How Far Do The Powers Of The I.R.S. Extend In The Fifth Circuit? Johnson V. Sawyer, Darrell Calvin Oct 1998

How Far Do The Powers Of The I.R.S. Extend In The Fifth Circuit? Johnson V. Sawyer, Darrell Calvin

Texas Wesleyan Law Review

The Fifth Circuit chose to recognize a judicially-created exception to the statute in Johnson v. Sawyer. This Note takes issue with the Fifth Circuit's holding in Johnson. The IRS is a creature of statute and, as such, should be governed by statute. If any further life is given the agency, it is for Congress, and not the judiciary to declare. If taxpayers convicted in the Fifth Circuit are to have their transgressions publicized, it should be with the specific approval of their elected representatives. Part I of this Note traces the development of judiciallycreated exceptions to I.R.C. § 6103 in …

Use Of Another's Trademark In A Web Page Meta Tag: Why Liability Should Not Ensue Under The Lanham Act For Trademark Infringement, Michael R. Sees

Texas Wesleyan Law Review

This Comment argues that liability for trademark infringement should not ensue under the Lanham Act when an unauthorized user incorporates a senior holder's registered trademark in a web page meta tag.4 Part I discusses the Lanham Act and the various elements that must be satisfied in order to prevail on a cause of action for trademark infringement. Part II provides a background of the Internet and World Wide Web. Part III discusses how a typical cause of action for trademark infringement in this situation may arise. Part IV analyzes the issue and demonstrates why liability should not ensue. In short, …

Reclaiming Hope: Teacher Education And Social Justice In The Age Of Globalization, Peter Mclaren, Gustavo Fischman

Education Faculty Articles and Research

"Our overarching position is unashamedly and avowedly criticalist: we believe that unless teacher education locates the pedagogical education of future teachers within the context of an examination of the current glorification of global corporatism and the capitalist economy's ability for self-valorization, teacher education will remain delinked from necessary and urgent political conversations and practices."

Aim And Objectives Of The Landmine Victims Data Collection, A. Aziz Ahmadzai Oct 1998

Aim And Objectives Of The Landmine Victims Data Collection, A. Aziz Ahmadzai

The Journal of Conventional Weapons Destruction

The 20 years of war in Afghanistan, beside other legacies, has left over 850 square kilometers of land and approximately 1,500 villages contaminated with landmines. Although official figures are not available, it is estimated that more than 400,000 people have either been killed or maimed by these perilous weapons. The majority of the over 400,000 victims are civilians, many of whom are women and children. Despite these facts, no proper and reliable data on the landmine victims in Afghanistan has yet been collected by any agency or organization. The Mine Clearance Planning Agency (MCPA), with its mandate to conduct landmine-related …

The Pseudomonas Syringae Pv. Tomato Hrpw Protein Has Domains Similar To Harpins And Pectate Lyases And Can Elicit The Plant Hypersensitive Response And Bind To Pectate, Amy O. Charkowski, James R. Alfano, Gail Preston, Jing Yuan, Sheng Yang He, Alan Collmer

Center for Plant Science Innovation: Faculty Publications

The host-specific plant pathogen Pseudomonas syringae elicits the hypersensitive response (HR) in nonhost plants and secretes the HrpZ harpin in culture via the Hrp (type III) secretion system. Previous genetic evidence suggested the existence of another harpin gene in the P. syringae genome. hrpW was found in a region adjacent to the hrp cluster in P. syringae pv. tomato DC3000. hrpW encodes a 42.9-kDa protein with domains resembling harpins and pectate lyases (Pels), respectively. HrpW has key properties of harpins. It is heat stable and glycine rich, lacks cysteine, is secreted by the Hrp system, and is able to elicit …
