India And Australia: A Neglected Legal Relationship And A Plan Of Action, The Hon Justice Michael Kirby Ac Cmg Jul 1998

India And Australia: A Neglected Legal Relationship And A Plan Of Action, The Hon Justice Michael Kirby Ac Cmg

National Law School Journal

The neglect by Indian and Australian lawyers of each other is as tragic as it is puzzling. It is tragic because it represents a lost opportunity for two common law countries, which are federations, which live by the rule of law, which are governed under democratic, parliamentary constitutions and which, in their different ways, protect fundamental human rights and basic freedoms. Australia, like India has a most creative and professional law reform system. Most law reform in Australia is achieved through the political process, i.e. through the initiatives of government and the public service. Two countries sharing so many historical, …

Uses And Misuses Of Comparative Law In International Human Rights: Some Reflections On The Jurisprudence Of The European Court Of Human Rights, Paolo G. Carozza Jul 1998

Uses And Misuses Of Comparative Law In International Human Rights: Some Reflections On The Jurisprudence Of The European Court Of Human Rights, Paolo G. Carozza

Journal Articles

Virtually all of Mary Ann Glendon's work can be seen as part of a persistent effort to open some windows in the edifice of American law and allow cross-currents of foreign experience to blow fresh insight into the rooms of our republic. In her critique of contemporary strains of rights discourse in the United States, she makes the case against American insularity quite directly: "In closing our own eyes and ears to the development of rights ideas elsewhere, our most grievous loss is ... the kind of assistance ... that can be gained from observing the successes and failures of …

Meta-Ethnographic Development Of A Dialogue Methodology Applied To Organization Discourse, Shelley P. Gallup Jul 1998

Meta-Ethnographic Development Of A Dialogue Methodology Applied To Organization Discourse, Shelley P. Gallup

Engineering Management & Systems Engineering Theses & Dissertations

A gap exists between theoretical stances that acknowledge the importance of dialogue as a dynamic within socially constructed structures, and "steersmanship" of those constructs--e.g., directing, intervening or transforming organizations. A "mechanism" which links theory with practice is missing, leaving practitioners with an acknowledgment of dialogue's central position, but without tools to enact this centrality in practice or research. This research constructs a conceptual model of dialogue, derived from the literature. Using this model as a base, the research seeks to generate a dialogue methodology bridging theory and practice with respect to organizational dialogue. The model, methodology, and research results are …

Communication To Reduce Embarrassment Between Individualistic And Collectivistic Cultures, Puvana Ganesan Jul 1998

Communication To Reduce Embarrassment Between Individualistic And Collectivistic Cultures, Puvana Ganesan

Institute for the Humanities Theses

lntercultural communication is an inherent aspect of life, and "as we move or are driven toward a global village and increasingly frequent cultural contact, we need more than simply greater factual knowledge of each other. We need, more specifically, to identify what might be called the 'rulebooks of meaning' that distinguish one culture from another" (Barnlund, 1975, p. 7).

This thesis sought to discover and contribute valuable content to this "rulebook of meaning" through intercultural communication between high context, collectivistic cultures and low-context, individualistic cultures in the situation of experiencing embarrassment. One goal of this study was to determine if …

Temporal Lobe Transients And Prayer, Donald E. Newberry Jul 1998

Temporal Lobe Transients And Prayer, Donald E. Newberry

Theses and Dissertations

Persinger (1983) theorized that religious experiences involve the production of brief, micro-seizures that originate in the limbic system and affect the temporal lobes of the brain. According to this theory, ritual behavior could be used by individuals to induce micro-seizure activity. The theory predicted that an increase in alpha and theta activity in the temporal lobes of the brain would occur when subjects had a religious experience.

To test this, male and female Christian college students completed a Prayer Experiences Questionnaire inquiring about their religious experiences during prayer. Individuals scoring in the upper and lower 30 percent of the possible …

Intermarriage In Hidalgo County, 1860-1900, Ana Cristina Downing De De Juana Jul 1998

Intermarriage In Hidalgo County, 1860-1900, Ana Cristina Downing De De Juana

Theses and Dissertations - UTB/UTPA

David Montejano and others characterize early Hispanic-Anglo relations as operating under a "peace structure," during which the two groups developed strong alliances. However, they suggest that after 1848, "conflict and distrust" replaced it. These studies rely on anecdotal evidence. To date, no one has sought to verify them using actual patterns of social interaction.

