Progress For Pilgrims: An Analysis Of The Holy See-Israel Fundamental Agreement, Geoffrey R. Watson Jan 1998

Progress For Pilgrims: An Analysis Of The Holy See-Israel Fundamental Agreement, Geoffrey R. Watson

Scholarly Articles

This Article asks whether international human rights law obliges states to admit foreign pilgrims, and if so, whether the existence of such an obligation should influence interpretation of the Fundamental Agreement. Part I of this Article takes up a logically prior question: whether the Fundamental Agreement is a legally binding treaty, and whether it should be interpreted in accordance with treaty law. The Article rejects recent suggestions that one or both parties lack the capacity to make treaties, and it concludes that the Agreement is a binding treaty that should be interpreted in accordance with the Vienna Convention on the …

Harnessing The Human Genome Through Legislative Restraint, George P. Smith Ii Jan 1998

Harnessing The Human Genome Through Legislative Restraint, George P. Smith Ii

Scholarly Articles

The awesome predictive power of genetic medicine promises great advancements in not only the treatment of identifiable conditions but the prevention of their pathological manifestations. At the same time, the release and dissemination of this genetic or medical information poses a distinct risk of loss of privacy and stigmatization to carriers of genetic disorders. In order to safeguard the individual right of autonomy, privacy, confidentiality and informed consent-yet accommodate the legitimate interests of employers and insurers to obtain medical information relevant to their professional needs and economic responsibilities a balance must be struck legislatively at the federal and state levels …

Control Freaks, John H. Garvey Jan 1998

Control Freaks, John H. Garvey

Scholarly Articles

Last year, in Washington v. Glucksberg, the Supreme Court decided that the Constitution does not afford us a right to commit assisted suicide. I endorse this conclusion. I might less modestly say that it endorses me, for the Court's understanding of freedom is similar to the one I propose in What Are Freedoms For?, and the theory it rejects is the one I am most concerned to combat.

Breeding Bird Use Of Intensively Managed Rotational Grazing Pastures, Native Prairies And Savannas: A Comparison, Jennifer Marie Hurley O'Hara Jan 1998

Breeding Bird Use Of Intensively Managed Rotational Grazing Pastures, Native Prairies And Savannas: A Comparison, Jennifer Marie Hurley O'Hara

Dissertations and Theses @ UNI

Intensively managed rotational grazing is a grazing method in which livestock are moved through a series of paddocks over a three to six week rotation. Vegetation in resting paddocks is allowed to regrow, renew energy reserves, and rebuild plant vigor to provide nutritious forage for livestock. Consequently, vegetation in the paddocks is in different stages of growth which creates a mosaic of vegetation heights across the pasture landscape. I hypothesized that the mosaic of vegetation heights resembles the native tallgrass prairie grazed by bison prior to European settlement. The mosaic may be attractive and beneficial to breeding grassland birds. Several …

Patient Dumping: Implications For The Elderly, George P. Smith Ii Jan 1998

Patient Dumping: Implications For The Elderly, George P. Smith Ii

Scholarly Articles

Before 1986, the Common Law provided that physicians and hospitals had no duty to admit or treat persons who sought their care except in limited circumstances. Congress enacted The Emergency Medical Treatment and Active Labor Act (EMTALA) to curb this so-called patient-dumping problem. EMTALA provides, essentially, that Medicare-participating hospitals must treat all patients who arrive in emergency conditions.

This article first discusses the patient-dumping problem and how EMTALA has provoked many hospitals to curtail their emergency facilities in order to avoid treating indigent and uninsured patients. The Article then proceeds to analyze the specifics of EMTALA’s main statutory provision, Section …

Single Gender Marriage: A Religious Perspective, Raymond C. O'Brien Jan 1998

Single Gender Marriage: A Religious Perspective, Raymond C. O'Brien

Scholarly Articles

This Article will offer a religious perspective which is a response to the legal arguments in favor of single-gender marriage. Three arguments will be made: first, that the religious perspective identified and associated with the Roman Catholic tradition offers a fundamental basis for family life that has been proven to be beneficial to society as a whole, and to the message of revelation consigned to Christians by Jesus Christ; second, inasmuch as the religious perspective is being contradicted by judicial interpretation rather than through legislative process, a tyranny of judicial activism has and is subverting a public policy consensus; and …

A Case Study Of Four Fifth Grade Teachers And Their Perceptions Of How And Why They Teach Science, Ana K. Houseal

Dissertations and Theses @ UNI

The purpose of this qualitative study was to explore the perceptions of four 5th grade teachers and their perceptions of the influences on how and why they taught science in their classrooms. The four participating teachers who were from three school districts in Iowa were observed teaching science lessons and interviewed following the observations. The results of the study showed that the data obtained during the observations and interviews focused on three major themes. The first theme centered on the teachers' perceptions of changes in teaching elementary science. These included a move away from text-based learning with a subsequent move …

