Against Constitutional Theory, Richard A. Posner Jan 1998

Against Constitutional Theory, Richard A. Posner

Articles

In this Madison Lecture, Chief Judge Posner advocates a pragmatic approach to constitutional decisionmaking, criticizing constitutional theorists who conceal their normative goals in vague and unworkable principles of interpretation. After discussing specific constitutional theories as well as the legal academy's increasing reliance on theory in genera Posner demonstrates the ineffectuality of constitutional theory, using the Supreme Court's decisions in United States v. Virginia and Romer v. Evans as examples. He argues not that these cases were necessarily wrongly decided, but that the opinions lack the empirical support that is crucial to sound constitutional adjudication. Posner urges law professors to focus …

Living Dangerously: A Defense Of Mortal Peril, Richard A. Epstein Jan 1998

Living Dangerously: A Defense Of Mortal Peril, Richard A. Epstein

Articles

As one of the most controversial writers of our time, just the name Richard Epstein draws immediate attention from all sectors of academia. But if the hallmark of great ideas is the criticism they engender, Professor Epstein's words and thoughts are powerful indeed. In Mortal Peril, Professor Epstein outlined a fundamental shift in thinking that he claimed needed to occur before any discussion of health care could take place. The final consensus of the validity of Professor Epstein's views may still be a matter for history to judge, but in many ways, he has already won; with the strength of …

Can A State Commit A Crime? Definitely, Yes!, Alain Pellet

ILSA Journal of International & Comparative Law

As is well known, the International Law Commission (ILC) decided in 1976 to include an article in its Draft Articles on State Responsibility that makes a distinction between normal international wrongful acts, which it called delicts, on the one hand, and exceptionally grave breaches of international law which it called international crimes, on the other hand.

An Exploratory Study Of The Level Of Reflection Attained By Preservice Teachers, Maria Elena Galvez-Martin, Connie L. Bowman, Margaret A. Morrison

Mid-Western Educational Researcher

This exploratory study investigated the levels of reflection achieved over three quarters by graduate level preservice teachers. Levels of reflection were determined through analysis of their reflective journal entries on readings and field experiences. A repeated measures two factor ANOVA completely within design was used to systematically analyze changes in the level of reflection. Even without specific training in reflection and reflective thinking, some significant growth occurred in the levels of reflection as a result of asking preservice teachers simply to reflect. However, only one participant achieved the highest level of reflection.

Management Education : The Academic Perspective, Ramnath Narayanaswamy Jan 1998

Management Education : The Academic Perspective, Ramnath Narayanaswamy

IIMB Management Review

Business graduates, especially from premier institutes of management, have long been wooed by all sectors of industry and business alike. By and large, they have the reputation of being the star performers of their organisations. Have business graduates lived up to their promise? How far has their education equipped them to face the challenges of the actual business environment? How have they coped with and geared up to the post globalisation and liberalisation scenario? How confident are they of managing organisations creatively, of dealing with tasks as wide ranging as interfacing sensitively with customers and putting processes in place? Bringing …

Phonetic Skills And Vocabulary Size In Late Talkers: Concurrent And Predictive Relationships, Jennifer Mirak, Leslie Rescorla Jan 1998

Phonetic Skills And Vocabulary Size In Late Talkers: Concurrent And Predictive Relationships, Jennifer Mirak, Leslie Rescorla

Psychology Faculty Research and Scholarship

Phonetic skills and vocabulary size were investigated in 37 toddlers (24 to 31 months) identified with specific expressive language impairment and 20 comparison toddlers matched on age, SES, and nonverbal ability. The use of consonants was highly consistent across two contexts: 20 minutes of structured testing and 5 minutes of free play. The comparison children produced almost triple the number of consonant types and five times as many consonant tokens as the late talkers. However, the most frequently present consonants were similar across groups, indicating delayed rather than deviant phonetic development in the late talkers. The late talkers used a …

Communicative Intent In Late-Talking Toddlers, Leslie Rescorla, Lisa Merrin Jan 1998

Communicative Intent In Late-Talking Toddlers, Leslie Rescorla, Lisa Merrin

Psychology Faculty Research and Scholarship

This research investigated communicative intent in 31 toddlers who were slow to talk and 32 normally developing toddlers matched on SES, age, and nonverbal cognitive ability. Communicative intent was studied during free play, both with the mother and with an unfamiliar examiner. Late talkers had lower rates of communication, initiation, and joint attention, but when total communicativeness was controlled for, they were just as likely to initiate, respond, and maintain joint attention as were their peers. As expected, the late talkers relied more on nonword vocalization, gestures, and gesture/oral combinations than their normally developing peers. Children in both groups initiated …
