Translating Federalism: A Textualist Reaction, Gregory E. Maggs Jan 1998

Translating Federalism: A Textualist Reaction, Gregory E. Maggs

GW Law Faculty Publications & Other Works

In his rich and important article, Translating Federalism: United States v Lopez, Professor Lawrence Lessig advances two ambitious and provocative claims. Lessig first asserts that the Supreme Court has sought to control the expansion of federal power by "translating" the Commerce Clause instead of following the Clause's textual meaning. Second, Lessig proclaims that, as a normative matter, the Supreme Court should engage actively in this type of translation. In his view, the Court shows greater fidelity to the Constitution by reading it in ways that preserve the document's original function than the Court exhibits by strictly following the document's text. …

The Effects Of A Dna Virus Infection On The Reproductive Otential Of Female Tsetse Flies, Glossina Morsitans Centralis And Glossina Morsitans Morsitans (Diptera: Glossinidae), Rosemary C. Sang, Walter G.Z.O. Jura, Leonard H. Otieno, Richard W. Mwangi Jan 1998

The Effects Of A Dna Virus Infection On The Reproductive Otential Of Female Tsetse Flies, Glossina Morsitans Centralis And Glossina Morsitans Morsitans (Diptera: Glossinidae), Rosemary C. Sang, Walter G.Z.O. Jura, Leonard H. Otieno, Richard W. Mwangi

All Peer-Reviewed Publications

Reproductive anomalies associated with the tsetse DNA virus infection in the female tsetse hosts, Glossina morsitans centralis Machado and Glossina morsitans morsitans Westwood, inoculated with the virus during the 3rd instar larval stage were studied and the data compared to those obtained from the control females injected with sterile physiological saline. Virus infected flies had significantly longer first and second pregnancy cycles (P<0.0001) and produced pupae that were of significantly less weight in milligrams (P<-0.0001) compared to controls. Transmission of the virus to progeny was not absolute and only 21% of G. m. centralis and 48% of G. m. morsitans first progeny flies from infected females developed salivary gland hypertrophy as a result of transmission from mother to progeny. The virus infected females produced significantly fewere pupae compared to the controls during the experimental period (P<0.00001).

The Magnitude Of Site And Time Interaction Effect In Tsetse Fly (Diptera: Glossinidae) Trap Catches, A. Odulaja, S. Mihok, I. M. Abu-Zinid Jan 1998

The Magnitude Of Site And Time Interaction Effect In Tsetse Fly (Diptera: Glossinidae) Trap Catches, A. Odulaja, S. Mihok, I. M. Abu-Zinid

All Peer-Reviewed Publications

Site and time effects are important factors determining trap catches of tsetse flies. These factors may interact significantly and therefore confound interpretation of time series data used for population monitoring. We therefore investigated the magnitude and importance of site x time interactions in trap catches of Glossina pallidipes Austen and G. longipennis Corti using a 2200 trap-days (400 trap-months) data set. The interaction was found to be significant (P < 0.05) in 46-100% of the combinations of different numbers of months and sites between 2 and 12. The mean percent variance due to the interaction ranged between 4% and 28% for G. pallidipes and 12% and 36% for G. longipennis. The interaction was usually less important than the effect of site alone but more important than the effect of time alone. These results suggest that tsetse researchers should examine critically the adequacy of existing approaches to population monitoring with traps and to testing new traps and odour baits.

