If Not Marriage? On Securing Gay And Lesbian Family Values By A "Simulacrum Of Marriage", Craig W. Christensen Jan 1998

If Not Marriage? On Securing Gay And Lesbian Family Values By A "Simulacrum Of Marriage", Craig W. Christensen

Fordham Law Review

The benefits of [homosexual] marriage may outweigh the costs. Nonetheless, since the public hostility to homosexuals in this country is too widespread to make homosexual marriage a feasible proposal even if it is on balance cost-justified, maybe the focus should be shifted to an intermediated solution that would give gomosexuals most of what they want . . . . . . . What . . . is called registered partnership and . . . homosexual cohabitation [in some countries] is in effect a form contract that comosexuals can use to create a simulacrum of marriage. Richard A. Posner, Sex and …

Our Administrative System Of Criminal Justice, Gerard E. Lynch Jan 1998

Our Administrative System Of Criminal Justice, Gerard E. Lynch

Fordham Law Review

In Honor of William M. Tendy. Bill Tendy was already a legend among federal prosecutors when I first served as an Assistant United States Attorney for the Southern District of New York in the early 1980s. To us youngsters, Bill even then seemed a survivor from another era, when prosecutors really did resemble the tough-talking Hollywood DAs played by actors like Brian Donleavy - while we felt more like insecure young lawyers who should be played by Michael J. Fox or Calista Flockhart. Partly, of course, this was just a function of age and experience; hard as it was to …

Theses

This study has been carried out at a time when Tralee is trying to develop a viable tourism industry and aims at analysing the impact of this process. It studies Tralee s transition over the last decade from being a commercial town to becoming a recognised tourist destination. The present state of the local tourism product is portrayed and fixture courses of action suggested. This analysis is conducted utilising the views of tourists, tourism operators in the town and current industry thinking. Relationship Between Attachment And Out-Of-Home Placements In Emotionally And Behaviorally Disordered Male Adolescents, Gail M. Curran Jan 1998

Relationship Between Attachment And Out-Of-Home Placements In Emotionally And Behaviorally Disordered Male Adolescents, Gail M. Curran

Open Access Master's Theses

Since its inception, Bowlby's attachment theory has guided research in the area of attachment. A body of literature supports the conclusion that when attachment needs are not met in the first year of life, serious deficits and problems can occur. The present study adds to the existing literature by examining attachment in adolescents, an age group not frequently researched. Specifically, this study examines the relationship between attachment and multiple out-of-home placements for adolescent males living in a residential treatment facility.

In order to understand the characteristics of youth living in a residential treatment facility, an archival search was completed to …

Patterns Of Organochlorine Pesticide Contamination In Neotropical Migrant Passerines In Relation To Wintering Range And Wintering Habitat, Jeffrey A. Klemens '98 Jan 1998

Patterns Of Organochlorine Pesticide Contamination In Neotropical Migrant Passerines In Relation To Wintering Range And Wintering Habitat, Jeffrey A. Klemens '98

Honors Projects

Seventy-two Neotropical migrant passerines were analyzed for the presence of 17 organochlorine pesticide residues (aldrin; alpha-BHC; beta-BHC; gamma-BHC; delta-BHC; p,p'-DDD; p,p'-DDE; p,p'-DDT; dieldrin; endosulfan I; endosulfan II; endosulfan sulfate; endrin; endrin aldehyde; heptachlor- heptachlor epoxide; methoxychlor) using standard method of gas chromatography applied to bird tissues. Individuals were colIected along the Mississippi River during May 1996 and represent 11 species (Catharus ustulatus; Geothlypis trichas; Protonotaria citrea; Mniotilta varia; Contopus virens; Dendroica petechia; Ernpidonax minimus; Passerina cyanea; Myiarchus crinitus; Vireo gilvus). The contaminants most frequently detected were p,p'-DDE, dieldrin, and heptachlor epoxide. No significant difference was found between male and female …

The Total Synthesis Of A Conformationally Constrained Organophosphorus Analog Of Acetycholine, Justin Mergott '98 Jan 1998

The Total Synthesis Of A Conformationally Constrained Organophosphorus Analog Of Acetycholine, Justin Mergott '98

Honors Projects

We propose the total synthesis of a conformationally constrained organophosphorus analog of acetylcholine (5, Scheme 5). This compound will contain two crural centers, one being the phosphorus atom and the other being the pyrrolidine ring carbon beta to the phosphorus atom. The chiral beta carbon is conformationally constrained because it is part of the pyrrolidine ring. Studies with such a compound should allow us to make substantial progress towards the clarification of the stereospecificity of AChE inhibition by OP compounds and eventually help us understand more about the structure of the AChE active site. The synthesis begins with Cbz-L-proline methyl …

Misery And Madness?: The Irish Face In Modern Irish Drama, Rob Mawyer '98 Jan 1998

Misery And Madness?: The Irish Face In Modern Irish Drama, Rob Mawyer '98

Honors Projects

The primary point of this paper is to examine the Irish face as it is seen in these dramas, analyzing how it functions as a symbol of the identity of Irish manhood. On one level, the Irish face reflects the traditional stereotype of the Irish hero: pathetic, drunken, crazy. It incorporates everything that is detestable about being Irish. However, it is also a shield, representing a strength that is not initially apparent. The Irish face establishes a distance from the misery and emptiness of life, a distance that underscores both the isolation of the character and the inner strength that …

An Emerging Consensus: Reproductive Technology And The Law, Janet L. Dolgin Jan 1998

An Emerging Consensus: Reproductive Technology And The Law, Janet L. Dolgin

Hofstra Law Faculty Scholarship

The advent and swift expansion of reproductive technology beginning in the late 1970s accelerated the transformation of the family by undermining sacred assumptions about the reproductive process. In vitro fertilization, embryo transfer, surrogacy, and the cryopreservation of gametic and embryonic material have challenged deeply internalized assumptions about the character and social implications of human reproduction. In addition, reproductive technology has placed third parties -- doctors, lawyers, egg or sperm donors, and gestational or "traditional" surrogates -- directly at the center of the reproductive process. Inevitably, disputes have developed about the nature and parameters of parenthood and about the rights and …

Efficiency, Entitlements, And The Value Of Consent, Jarod Bona '98 Jan 1998

Efficiency, Entitlements, And The Value Of Consent, Jarod Bona '98

Res Publica - Journal of Undergraduate Research

What methods should we use to protect a legal entitlement or right? Guido Calabresi and A. Douglas Melamed in their 1972 article, "Property Rules, Liability Rules, and Inalienability: One View of the Cathedral," introduced the distinction between property rules and liability rules that has now formed the template of the debate over this vitally important question. Many look at this debate from the angle of an efficiency- seeking state. To truly evaluate the efficiency of these two rules, we must look beyond the typical determinants of individual valuations. Indirectly, this will take us to ideas related to consent and, more …

The Role Of Social Support In Mediating Stress And Illness, Valerie M. Stachour '98 Jan 1998

The Role Of Social Support In Mediating Stress And Illness, Valerie M. Stachour '98

Honors Projects

Social Support has been shown to be one important factor in the link between stress and illness. In this study, the role of social support is examined in light of the two different categorizations of social support: quality and quantity. High quality and high quantity social support groups were hypothesized to be correlated with lower illness levels. In an attempt to explore the relative merits of the main effect and the buffering hypotheses, the relative role of social support to stress and illness was examined. There was a significant correlation between quality of social support and illness levels. Quantity of …
