a survey of nurses from one chapter of Sigma Theta Tau International. The survey was sent to 544 members to determine their scores on professional development. The current study conducted a re-analysis of that data to determine if a relationship existed between professional development and education.

This thesis was based on Leddy and Pepper’s (1993) theory of professional development modified from Eric Erikson’s eight stages of the life cycle. …

Parental Factors Affecting Child Restraint Device Use In Children Ages 3-5 Years, Peggy Sue Meulenberg Jan 1998

Parental Factors Affecting Child Restraint Device Use In Children Ages 3-5 Years, Peggy Sue Meulenberg

Masters Theses

Motor vehicle accidents are a leading cause of morbidity and mortality in children. Although Michigan law requires all children to be restrained, many children remain unrestrained or improperly restrained. The purpose of this study was to determine how preschool children are restrained and to examine where parents obtain information on restraining techniques. A descriptive study utilizing a newly developed questionnaire was performed. The Health Belief Model served as the conceptual framework. A significant relationship was found between parents who wore their seat belts all the time and the child being restrained. Most parents restrained their child by a lap and …

Quality Nursing Care: The Nursing Home Residents' Perspective, Brenda L. Larsen Jan 1998

Quality Nursing Care: The Nursing Home Residents' Perspective, Brenda L. Larsen

Masters Theses

The purpose of the study was to determine what nursing home residents consider quality nursing care. The information obtained can provide nurses with knowledge about quality care perceptions in this population. Care thus could be planned and provided that would promote resident centered quality.

For this qualitative study a phenomenological approach was used. The investigator collected data via audio-taped interviews and field note observations. A grounded theory approach was used to uncover residents' perceptions of quality nursing care. The meaning was then disclosed by the process of description and thematic interpretation.

The shared experience of living in a nursing home …

Masters Theses

This study used a quasi-experimental design using a two-group comparison to evaluate the effects of advanced practice nurse interventions on client compliance to self-care regimens (diet, meds, and established appointments). The conceptual framework was based upon Dorothea Orem's Self-Care Model.

This study used the premise of Ashby's (1988) "Self-Care Outcome Measurement" tool to ascertain the frequency of the clients'performance of self-care activities. The frequency was measured using a 4-point summated rating scale. The study site was a 400 bed acute care hospital in Southcentral Michigan. The convenience sample of 10 adult clients with congestive heart failure were interviewed by phone …

Relationship Between Sensibility Loss And Performance On The Jebsen-Taylor Hand Function Test In Non-Surgical Carpal Tunnel Syndrome Patients, Bethany J. Navarre, Elizabeth A. Ware Jan 1998

Relationship Between Sensibility Loss And Performance On The Jebsen-Taylor Hand Function Test In Non-Surgical Carpal Tunnel Syndrome Patients, Bethany J. Navarre, Elizabeth A. Ware

Masters Theses

The assumed correlation between sensibility loss in carpal tunnel syndrome (CTS) and hand function has not been supported by research. The purpose of this study is to examine this relationship. Thirteen subjects with CTS, no previous hand surgeries, hypothyroidism, or diabetes participated. The Weinstein Enhanced Sensory Test was used to assess sensibility and the Jebsen-Taylor Hand Function Test was used to assess hand function. No correlations were found between sensibility loss and hand function. Despite a small sample, lack of correlation between sensibility loss in CTS and hand function is significant. It suggests that further research is needed.

Coffee In Nicaragua : Regional Development And Change In The Nineteenth Century, Craig Stephen Revels

Dissertations and Theses

Throughout the nineteenth century expanding coffee cultivation transformed the economic, political, and social landscapes of the Central American republics. In Nicaragua, coffee cultivation developed in two primary regions, the Southern Uplands and the North-Central Highlands. This study analyzes the formation and development of these two regions using six key factors: 1) pre-coffee economic development; 2) transportation; 3) government promotion; 4) labor and population structure; 5) land tenure and access; and 6) capital and credit. Qualitative assessment of the relative importance of these six factors determines which factors were most important in the creation of the Southern Uplands and the North-Central …

Free Trade, Regionalism, And The Democratic Peace Theory, Julia B. Johnson Jan 1998

Free Trade, Regionalism, And The Democratic Peace Theory, Julia B. Johnson

Dissertations and Theses

Democratic nations worldwide rarely, if ever, go to war against one another. A variety of reasons for these peace loving democracies are offered in the social sciences literature. Many proponents of the theory of a democratic peace argue that democratic nations do not war against one another because of similar libertarian norms of behavior, and prohibitive structural institutions.

This thesis disagreed with the above assessment of peaceful democratic norms and institutions, and sought instead to investigate the role of economic prosperity as a crucial element of international cooperation. Combining the characteristics of democracy and economic prosperity, more fully rounded out …

Role Of The Warrant In Presidential Debates : 1960, 1976, & 1996, Aaron Nicole Kaio

Dissertations and Theses

Every four years in America we make a decision about which candidate is best suited to be our next president. Over the past twenty years a standard component of the presidential campaign has been televised debates. These debates are supposed to help the public get a better understanding of the candidates' ideas about government, our future, and to demonstrate analytical skills and their ability to think on their feet.

This study set out to see how the candidates' arguments measured up to some basic argumentation standards. According to several scholars, none of the televised presidential debates qualify as 'true debates', …

Academic Esl Reading : Semantic Mapping And Lexical Acquisition, Jeffrey Darin Maggard Jan 1998

Academic Esl Reading : Semantic Mapping And Lexical Acquisition, Jeffrey Darin Maggard

Dissertations and Theses

Second Language Acquisition (SLA) theoreticians and educators disagree whether vocabulary should be explicitly taught in second language learning classrooms. These individuals are divided about the most efficient way for L2 learners to increase the size of their lexicons. This thesis proposes that explicit vocabulary instruction may significantly facilitate lexical acquisition for adult second language learners in academic contexts.

An experimental study designed to investigate the relationship between explicit vocabulary instruction and the rate of lexical acquisition is described. It was hypothesized that metacognitive strategy training in semantic mapping activities would significantly increase the rate of lexical acquisition for upper-intermediate university …

The K-BIT provides normative curve equivalents and stanines, which the SILS does not. The SILS provides abstract and …

An Analysis Of The Principal Arguments In Support Of A Congressional Term Limit, Paul William Cadero-Smith Jan 1998

An Analysis Of The Principal Arguments In Support Of A Congressional Term Limit, Paul William Cadero-Smith

Dissertations and Theses

This paper looks closely at the debate on congressional term limits. The objective of this paper is to examine critically the fundamental arguments made in support of term limits. Analysis of pro-term limits literature pinpoints incumbent behavior as the driving force behind term limits reform. In particular, supporters argue that legislators have become increasingly career-oriented over the past fifty years, allocating for themselves a myriad of perks of office ( e.g., large staff, free mailing, and unlimited travel budgets) to achieve their reelection goals. In addition, incumbents are cited for focusing on the wishes of their constituencies instead of on …