Piezoelectric Biomechanical Assessment Of Swallowing Across Ages And Swallowing Task, Janel Elizabeth Crow Jan 1998

Piezoelectric Biomechanical Assessment Of Swallowing Across Ages And Swallowing Task, Janel Elizabeth Crow

Dissertations and Theses @ UNI

Even though the Modified Barium Swallow (l\1BS) is the gold standard for the evaluation of swallowing disorders, the MBS has several limitations ( e.g., invasiveness, cost and portability). Noninvasive tools to measure swallowing ability at low cost and with low risk to the patient are desirable. Recently, thin film, piezoelectric technology (Computerized Laryngeal Analyzer: CLA) has become available which allows for noninvasive biomechanical analysis of swallowing. Noninvasive biomechanical measurement of swallowing is possible due to the close correlation of hyolaryngeal movement, airway protection and upper esophageal sphincter (UES) opening (Jacob, Kahrilas, Logemann, Shah, & Ha, 1989). The vertical and anterior …

The Relationship Between Coping Strategies And Body Image Among Adolescent Females, Lisa Monae Yarrow Jan 1998

The Relationship Between Coping Strategies And Body Image Among Adolescent Females, Lisa Monae Yarrow

Dissertations and Theses @ UNI

The purpose of this study was to investigate the relationship between coping strategies and body image disturbance among adolescent females. Fifty-eight of 78 (74.4%) seventh grade female students at a midwestern middle school completed all phases of the research.

The Eating Attitudes Test (EAT-26; Gamer & Garfinkel, 1979) identified subjects with maladaptive eating behaviors. The Coping Inventory for Stressful Situations (CISS; Endler & Parker, 1990) and the Body Shape Questionnaire (BSQ; Cooper, Taylor, Cooper, & Fairburn, 1987) provided information concerning the type of coping strategies employed as well as feelings concerning appearance.

Pearson product-moment correlation was used to determine the …

Profile Of Adolescent Gambling Behaviors In Black Hawk County High School Students Ages 14-18, Holly A. Helm Jan 1998

Profile Of Adolescent Gambling Behaviors In Black Hawk County High School Students Ages 14-18, Holly A. Helm

Dissertations and Theses @ UNI

As gambling opportunities increase, adolescents are exposed to more forms of gambling and may be developing problematic gambling behaviors. Research seems to indicate a "growing trend that pathological gambling is becoming more common among young Americans" (Kerr, 1998, p. 27). Thus, the purpose of this study was to profile adolescent gambling behaviors that exist in Black Hawk County high school students between the ages of 14-18. In particular, this study sought to: (a) define adolescent perceptions of gambling; (b) tabulate the percentages of youth who are engaged in gambling activities; (c) identify money gambled; (d) examine who influences gambling behaviors; …

Coaching Philosophy Differences Among Ncaa Division Iii Head Men’S Basketball Coaches, Mark J. Franzen Jan 1998

Coaching Philosophy Differences Among Ncaa Division Iii Head Men’S Basketball Coaches, Mark J. Franzen

Dissertations and Theses @ UNI

The purpose of this study was to describe the coaching philosophies of men's head basketball coaches at the NCAA Division III level in three areas: (a) coach's expectation of the athlete, (b) coach's role in the overall development of the athlete, and ( c) conditions believed essential to maximize team performance. All of the coaches in this study were from private institutions. A modified questionnaire from Eitzen and Pratt (1989) was used as the instrument in this study. The questionnaire pertained to three areas of coaching philosophy and was divided into three sections: ( a) coach's expectation of the athlete, …

The Desegregation Of A Historically Black High School In Jacksonville, Florida, Judith Bockel Poppell Jan 1998

The Desegregation Of A Historically Black High School In Jacksonville, Florida, Judith Bockel Poppell

UNF Graduate Theses and Dissertations

This historical study examines the desegregation of a historically African- American high school during the period between 1965-1975. The Mims v. The Duval County School Board (1971) decision brought about radical changes in the operation of the Duval County Public Schools. The mass transfer of teachers and reassignment of students as a result of the federal judge's order in this case resulted in a school system that was dramatically different from the one that previously existed. The author seeks to determine why the desegregation of William Raines High School was short-lived and questions the continued effort of the school system …

A Bayesian Meta-Analysis Using The Gibbs Sampler, Shannon Marie Fair Jan 1998

A Bayesian Meta-Analysis Using The Gibbs Sampler, Shannon Marie Fair

UNF Graduate Theses and Dissertations

A meta-analysis is the combination of results from several similar studies, conducted by different scientists, in order to arrive at a single, overall conclusion. Unlike common experimental procedures, the data used in a meta-analysis happen to be the descriptive statistics from the distinct individual studies.

