Entering the twenty-first century, Americans, like most people around the world, regard the Internet as a free and unregulated means of communication. Naive to its origins, many individuals surf the Internet unaware of the debates concerning its regulation.

In March 1996, America's Carriers Telecommunication Association (ACTA), a trade association of roughly 130 long-distance carriers, petitioned the Federal Communications Commission (FCC) to confirm "its authority over interstate and international telecommunications services using the Internet." More specifically, the ACTA petition requested that the FCC enjoin software distributors of long-distance telephone software and other providers of non-tariffed and uncertified entities, compelling them to …

Extension Of Copyright To Fonts-Can The Alphabet Be Far Behind?, Jonathan L. Mezrich

In February 1998, a federal district court issued a decision that may have a profound impact on the software industry. The court held, in Adobe Systems, Inc. v. Southern Software, Inc., that copyright law protects "software programs" that create fonts that are distinct typefaces. This ruling is ill-conceived. While people should be rewarded and protected for their creativity, copyright law should not be extended to cover the "artwork" inherent in font "glyphs," which, in their most basic form, comprise the alphabet itself.

Several animal studies have brought the cholinergic hypothesis of Alzheimer's Disease (AD) into question. In addition, recent clinical studies have shown that the number of neuritic plaques and neurofibrillary tangles does not yield a conclusive diagnosis of AD. A reassessment of risk factors involved in AD development has led to findings that atherosclerosis is associated with dementia. The present study is a clinical analysis, through the use of case studies, of the relationship between atherosclerosis severity, based on autopsy results, and AD severity, based on scores from cognitive tests and functional assessments, as well as autopsy results. An Investigation Into The Development Of Engineering Students' Conceptual Understanding Of Mathematics, Wendy Mary Maull

Following widespread concern over an apparent decline in the mathematical skills of engineering students, this study employed survey and observation methods to investigate the ways in which engineering students understand mathematical concepts, and to compare these with the concepts held-by students of mathematics. It was found that the engineering students employ a different vocabulary from mathematics students in discussing mathematics, and that their understanding of mathematical concepts develops differently from mathematics students both in response to teaching (which appears to be a transitory effect) and as their experience gives meaning to the ideas in life outside study. The Orientation Toward Domestic Labor Questionnaire: Exploring Dual-Earner Wives' Sense Of Fairness About Family Work, Alan J. Hawkins, Christina M. Marshall, Sarah M. Allen

This study explored the psychometric properties of the Orientation Toward Domestic Labor Questionnaire (ODL-Q) with a sample of 622 dual-earner wives. Adequate internal consistency reliability was obtained for most of the construct in the ODL-Q. In addition, construct validity for the ODL-Q was provided with multiple regression and discriminant analyses of the constructs' relationships to wives' sense of fairness about family work. The ODL-Q scales accounted for 57% of the variance in wives' sense of fairness. Effective communication about domestic labor (expressions of appreciation, sympathetic listening, mutual decision making) was by far the most powerful predictor and discriminator of fairness. …

Personal Jurisdiction And The Internet Quagmire: Amputating Judicially Created Long-Arms

This Comment will explore the expanding power courts have given the word “haled” and its relationship to computer communication: a relationship that is confusing, contradictory, and sometimes downright troubling. Personal jurisdiction via the internet is a rapidly expanding area of American jurisprudence that has developed, and is developing, in response to the explosive growth of computer communications. While the hypothetical internet disclaimer contained above could be viewed as little more than unsubstantiated fears of the legally paranoid, in the future it may be the disclaimer of the legally prudent.

In 1996, the California legislature took steps to modify existing contractual relationships between physicians and managed care organizations (“MCOs”).Legislative action was prompted by skyrocketing medical malpractice verdicts, cries from physicians about unfair treatment caused by new payment systems, and media hysteria. Regardless of which straw broke the proverbial camel’s back, the result was no fewer than four bills that promise to forever change health care in California.

This thesis describes the background, investigation and construction of a system for storing data on the magnetic stripe of a standard three-inch plastic credit in: inch card. Investigation shows that the information storage limit within a 3.375 in by 0.11 in rectangle of the stripe is bounded to about 20 kBytes. Practical issues limit the data storage to around 300 Bytes with a low raw error rate: a four-fold density increase over the standard. Removal of the timing jitter (that is prob-' ably caused by the magnetic medium particle size) would increase the limit to 1500 Bytes with no other …

The aim of the project on which this thesis is based is to develop reliable techniques for foetal electrocardiogram (ECG) based monitoring, to reduce incidents of unnecessary medical intervention and foetal injury during labour. World-wide electronic foetal monitoring is based almost entirely on the cardiotocogram (CTG), which is a continuous display of the foetal heart rate (FHR) pattern together with the contraction of the womb. Despite the widespread use of the CTG, there is no significant improvement in foetal outcome. In the UK alone it is estimated that birth related negligence claims cost the health authorities over £400M per-annum. An …

"Pro-Life" Absolutes, Feminist Challenges: The Fundamentalist Narrative Of Irish Abortion Law 1986-1992, Ruth Fletcher

Osgoode Hall Law Journal

This article asks how Irish abortion law developed to the point of stopping a young pregnant rape victim from travelling abroad to have an abortion in 1992 (Attorney General v. X.). The author argues that this case, which ultimately saw the Irish Supreme Court overturn that decision and recognize the young woman's right to abortion, was the last chapter of the fundamentalist narrative of Irish abortion law. The feminist critique of that law needs to consider its particular fundamentalist aspects in order to clarify the obstacles posed to the struggle for Irish women's reproductive freedom. Domestic violence is receiving increasing attention in the media, communities, and classrooms across the country. It is suggested a minimum of from 2 to 3 million women are assaulted by male partners each year in the United States. More than 3 out of every 100 or 1.8 million women were severely assaulted as they were kicked, punched, choked, beaten, threatened with a knife or gun, or had a knife or gun used on them. The purpose of this study was to begin to understand what motivates women to participate in marathons. Twenty-seven Caucasian women enrolled in the "Seminar in Fitness and Mental Health" at a Midwest university answered the questionnaire (Motivations of Marathoners Scale Questionnaire). After participants completed the questionnaire a focus group interview was conducted with six participants. The Motivations of Marathoners Questionnaire was used to identify the participants' motives to run a marathon. The questionnaire contained 56 items distributed across nine scales. Bioremediation of contaminated soil and water has been the topic of considerable research interest. White rot fungi have recently been proposed for use in biodegradation of explosives. The explosives, TNT, RDX and HMX are integral components of the manufacture of munitions. The wastes from the production of these and other explosives have been discharged into the surrounding environment resulting in contamination. Phanerochaete chrysosporium and strain F600, a proprietary white rot fungus developed by Mycotech Corporation, were studied with regard to their ability to degrade TNT, HMX and RDX in liquid cultures and in soil. New technologies such as site bioremediation using microorganisms or microbial processes that enhance contaminant detoxification and destruction are being developed. This project assessed the success of bioremediation by a white rot fungus. The material tested was soil from Virginia site contaminated with a mixture of explosives (TNT, RDX, and HMX). The purpose of this qualitative study was to explore the perceptions of four 5th grade teachers and their perceptions of the influences on how and why they taught science in their classrooms. The four participating teachers who were from three school districts in Iowa were observed teaching science lessons and interviewed following the observations. The results of the study showed that the data obtained during the observations and interviews focused on three major themes. The first theme centered on the teachers' perceptions of changes in teaching elementary science. These included a move away from text-based learning with a subsequent move …
