Australia’S National Drought Policy Continues To Evolve, David H. White Jun 1998

Australia’S National Drought Policy Continues To Evolve, David H. White

Drought Network News (1994–2001)

Australia is an arid continent with a high variability in its annual rainfall. Given the frequency and severity of droughts and the consequent high financial and social costs to the nation and to individuals, and the associated potential for further degradation of the land, a national policy on drought was clearly needed.

Australia’s National Drought Policy (NDP) was ratified by the state and Commonwealth (federal) governments in 1992 (White, 1993; White et al., 1993; White and O’Meagher, 1995). Its aims are to:

• encourage primary producers and other sections of rural Australia to adopt self-reliant approaches to managing for climatic …

From The Director: June 1998, Donald A. Wilhite

Drought Network News (1994–2001)

The 1997–98 El Niño event has certainly raised the public’s level of awareness of the impact of climate on society. Although the concern in the United States has focused more on mitigating the potential effects of floods, not all regions of the country are dealing with water surplus situations. An emerging drought in Montana and parts of some surrounding states has caught the attention of scientists and policy makers in recent months. Worldwide, droughts in Central America, Mexico, Brazil, Hawaii, some Pacific island nations, Indonesia, Australia, southern Africa, and elsewhere have attracted the attention of scientists, policy makers, and the …

New German Telecommunications Act, The, Axel Spies, Jan F. Wrede Jun 1998

New German Telecommunications Act, The, Axel Spies, Jan F. Wrede

Michigan Telecommunications & Technology Law Review

In the wake of the debate in Germany on how to weather the storms against the "marketplace Germany" (Unternehmensstandort Deutschland) the new German Telecommunications Act ("TA") has been earmarked as a milestone. Its supporters hail the TA to spur competition in Germany's telecommunications market, which they expect to have a turnover of over DM 100 billion (app. US $66 billion) by the year 2000.... This article seeks to summarize the salient features of the TA and to outline the perspectives for potential foreign investors in the German telecommunications market as to the regulatory environment such investor will face. For this …

"Chilling" The Internet? Lessons From Fcc Regulation Of Radio Broadcasting , Thomas W. Hazlett, David W. Sosa Jun 1998

"Chilling" The Internet? Lessons From Fcc Regulation Of Radio Broadcasting , Thomas W. Hazlett, David W. Sosa

Michigan Telecommunications & Technology Law Review

Congress included the Communications Decency Act (CDA) in the Telecommunications Act signed into law on February 8, 1996. The bill seeks to outlaw the use of computers and phone lines to transmit "indecent" material with provisions of jail terms and heavy fines for violators. Proponents of the bill argue it is necessary to protect minors from undesirable speech on the Internet. The CDA was immediately challenged in court by the American Civil Liberties Union, and the special 3-judge federal panel established to hear the case recently declared the Act unconstitutional. Yet, its ultimate adjudication remains in doubt. Ominously, the federal …

What State Am I In?: Common Law Trademarks On The Internet , Brian L. Berlandi Jun 1998

What State Am I In?: Common Law Trademarks On The Internet , Brian L. Berlandi

Michigan Telecommunications & Technology Law Review

This essay explores the interaction between common law trademarks and the Internet--a relationship that has yet to be scrutinized by the intellectual property and Internet communities. More specifically, it strains to identify a common law mark's territorial zone of protection with respect to the Internet. This is an ambitious endeavor from the start, for there is no case law or published academic material available or directly on-point. As a result, this essay will not be a critique of judicial precedent or academic opinion. Instead, it offers a premonition of future case law and a foreshadowing of legal scenarios that might …

Law Of Nations In Cyberspace: Fashioning A Cause Of Action For The Supression Of Human Rights Reports On The Internet , Thomas Cochrane

Michigan Telecommunications & Technology Law Review

For nearly two decades, two U.S. statutes have provided redress to victims of human rights abuses: the Alien Tort Statute and the Torture Victim Protection Act. A handful of plaintiffs have recovered under these laws against foreign perpetrators of a narrow range of human rights violations. The growth and proliferation of communications technology raises important questions about how these statutes will be used in the future. Human rights activists have discovered that they can instantly communicate over the Internet with supporters and news media anywhere in the world. Repressive regimes have responded by attempting to restrict such communications. Could cutting …

Gemeindegeschichte Als Vergleichende Geschichte: The Church Of Jesus Christ Of Latter-Day Saints In East Germany, Bruce W. Hall Jun 1998

Gemeindegeschichte Als Vergleichende Geschichte: The Church Of Jesus Christ Of Latter-Day Saints In East Germany, Bruce W. Hall