In this thesis, we will consider two regression studies performed by two scientists. These studies have one common dependent variable, Y, and one or more independent common variables, X. A regression of Y on X with other independent variables is carried out on both studies. We will estimate the regression coefficients of X …

A Java Implementation Of A Portable Desktop Manager, Scott J. Griswold Jan 1998

A Java Implementation Of A Portable Desktop Manager, Scott J. Griswold

UNF Graduate Theses and Dissertations

Computers equipped with a Graphical User Interface (GUI) and connected to the Internet are common in both the business and educational communities. These computers, using a web browser, easily share programs written in the Java programming language that are able to execute on a variety of heterogeneous machines.

While programs written in many languages will not execute unmodified on different computing platforms because of portability restrictions, Java has overcome these limitations and provides a platform independent language. However, every programming language is limited, and no language provides all the features required for every program. Therefore, creation of any portable program …

Courting Serendipity: Constructivist Theory And Classroom Practice, Marilyn Duckworth Jensen Jan 1998

Courting Serendipity: Constructivist Theory And Classroom Practice, Marilyn Duckworth Jensen

UNF Graduate Theses and Dissertations

This dissertation is a cross-case study and analysis of four teachers in a school involved in two reform initiatives which promote constructivist approaches to teaching and learning. The study describes the teachers' understandings of the learning theory and their interpretations of it in their classroom practice. The study found that three of the four teachers were practicing in ways consistent with constructivism while one was not because her need for control took precedence. The study found that although teachers are very aware of their students as individuals with different ways of learning and constructing an understanding, they are not much …

The Effects Of Systematically Fading Reinforcement While Maintaining Skills, Jodi Suzanne Bronson Jan 1998

The Effects Of Systematically Fading Reinforcement While Maintaining Skills, Jodi Suzanne Bronson

Dissertations and Theses @ UNI

A review of the literature describing treatment programs for young children with autism revealed two distinctly different strategies. One, the Lovaas approach (Lovaas, 1987), focused on an intense, one-on-one discrete trial training format implemented for approximately 40 hours per week. A prescribed curriculum targeted at social and communication skills is incorporated. The second program, TEACCH, emphasized an individualized curriculum selected after a careful assessment process to determine a person's strengths and limitations. Goals and objectives were subsequently implemented in highly structured special education classrooms where the focus was on antecedent control and the use of visually mediated strategies. Interviews with …

The War At Home: Prisoner Of War Camps In Iowa During World War Ii, Julie K. Heintz Jan 1998

The War At Home: Prisoner Of War Camps In Iowa During World War Ii, Julie K. Heintz

Dissertations and Theses @ UNI

Two base camps, along with their branch camps, located in the state of Iowa will provide the focus for this study. The camps in Iowa, located near the towns of Algona and Clarinda, provide an example of two camps that met or exceeded the criteria set by the Geneva Convention of 1929. The creation and administration of the camps raises three questions which constitute the body of this thesis. The first deals with the founding, administration and operation of the camps. Secondly, the study investigates the daily life of the camp inmates. Finally the third question examines how townspeople and …

Portrait Of Success: A Situational Analysis Case Study Of Students Challenged By Attention-Deficit/Hyperactivity Disorder, Sandra Hundley Zimmermann

Harold L. Hodgkinson Award for Outstanding Dissertation

This study examined factors that encouraged and supported academic success for students diagnosed with Attention-Deficit/Hyperactivity Disorder (ADHD). Students with ADHD are often not academically successful and do not graduate from high school, due in large measure to ADHD symptoms of (a) impulsive and reckless behaviors, (b) alienation from significant others including peers, and (c) disorganization. Students in this study overcame symptoms of ADHD and were academically successful.

The situational analysis case study design for this research utilized both qualitative methods (interview, observation, and record review) and quantitative instrumentation. Five students with ADHD comprised the case study sample. Data from student, …

Object-Oriented Programming And Parallelism, Atanas Radenski Jan 1998

Object-Oriented Programming And Parallelism, Atanas Radenski

Mathematics, Physics, and Computer Science Faculty Articles and Research

Initially, object-orientation and parallelism originated and developed as separate and relatively independent areas. During the last decade, however, more and more researchers were attracted by the benefits from a potential marriage of the two powerful paradigms. Numerous research projects and an increasing number of practical applications were aimed at different forms of amalgamation of parallelism with object-orientation. It has been realized that parallelism is a inherently needed enhancement for the traditional object-oriented programming (OOP) paradigm, and that object orientation can add significant flexibility to the parallel programming paradigm.

Commercial Codification As Negotiation, David Frisch Jan 1998

Commercial Codification As Negotiation, David Frisch

Law Faculty Publications

Part I of this Article endeavors to put the sales law in perspective by emphasizing its role in the broader system of commercial law. Then, in Part II we focus on a particular example (the buyer's right to recover goods upon the seller's insolvency) to support our general observation that the revision reflects a fatal insensitivity to the need for article 2 to fit with other bodies of commercial codification. Part III demonstrates the revi~ion's failure to come to terms with the role of context and makes the argument that the drafters' shortsightedness is evidenced by the manner in which …