This study addresses intermarriage between Hispanic, white non-Hispanic, Black and mixed heritage individuals in Hidalgo County. The quantitative data shows that the demographic characteristics of the area played a major role in defining the patterns of intermarriage. However, it points to a multiethnic society that intermarried …

A Generation Of Human Rights: Looking Back To The Future, Rosalie Silberman Abella Jul 1998

A Generation Of Human Rights: Looking Back To The Future, Rosalie Silberman Abella

Osgoode Hall Law Journal

The author traces the development of human rights in North America since the Second World War, and examines the socio-political environment in which these developments took place. In examining what appears to be an existing backlash against the earlier vigorous pursuit of rights for disadvantaged groups, the author distinguishes between civil liberties and human rights, and focuses on how a preoccupation with civil liberties is impeding the ability to promote human rights. She concludes by discussing the evolution of human rights for women this generation, and observes that while there have been significant gains, especially numerically, there has also been …

Šawaš Ili?I-Šawaš Wawa -- 'Indian Country--Indian Language' : A Participant Observation Case Study Of Language Planning By The Confederated Tribes Of The Grand Ronde Community Of Oregon, Gregry Michael Davis

Dissertations and Theses

The Kwelth Tahlkie Culture and Heritage Board (KTC&HB) of the Confederated Tribes of the Grand Ronde Community of Oregon (CTGR) have made it a priority to revitalize one of the languages which historically has been associated with being a Grand Ronde Indian-Chinook Jargon, referred to as činuk wawa 'Chinook talk' or simply činuk.

The purpose of the present study was to observe the language planning process as executed by the KTC&HB. Initial guiding questions were: (i) What stages is the KTC&HB going through in the process of planning for činuk revitalization? (ii) How do these efforts compare with theory and …

Does A Phonological Intervention Program Using A Modified Auditory Discrimination In Depth Program Make A Difference In Kindergarten Students' Ability To Manipulate Phonemes?, Julie Kay Osbourne

Masters Theses

The purpose of this study was to determine if a training program based on the Lindamood Auditory Discrimination in Depth Program made a difference in students' abilities to manipulate phonemes and identify similarities and differences in initial consonants between words. Kindergarten students were pre- and post-tested using the Test of Phonological Awareness (TOPA) and the Test of Auditory Analysis Skills. While students showed substantial improvement in their abilities to manipulate phonemes, their improvement on initial consonant skills, as measured by the TAAS was not as substantial.

Speech Parameters Affects On Social Acceptability Ratings Of Adolescents With Repaired Cleft Lip And/Or Palate, Sarah Telkins Hoff

Dissertations and Theses

The current study explored speech social acceptability ratings of adolescents with and without orofacial clefts. The study utilized speech samples previously collected on 80 adolescents, 40 cleft and 40 noncleft, dubbed on to a stimulus tape in a random order. From an earlier study the following were available: (a) adolescent (cleft and noncleft) self-ratings of speech social acceptability, (b) objective ratings of the adolescents' speech social acceptability provided by a listener panel with no background in speech-language pathology. New data were collected by recruiting a new listener panel of 10 graduate students with training in speech-language pathology, utilizing a 7-point …

Multiple Media Correlation: Theory And Applications, Charles B. Owen Jun 1998

Multiple Media Correlation: Theory And Applications, Charles B. Owen

Dartmouth College Ph.D Dissertations

This thesis introduces multiple media correlation, a new technology for the automatic alignment of multiple media objects such as text, audio, and video. This research began with the question: what can be learned when multiple multimedia components are analyzed simultaneously? Most ongoing research in computational multimedia has focused on queries, indexing, and retrieval within a single media type. Video is compressed and searched independently of audio, text is indexed without regard to temporal relationships it may have to other media data. Multiple media correlation provides a framework for locating and exploiting correlations between multiple, potentially heterogeneous, media streams. The goal …