Theses and Dissertations

From 1945 until the fall of the Berlin Wall in 1989, the Church of Jesus Christ of Latter-day Saints (LDS) in the former German Democratic Republic (GDR) endured the hardships of existing as a religious organization under a Communist regime. An evaluation of the LDS Church within the category of general and minority religions, which serves as a microcosmic evaluation of religion in the GDR, constitutes one part of this study. The uniqueness of the LDS Church and its experience - especially its American ties, ironically earlier a liability and later an asset - make it a candidate for a …

The Electronic Media And The Flight From First Amendment Doctrine: Justice Breyer's New Balancing Approach, Jerome A. Barron Jun 1998

The Electronic Media And The Flight From First Amendment Doctrine: Justice Breyer's New Balancing Approach, Jerome A. Barron

University of Michigan Journal of Law Reform

Contemporary First Amendment issues in cases involving the electronic media transcend traditional conflicts between the government and the speaker. The speaker is not easy to identify. Listeners, programmer and medium operators or distributors all have competing claims to First Amendment protection. To determine whose interests shall prevail, courts increasingly seek a methodology that accounts for these warring interests. Justice Breyer, along with Justice Souter and, in some respects, Justice Stevens, have been instrumental in reviving balancing as a First Amendment approach in these situations.

In two recent First Amendment cable television cases Turner Broadcasting System, Inc. v. FCC (Turner II) …

A Proposal To The Hanodaganyas To Decolonize Federal Indian Control Law, Robert B. Porter Jun 1998

A Proposal To The Hanodaganyas To Decolonize Federal Indian Control Law, Robert B. Porter

University of Michigan Journal of Law Reform

In this Article, cast in the form of a letter to President William Jefferson Clinton, Professor Porter argues for the decolonization of federal Indian control law. After detailing the religious and colonialist roots of early Supreme Court decisions dealing with the Indian nations and giving an overview of the evolution of federal Indian policy, Professor Porter argues for the decolonization of federal Indian control law on several grounds: 1. the world community has rejected colonialism policies; 2. federal Indian control law denies basic human rights of self-determination; 3. colonization has partially succeeded in destroying the Indian nations; and 4. decolonization …

Clouded Horizons: Catholic Higher Education In The Coming Decade, Martin F. Larrey Jun 1998

Clouded Horizons: Catholic Higher Education In The Coming Decade, Martin F. Larrey

Journal of Catholic Education

Catholic institutions of higher education in the United States are increasingly finding themselves at risk concerning their survival because of potential threats in five principal areas: 1) changing delivery systems, 2) a failure of management, 3) Catholic identity and religious affiliation, 4) competitive price structures, and 5) the volatility of enrollment. Yet there is no remorseless law of entropy to which Catholic colleges and universities are inexorably bound. There are many choices facing us, some better than others, and only a few really bad. Two of the latter are: to do nothing or, worse, to continue to do things the …

A Sabbatical View Of Educational Technology, Margaret E. Curran Jun 1998

A Sabbatical View Of Educational Technology, Margaret E. Curran

Journal of Catholic Education

Catholic schools throughout the country are actively engaged in the process of integrating technology into their schools. A wide range of programs exists, and those programs are at various stages of development. The author visited a sample of schools that have a strong technology emphasis and identifies key elements within those programs. A review of those elements can be helpful in creating new programs.

Expression Of Human Lactoferrin Cdna Confers Resistance To Ralstonia Solanacearum In Transgenic Tobacco Plants, Zhanyuan Zhang, Dermot P. Coyne, Anne K. Vidaver, Amitava Mitra Jun 1998

Expression Of Human Lactoferrin Cdna Confers Resistance To Ralstonia Solanacearum In Transgenic Tobacco Plants, Zhanyuan Zhang, Dermot P. Coyne, Anne K. Vidaver, Amitava Mitra

Department of Plant Pathology: Faculty Publications

A construct containing a human lactoferrin cDNA was used to transform tobacco (Nicotiana tabacum) using an Agrobacterium-mediated DNA-transfer system to express this human protein in transgenic plants. Transformants were analyzed by Southern, Northern, and Western blots to determine integration of the cDNA into the plant genome and lactoferrin gene expression levels. Most transgenic plants demonstrated significant delays of bacterial wilt symptoms when inoculated with the bacterial pathogen Ralstonia solanacearum. Quantification of the expressed lactoferrin protein by enzyme-linked immunosorbent assay in transgenic plants indicated a significant positive relationship between lactoferrin gene expression levels and levels of disease …