Olfactory Responses Of Glossina Fuscipes Fuscipes (Diptera: Glossinidae) To The Monitor Lizard Varanus Niloticus Niloticus, M. M. Mohamed-Ahmed Jan 1998

Olfactory Responses Of Glossina Fuscipes Fuscipes (Diptera: Glossinidae) To The Monitor Lizard Varanus Niloticus Niloticus, M. M. Mohamed-Ahmed

All Peer-Reviewed Publications

Visual and olfactory responses of Glossina fuscipes fuscipes Newstead to the monitor lizard, Varanus niloticus niloticus Laurenti were studied using various catching devices near Lake Victoria, Kenya. Electric nets baited with visible lizards caught more males (x2.1) and significantly more females (x2.0) than unbaited nets. Lizards concealed in electrified black Pvc pipe models, simulating the shape and size of a monitor lizard, increased significantly the catches of tsetse by 2.1 times. Fresh lizard urine dispensed at an evaporation rate of 500 to 1000 mg/h also increased significantly the catches of flies at biconical traps, electrified models and electric nets. Identification …

Perceptions Of Elder Abuse Among Australian Elderly Individuals And General Practitioners, Marianela Cuevas Jan 1998

Perceptions Of Elder Abuse Among Australian Elderly Individuals And General Practitioners, Marianela Cuevas

Theses: Doctorates and Masters

Research available on elder abuse is limited. There continues to be a lack of uniformity in how to define and identify the problem, as well as how to intervene. One group which continues to be excluded from the process of gaining knowledge on the issue of elder abuse is the elderly themselves. As general practitioners are the primary source of health care for older people, their perspectives on elder mistreatment should be explored as well. The first objective of this study was to examine whether differences existed in the perceived severity of potentially abusive situations between three groups of older …

Pedagogic Approaches And Cultural Scripts: The Use Of Talk During Shared Literacy Lessons In Three Primary Two Classrooms In Singapore, Maha Sripathy

Theses: Doctorates and Masters

This study investigates the use and occurrence of talk during the implementation of the key approaches of Shared Book Reading and Class Dictated Story in three Primary Two classrooms in Singapore. These approaches are based on a constructive perspective of literacy where children make meaning from texts read with the teacher through joint exploration and connection with their respective background knowledge and experiences. Central to this joint exploration and meaning-making is the teacher-pupil talk. The occurrence and use of talk in the implementation of these approaches in three primary two classrooms was recorded, transcribed and analyzed. Teachers' and pupils' experiences …

User Response And Organisational Fit For Information Systems In Earth Observation, Jeff Kingwell

Theses: Doctorates and Masters

A group of seventy six scientists and data managers in the Australian research agency CSIRO were surveyed to establish their needs and preferences in relation to information systems for Earth observation data. After study of available alternatives, three prototype Earth observation information management systems were installed and the user response was evaluated through interview of fifteen of the group. The prototypes consisted of web-based client servers which permitted users to interrogate databases of Earth observation datasets; to search for information about sensor or satellite performance, and to retrieve data and information products. The chosen systems were CILS, the CEOS (Committee …

The Effect Of Lip-Slur Practice On Increasing Pitch Range In Brasswind Instrument Students, Robert L. Benton Jan 1998

The Effect Of Lip-Slur Practice On Increasing Pitch Range In Brasswind Instrument Students, Robert L. Benton

Theses: Doctorates and Masters

Lip-slur exercises comprise part of the practice routines of many professional and serious amateur brasswind players. There are several reasons why so many players practise lip-slurs. One of those reasons is the belief that lip-slurs contribute to the development of the brasswind high register. This study argues that while there is a vast amount of anecdotal evidence from many authors widely deemed to be influential in the form of method books or writings that lip-slurs can contribute to the development of the brasswind high register, there has been little research to support this widely held belief. This study used a …

Investigating Organisational Effectiveness Within The Federation Of Wa Police And Citizens Youth Clubs (Inc.), Bruce Heathcote

Theses: Doctorates and Masters

The purpose of this study was to identify organisational effectiveness criteria relevant to the Federation of WA Police and Citizens Youth Clubs; analyse variations between important constituent groups; and compare the criteria developed with the Objects of the Federation and relevant models for assessing organisational effectiveness within the Western Australian public sector. A four round Delphi technique was applied to club staff, management committee members, coaches and other volunteers (including current and ex-club members) to identify organisational effectiveness criteria. The 22 criteria developed were further refined to make 25 criteria that were tested against a larger sample using a mailed …
